** The $50 Guarantee Fee per student MUST be paid in full to secure your spot in your chosen class/es. This amount will then be deducted off your first months fees.
Maxi-Jazz Dance Studio Pty Ltd
2023 TERMS and CONDITIONS
1. ALL-INCLUSIVE PRICE PACKAGING
1.1 - All class packages are a set price, payable per student. All monies paid are non-refundable and cannot be transferred to another student/account.
1.2 - All classes have 11 equal monthly instalments, payable in February - December inclusive.
1.3 - All instalments will be applied to your account on the 15th day of the month prior (or upon enrollment if after 15th January 2023) and are due to be paid in full by the 1st of the month. i.e February instalment will be charged on the 15th January 2023 and is due to be paid in full by the 1st February 2023.
*Please note that your February 2023 instalment will be debited from your nominated account via AutoPay on Monday 30th January 2023 due to our dance season commencing prior to February.
1.4 - For students that enrol after the 2023 Dance Season start date (Monday 30th January 2023), the full monthly instalment will be charged for the month in which classes are commenced.
1.5 - For students who enrol after 1st March 2023, a Performance Package Fee will be charged at $35 per month for each class I.e. If you commence classes in April 2032, a Performance Package will be applied for February & March. The Performance Package fee applicable is due to be paid in full within 14 days of class commencement, or your account will be subject to the $10 administration fee outlined in clause 1.9.
1.6 - All students MUST be enrolled in Auto-Pay (our online direct debit payment method) with a valid credit card, upon registering for the 2023 dance season. All instalments will be debited monthly from your nominated credit card on the 1st of each month, with the exception of February as stated in clause 1.3.
1.7 - Direct deposit and cash are not accepted payment methods for monthly instalments. Any direct deposit will incur a $5 administration fee. Any payments made prior to an auto-pay cycle will need to be done via your Parent Portal.
1.8 - If your Auto-Pay payment is unsuccessful on the 1st attempt, you will be notified by email and a second attempt will occur on the 5th of the month. Following a failed second attempt, a third and final attempt will occur on the 10th of the month.
1.9 - Any account that is 14 days overdue will incur a $10 administration fee. The fee will again be charged every 14 days until the account has no overdue balance. If an account becomes 60 days overdue it will be referred to a solicitor or recovery agent and any associated costs, commissions or fees will be added to your account and payable by you (Student or Parent/Guardian).
1.10 - No Pay, No Play - for any account that is 30 days overdue students will only be able to observe and not be able to participate in any class until the overdue amount is paid.
1.11 - If an account is overdue, students will not receive any costumes for performances, photos or the concert.
1.12 - A copy of your account statement is available for you to view at any time through your parent portal.
1.13 - Introductory Month of Dance - Any student new to Maxi-Jazz Dance Studio can enrol for an Introductory Month of Dance in ANY chosen class/es, within the relevant age group.
1.13.1 - One month’s instalment will be charged to your account and must be paid in full prior to the commencement of your first class.
1.13.2 - Upon completion of your introductory month, instalments will continue to be charged to your account for the remainder of the dance season in accordance with these terms and conditions. Performance Package fees (clause 1.5) will be charged to your account at this time and debited as a part of your next month’s payment.
1.13.3 - If you feel that Maxi-Jazz Dance Studio is not the right studio for you and your family, written notification must be received 15 days prior to the completion of the introductory month and no further charges will be applied to your account.
1.14 - If for any reason a student does not wish to return to class, written notification MUST be received 15 days prior to the end of the month you wish to finish attending class. If notification is received after this date, the following month’s instalment will be charged to your account. No refunds will be given if the student chooses not to attend lessons for the remainder of the month in which notification is received.
1.14.1 - Instalments will continue to be charged for classes for the remainder of the dance season until written notification has been received.
1.14.2 - Written notification must be sent as an email to maxijazzdancestudio@hotmail.com.
1.15 - If for any reason a 2023 timetabled class is cancelled by Maxi-Jazz Dance Studio after the first month of commencement for the season and no other suitable class can be offered to the student to continue their dance education with Maxi-Jazz during this season, a credit of $35 will be made to your nominated bank account for each month an instalment has been paid and any advance payments will be reversed.
1.16 - For any class that falls on a Public Holiday or rehearsal/concert day, 1 free workshop/event pass will be given to be redeemed during the current dance season.
1.17 - If student names appear on the concert T-shirt, names will be compiled from active students as at term 3 week 10.
1.18 - All charges are inclusive of GST and Auto-Pay Processing fees.
Enhancement Program Students Only
1.19 - If a student chooses not to continue with their Dance or Cheer Enhancement Team class after the commencement of the season (Monday 30th January 2023 inclusive) a $250 exit fee will be charged.
1.20 - Enhancement Dance Team students are required to pay a one-off $200 costume fee, paid at enrollment. This will be an Auto-Pay charge from your nominated card.
2. CONCERTS & REHEARSALS
2.1 - The concert will be held during late November / early December at a local theatre location yet to be confirmed (due to the uncertainty of the current Covid-19 situation). More details will be made available as soon as practically possible in our 2023 season.
2.2 - All concert classes will perform in the end of year concert unless otherwise noted by Maxi-Jazz. Performing at the concert will require costumes (which are included in your package), the correct dance attire, shoes, hair and makeup.
2.3 - Students that choose not to participate in the end of year concerts will still receive everything included in their monthly package price. There will be no discounted instalment offered for students choosing not to participate.
2.4 - Attendance is required at all classes and is compulsory for all extra rehearsals and concerts.
2.5 - There will be 1-3 extra rehearsals held on Saturday and or Sundays (including Photo Day) and 1 extra rehearsal on a weeknight at the concert venue in Term 4 prior to the concerts. More information for times and dates will be confirmed in Term 4. All extra rehearsals are COMPULSORY for all students and the rehearsal fee and professional photo package is included in your all-inclusive package.
2.6 - Maxi-Jazz students may be provided with the opportunity to perform at a number of events throughout the dance season. Any additional costs associated with extra performances are NOT included in the packages.
3. PHOTOS & VIDEOS
Upon completion of the Maxi Jazz Dance Studio 2023 Online Registration Form, you are confirming your consent to the following:
3.1 - The student’s photograph or video to be taken in situations including but not limited to; in class, events, performances, rehearsals and concerts, and be displayed, along with their name, (e.g. Ylanda R) on the studio website and social media for promotional or advertising purposes.
3.2 - The student’s photographs to be taken and edited by our professional photographer on our photo day and at the concert, and to be displayed in the photo package that is received by all students.
**NOTE: If you wish for this NOT to occur, the student will not be able to participate in the group photo on photo day and there will be no photos available from the concert.
3.3 - The student to be filmed at our concerts, and the recording to be edited and available for purchase for all students and their parents/guardians.
**NOTE: If you wish for this NOT to occur, unfortunately, the student will not be able to participate in the concert.
3.4 - The student’s photographs or video to be published on class files (only the class that the student is enrolled in) on the parent portals in situations including but not limited to; in class, events, performances, rehearsals and concerts. This will be viewable for other students and parents within those classes to show class activities, progressions and anything else that the Maxi-Jazz Dance Studio staff feel beneficial to share with the class.
**NOTE: If you do not wish to consent to any of the above mentioned policies, you are required to provide written notification outlining removal of your consent, stating the relevant clauses (e.g. clause 3.1). This must be provided by email to maxijazzdancestudio@hotmail.com .
4. INJURIES & MEDICAL CONDITIONS
4.1 - It is the student’s responsibility to inform their class teacher of any injuries or medical conditions that they are/have been treated for, that may impact their ability to participate in class, prior to the commencement of class.
4.2 - Our main priority to all dancers is to implement and teach safe dance practice in order to eliminate/reduce the risk of injuries and accidents. Any student who requires to participate at less than 100% (ie. marking out routines) or not participate at all in class due to an injury or illness, or is absent from class for:
4.2.1 - 2 or more consecutive weeks during Term 1, 2 & 3, will be required to provide a medical certificate for clearance to recommence full participation in class, if due to injury/illness, or will require a written letter of absence signed by your parent/guardian, if due to being absent. This must be provided prior to the commencement of the students first class back as a hard copy in class or emailed to maxijazzdancestudio@hotmail.com. The student will not be able to participate in classes until one of the above is provided.
4.2.2 - 2 or more consecutive weeks during Term 4, will be required to provide a medical certificate for clearance to recommence full participation in classes and concerts. The student/parent/guardian will also be asked to arrange a meeting with the class teacher/s to discuss participation in the upcoming concerts, as too much of the physical aspect of classes and rehearsals will have been missed.
4.3 - Any injury must be reported to a Maxi-Jazz staff member who will arrange for the commencement of first aid. All studio locations have a first aid kit and a trained first aider.
**Note - we are unable to provide any student with Panadol, Nurofen or other equivalent medication.
4.4 - Maxi-Jazz Dance Studio takes no responsibility for any injuries that may occur.
4.5 - Maxi-Jazz Dance Studio must be notified of any allergies, medication or medical conditions that may directly or indirectly relate to participation in class or other Maxi-Jazz events. If at any time, your medical situation changes, we must be notified in writing.
4.6 - In case of an emergency, the staff of Maxi-Jazz Dance Studio will call an ambulance or take your child to an available physician at the expense of the parent/guardian.
5. CODE OF CONDUCT
5.1 - At Maxi-Jazz Dance Studio, our mission is to provide a professional and family friendly service with quality lessons that ensure our students and families are receiving the best dance experience and education. Our passionate staff build positive relationships through knowing and valuing each and every student and encouraging their passion and love of dance.
5.2 - The core values of our studio are Love of Dance, Teamwork, Acceptance, Confidence and Home Away From Home. These core values encompass who we are, why we do what we do, and are worked into every aspect of our studio.
5.3 - Maxi-Jazz Dance Studio is a bully free and judgement free zone! We will not tolerate any student being disrespectful or rude to their teachers and/or fellow peers. Students are to be respectful of their Senior/Assistant teachers, their peers and themselves.
5.4 - At Maxi-Jazz we endeavour to provide a positive and encouraging environment for ALL students and their families. As such, any parent/guardian or student caught speaking negatively about another student or family, or speaking in a way that will tarnish the reputation of Maxi-Jazz, will be asked to leave the studio.
5.5 - We ask that you arrive at least 5 mins prior to the commencement of your class to ensure that you are fully dressed, including the correct footwear, ready to start all classes promptly.
5.6 - There is no food permitted during class (this includes lollies or chewing gum). If you/your child are doing multiple classes in a row, please pack something small to eat in between classes, ie. a piece of fruit or sandwich (please, nothing messy and NO eggs or nuts). Please make sure you bring a water bottle.
5.7 - Please ensure all students, especially all our Tiny Twirlers and Petite Feet students, go to the toilet before class commences. Parents are paying for teachers to teach their child, and continuously taking students to the toilet can interfere with valuable teaching and learning time.
6. SOCIAL MEDIA
6.1 - For the purpose of this policy ‘social media’ is a term used for a wide spectrum of user driven content technologies.
6.2 - Social media pages hosted privately by Maxi-Jazz Dance Studio (MJDS) are for current students and/or their families. By participating on our social media pages you agree to comply with the terms of use of that particular service as well as this social media policy.
6.3 - Posts on any of the MJDS social media pages do not reflect the views, opinions or position of MJDS, its directors or employees.
6.4 - Whilst we welcome engagement in open discussion, feedback, comments, reviews or ideas from all our members, we ask that you do so with integrity and request that all content is appropriate, friendly and respectful to all and remains in line with our code of conduct.
6.5 - Maxi-Jazz Dance Studio reserves the right to delete any post that in its view:
6.5.1 - is unlawful, offensive, obscene, indecent, defamatory, fraudulent, threatening, abusive, discriminatory, harassing, hateful or could incite violence.
6.5.2 - Contains, refers to or encourages: offensive language, sexual activity or sexuality, violence toward any thing or any person, damage to property, criminal activity, offensive behaviour, or any activity that is morally questionable.
6.5.3 - contains derogatory remarks about any person or organisation.
6.5.4 - contains any information that is untrue or incorrect or implies that to be the case.
6.5.5 - breaches the intellectual property rights of any person or organisation.
6.6 - Photographs/videos that feature any MJDS student/s other than your own are not to be posted online without the proven consent of their parent/guardian.
6.7 - To ensure the safety and privacy of our students, their families and our staff, current MJDS staff members are not permitted to communicate through their personal social media profiles with any student under the age of 18
6.8 - We discourage parents/students and teachers from becoming ‘friends’ or ‘followers’ on Social Media, unless there is an existing relationship. We consider all studio members to be family and as such feel the obligation to respect and monitor personal boundaries.
6.9 - Families found to be engaging in ‘hidden’ or ‘private’ groups formed for the specific purpose of discussing studio matters will be encouraged to join our closed Facebook group for current students/families, and warned against discussing studio matters in their private online groups.
6.10 - Maxi-Jazz Dance Studio’s decision to follow a particular social media page does not imply endorsement of any kind. Similarly, the appearance of a social media page as a follower or friend of MJDS does not imply endorsement.
6.11 - All material posted by you will be regarded as public information and may be treated as such by us. In particular, by posting on our social media pages, you acknowledge that we (and/or anyone else) can use, copy, reproduce, modify, publish and distribute the material in any and all media or distribution methods; however, this does not imply endorsement on the part of Maxi-Jazz Dance Studio. This also means we can reproduce your posts for promotional or commercial purposes (with no compensation paid to you).
6.12 - The contents of our social media pages are intended for informational purposes only. Maxi-Jazz Dance Studio shall in no event accept any liability for loss of damage suffered by any person or body due to the information provided on these sites or linked sites. Violation of this policy may result in you being barred or removed from Maxi-Jazz Dance Studio social media pages.
7. COVID-19 and INFECTIOUS DISEASE
Upon completion of the Maxi Jazz Dance Studio 2023 Online Registration Form, you are confirming you agree to the following
7.1 - You are personally responsible for your safety and actions while attending Maxi-Jazz Dance Studio. You agree to comply with all policies and rules, including but not limited to Maxi Jazz Dance Studio guidelines, signage, and instructions. With full awareness, understanding, and appreciation of the risks involved, you hereby and forever release, waive, discharge all risk and responsibility during any event or class at Maxi-Jazz Dance Studio, its affiliates, employees, and independent contractors from any and all liability and claims whatsoever directly or indirectly arising out of or related to any loss, damage, or injury, including death, that may be sustained by you related to COVID-19. You agree to honestly and accurately, to the best of your ability / knowledge, complete a Daily Health Screening before entering the studio, until further notice. This is a requirement of all dancers, family members and attendees participating in any activity on Maxi-Jazz Dance Studio property.
7.2 - Despite our careful attention to sterilisation, disinfection and social distancing practices, there is still a chance that you or your child could potentially be exposed to an illness on Maxi-Jazz Dance Studio Pty. Ltd. property. Although Maxi-Jazz Dance Studio has taken extra precautionary measures to reduce the possibility for transmission of communicable diseases, there is still a possibility that exposure may occur. Please know that participating in classes, workshops, performances, or activities hosted by Maxi-Jazz Dance Studio Pty. Ltd. are at your own risk.
7.3 - You agree to adhere to Maxi-Jazz Dance Studio Pty. Ltd. safety measures and guidelines to help stop the spread of communicable diseases, including Covid-19, also known as "Coronavirus"
7.4 - You, for yourself and on the behalf of your heirs, assigns, personal representatives, and next of kin hereby release and hold Maxi-Jazz Dance Studio Pty. Ltd. its owner, employees, assistants and/or students, with respect to any and all illness, disability, death or loss of person or property.
7.5 - In the circumstances that any given communicable disease or natural disaster affects the running of face to face classes at Maxi-Jazz Dance Studio;
7.5.1 - Maxi Jazz Dance Studio has the right to transfer all classes to virtual (online/Zoom) lessons
7.5.2 - Maxi Jazz Dance Studio has the right to change the timetable, class type and activities without notification, at any time. Any fees or instalments will remain the same. There will be no compensation in the event of dissatisfaction with such changes.
7.5.3 - All Maxi-Jazz Dance Studio Terms & Conditions continue to apply during the affected time period.
7.5.4 - Covid-19 or any other infectious disease and natural disaster measures are in line with current Government Guidelines and/or public health order and will be regularly reviewed and updated as necessary. All MJDS families must stay up to date with these policy changes by regularly checking and reading ALL email communication, joining the closed MJDS Facebook page and your online parent portal.
7.5.5 - All Virtual sessions will be recorded by the host to be archived for insurance purposes.
7.5.6 - Attendees must not record ANY virtual sessions or share any online, pre-recorded or printed content.
