I the parent/guardian of the above listed child, hereby acknowledge that I will be entering into a Contract for Dance Classes/Fee Agreement with Dance Arts South. Dance Arts South, LLC agrees to provide dance instruction for my child in accordance with the mission, philosophy and policies outlined in the Fall 2018 Dance Arts South Information Guide.
Contract Start Date: 9/4/2019 Contract End Date: 05/31/2020
Contract Duration and Automatic Renewal: Contract is in force for 9 months from the Contract Start Date, with automatic renewal for subsequent months.
Agreement to Pay Recurring Fees: I the parent/guardian agrees to pay Dance Arts South monthly recurring fees as follows: 4 Month Tuition Auto-Draft in accordance with the Dance Arts South tuition fee schedule based upon total hours of the above listed child's class enrollment via parent/guardian authorized automatic checking account ACH charges. Alternatively, parent/guardian may prepay 4 months in advance E Check/ ACH, bank check or cash. Payment in monthly increments by any means other than E Check/ACH is not permitted unless alternative written arrangements are made in writing between Dance Arts South, LLC and the parent/guardian.
I understand that any requests for changes to the enrollment schedule or withdrawal listed herein must be made in writing and submitted to the Studio Director. Upon submission of enrollment, I am agreeing to compensate Dance Arts South for the above listed services as follows: Tuition is paid prior to the performance of dance instruction. Tuition is due whether or not the child attends the program. The tuition represents the child's place in the program. There is no credit given for vacation or emergency closure days, makeup classes will be scheduled to allow for missed dance instruction.
The Contract for Dance Classes/Fee Agreement may be cancelled by Dance Arts South at any time with or without notice, in its sole discretion. Any unused TUITION paid by the parents/guardians will be refunded within 30 days of cancellation.
The Contract for Dance Classes/Fee Agreement may be cancelled by the parents/guardians with two weeks written notice. Written notice of cancellation must be submitted to the Creative Director. There are NO REFUNDS for tuition paid, recital fees or dance costumes.
(a) I agree to purchase 9 Month Tuition Auto-Draft in accordance with the Dance Arts South tuition fee schedule based upon total hours of the above listed child's class enrollment via parent/guardian authorized automatic debit to my checking account each month for a contract period of 4 months.
(b) I hereby certify that I am an authorized signer on the bank checking account detailed below.
(c) I understand that I will be notified if my checking account payment fails to authorize for any reason, and that a $15 late fee will apply if I do not provide a valid credit card or checking account ACH information within 3 calendar days of the original rejection date.
I represent and warrant that if I am purchasing something or paying for a service from Dance Arts South or from other merchants through Dance Arts South that (i) any credit card or bank account draft (ACH Draft) information I supply is true and complete, (ii) charges incurred by me will be honored by my credit card company or financial institution, and (iii) I will pay the charges incurred by me at the posted prices, including any applicable taxes, fees, and penalties.
(d) I hereby authorize this facility to charge my credit card account. I understand that a 30-day written notice is required to modify billing and I am responsible for payment whether or not my student attends classes for the entire session. A $25.00 NSF fee will be charged if funds are not available.
(e) Should I dispute a charge through my financial institution this will constitute a breach of contract possibly resulting in, but not limited to, penalties, additional fees, collection, legal action, and/or termination of any and/or all current and future services.
(d) I understand that my child will not be able to attend classes if the account becomes 30 calendar days late.
(f) I confirm that I have had the opportunity to discuss the information contained herein with a representative of Dance Arts South, that my questions have been answered fully and to my satisfaction and that I agree to abide by the conditions set forth herein as well as the policies contained herein by reference from the Dance Arts South Information Guide.
I agree to pay a $35.00 non-refundable registration unless a pre-registration form was submitted prior to 06/01/2019. Registration fees are processed via E Check/ACH bank draft upon enrollment.
Participant or Guardian of Participant understands and acknowledge that Dance Arts South (“DAS”) is an not insurer of Participant’s behavior, actions or participation in the program, and that DAS assumes no liability whatsoever for personal injuries or property damages to Participant or to third persons arising out of Participation in the Program activities. Participant or Guardian hereby agrees to release, waive, covenant not to sue, indemnify and hold harmless the Dance Arts South, and all of their officers, employees and agents (collectively the “Releases”) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant or loss or damage to any property belonging to Participant arising out of or related to participation in the above named Program, and excepting only such loss, damage or injury as may be caused by the sole negligence of any Release.
I understand that ballet training for Dance Arts South students requires a sustained, repetitive, vigorous physical activity, usually performed on a hard or lightly padded surface without protective footwear. It is also understood that dance instruction involves kinetic corrections that may include physically touching the student as part of regular classwork and rehearsals. I understand that participants engage in a broad range of quick movements, bending, twisting, running, leaping and lifting, which place extreme demands on the human body, including stress of joints and ligaments, repetitive impact, and occasional falls, slips and collisions with other participants and objects.
I also understand that the Dance Arts South is not staffed to monitor and supervise the activities of its students at all times, and the tuition schedule does not contemplate constant supervision.
I also understand that there are inherent risks of serious personal injury involved in all of the above activities as well as in the general participation in Academy activities and events. I voluntarily assume and accept such risks of personal injury and illnesses arising from my/my child’s attendance and participation in such activities and events. I hereby release Dance Arts South, its trustees, employees and agents from all actions, claims or demands that I, my child, our heirs or representatives now have or may hereafter have for personal injuries or property damage resulting from our attendance at and/or participation in Academy activities and events. I agree that this release includes personal injury or property damages caused in whole or in part by negligence, active or passive, of Dance Arts South, its trustees, employees and agents. This release does not apply to liability for willful injury or fraud. This permission and release shall remain effective through the end of the school year, unless and until a written revocation is delivered to the School Administration.
I hereby give permission for my student to participate in activities, and if applicable, ride in a chartered bus. All excursions are non-refundable. I understand that students participating in any excursions are ambassadors of Dance Arts South. Any student who fails to abide by the rules set by the chaperones for excursions will forfeit participation on future excursions and may be dismissed from the session. In either event, no refund will be granted.
Participant or Guardian of Participant agrees that the site of any lawsuit arising out of or related to participation in the Program shall be Alabama and that this Agreement will be governed by and construed in accordance with the laws of the state of Alabama, without application of any principles of choice of law.
Participant does not have any medical conditions that would prevent participation in course Program.
Participant has adequate health insurance to cover the costs of treatment in the event of any injury.
Participant shall pay any attorney fees or costs incurred by DAS in enforcing this Agreement.
If any portion of this Agreement is held to be invalid by a court of law, then it is agreed and intended that all the remainder shall, notwithstanding, continue in full force and effect.
I hereby grant Dance Arts South permission to photograph myself or my child(ren) and use me/their likeness in a photograph/image in any of its publications, including website entries, without payment or any other consideration. I understand and agree that photographs will become the property of Dance Arts South and can be used for the purpose of publicizing Dance Arts South, its programs and initiatives. I waive the right to approve finished product as well as any right to royalties or other compensation related to the use of any photography.
