LIABILITY WAIVER
*Please read this document carefully. It may affect your legal rights*
For valued received, the undersigned jointly and severally agree to indemnify, save, and hold harmless STUDIO C SCHOOL OF DANCE, LLC, Carson Bourne and Christina Bourne, jointly and severally, (“Indemniteesâ€) from any and all claims, actions, damages, liabilities, or litigation arising out of the following circumstances: my and/or my child(ren)’s participation in online instruction; my and/or my child(ren)’s potential exposure to infectious disease; my and/or my child(ren)’s participation in any service or program offered by Indemnitees, whether on or off Indemnitees’ premises; and any dangerous and/or hazardous condition on Indemnitees’ premises. In the event of any cause of action or claim asserted by a party to this Agreement or any third party, the Indemnitees will provide the undersigned timely notice of such claim, dispute, or notice. Thereafter, the undersigned shall, at its own expense, faithfully and completely defend and protect the Indemnitees against any and all liabilities arising from this claim, cause of action and/or notice.
If the undersigned should fail to so successfully defend, the Indemnitees may defend, pay, or settle the claim with full rights of recourse against the undersigned for any and all fees, costs, expenses, and payments, including but not limited to attorney's fees and settlement payments, made or agreed to be paid, in order to discharge the claim, cause of action, dispute, or litigation. PLEASE BE ADVISED THAT THIS AGREEMENT APPLIES TO CLAIMS ARISING OUT OF INDEMNITEES’ OWN NEGLIGENCE. This Agreement is binding upon and is to insure to the benefit of the parties, their successors, assigns, and personal representatives. This Agreement is intended to operate to extinguish any claims or causes of action arising out of any of the circumstances described herein and is an
absolute bar against claims arising from the same.As the parent or legal guardian of the minor child(ren) participating in the activities described herein, I am exercising my right under Texas Family Code § 151.001(a)(7) to represent my child(ren) in legal action(s) and to make other decisions of substantial legal significance concerning my child(ren).
Further, In the event I cannot be reached, I hereby give my permission to the management, faculty and staff of Studio C School of Dance to authorize any emergency medical care that may be required by the above student during participation in classes, performances, or any related Studio C events. This authorization extends throughout the current dance year and throughout the summer or until the student is no longer enrolled at Studio C, whichever comes first. I understand that I am responsible for any and all charges of such care or medical treatment. Studio C does not permit staff members or teachers to provide or administer medication.
The undersigned does hereby agree to waive and release all claims on behalf of the above registered participant against Studio C and its employees from all responsibilities for personal injuries received or sustained while on Studio C premises. I also understand that good dance training involves touching and adjustment of the student's body by the instructor. Acknowledgment: I have read, understand and agree to comply with the above release.
