REGISTRATION: An annual non-refundable/non-transferable fee of $40 is required per student upon season enrollment.

PAYMENT OF FEES: Tuition must be paid by automatic bank account debit or automatic credit card payment. No cash or checks will be accepted for tuition payment. First month's tuition is due upon registration. Failure to pay tuition in a timely manner will result in students being asked to sit out the class.

I understand that New Heights Studio will process tuition payments on the 1st of every month (unless otherwise communicated). If my payment declines for any reason, DanceStudio will send a notification with the declined payment reason to my email address on file and I will be charged a $10 Declined Payment Fee. If tuition remains unpaid in my account, New Heights Studio will attempt to reprocess payment on the 5th of the month. I understand that if my payment declines a second time, I will be charged a second $10 Declined Payment Fee and also a $10 Late Payment Fee. I understand that these fees are non-reversible and non-refundable once charged/paid.  If outstanding tuition is not paid by the 15th of the month, the student may be withdrawn from the studio. 

ESA STUDENTS UTILIZING CLASS WALLET: Tuition will be paid on a quarterly basis with due dates on July (first day of class after summer break), October 1st, January 1st, and April 1st to align with ESA's funding schedule. I understand that I will be required to submit a screenshot of my order confirmation from Class Wallet and will send this screenshot to New Heights Studio via email (info@newheightsstudioaz.com) on the due dates previously mentioned to avoid being charged a late fee. If a screenshot is not received within 4 days of these due dates, I understand that I will be charged a $10 Late Fee. There are no refunds or credit transfers after tuition has been paid and fees posted.

WINTER SHOWCASE AND SPRING RECITAL Dance students have the opportunity to perform for both Winter Showcase and Spring Recital events. These shows are optional, but participation is highly encouraged because performance is part of our education. New Heights Studio will assume every student is participating in the show, unless I opt my student out of the performance. I understand the fee to participate in the Winter Showcase will be $30. I understand the fee to participate in the Spring Recital will be $60. There are no refunds or credit transfers after these fees have been paid. I understand that eligibility for showcase/recital requires consistent attendance. I understand that if my student has been absent 3 or more times, an instructor may require a mandatory private session to be able to help the student catch-up and feel confident with the routine. New Heights Studio will communicate with me directly if a private session is required and will provide session fees and available time slots at that time. There are no refunds or credit transfers after these fees have been paid.

COSTUMES: I understand that if my child participates in the Winter Showcase, there will be a $45 costume fee per class in addition to the $30 showcase fee. I understand that if my child participates in the Spring Recital, there will be a $90 costume fee per class in addition to the $60 recital fee. There are no refunds or credit transfers after these fees have been paid.

WITHDRAWALS AND REFUNDS: Should it become necessary to discontinue classes for any reason, I understand that a 30-day written notice is required. Withdrawal must be done by sending an email to info@newheightsstudioaz.com. If I wish to avoid being charged the following month's tuition fee, I understand that I must inform New Heights Studio no later than the 1st of the final month of enrollment (i.e. if my student can no longer attend classes beginning April 1st, then my notice must be received no later than March 1st to avoid being charged for April's tuition). No exceptions. I understand that if my student was enrolled in a 12-month contract and is withdrawing prior to completing 12 consecutive months of enrollment, I will revoke the 20% discount and all previous/current tuition fees will be retroactively adjusted to the non-discounted rate and balance will be due.

No withdrawals will be accepted between April - June if a student is participating in the Spring Recital. I understand my student will not be allowed to perform in the Spring Recital if tuition is not paid in full. I understand no exceptions can be made.

EXTREME WEATHER OR UNEXPECTED INTERRUPTION OF CLASSES: If the school must cancel classes due to extreme weather or events beyond our control, such as power outages and pandemics, makeup classes will be offered. No refunds.

SUBSTITUTIONS: The studio reserves the right to provide a substitute teacher if the regularly scheduled teacher is ill or otherwise unable to teach classes. If a teacher is ill and the school cannot arrange a substitute, makeup classes will be offered.

NOTICE TO CUSTOMER: Pursuant to ARS Statute Ariz. Rev. Stat. § 44-1744 (“A.R.S. § 44-1744”), I understand that I may cancel this contract within fifteen days of the time I originally signed. If I cancel the contract in the fifteen-day period, I understand that I am entitled to a refund less payment for dance lessons or services/fees due before cancellation. Refunds must be made within ten days, not including Sundays and holidays of receipt of the cancellation notice by the studio.

Furthermore, pursuant to Ariz. Rev. Stat. § 44-1746 (“A.R.S. § 44-1746”), if by reason of death or disability, my student is unable to continue lessons included in any of the enrollment options/contracts listed above, I understand my student shall be relieved from the obligation of making payment for lessons and other services other than those received prior to death or the onset of disability.

New Heights Studio requests that each student enrolled consult with a physician with respect to any past or present illness or injury that may affect his/her participation in and ability to endure the exercise, dance, and all other activities at New Heights Studio including tumbling.

As with all physical activity, there is a risk of injury. Even though New Heights Studio takes precautions to assure a safe environment, physical activities such as those taught or participated in at New Heights Studio have a risk of injury. I agree to be solely responsible for any and all costs, damages and expenses incurred by me and/or my child as a result of any injury sustained from participation in any classes or while at New Heights Studio or at another location with New Heights Studio. I further agree not to hold New Heights Studio, its staff, volunteers and/or instructors, and Hayden Acres, their owners, their staff and/or instructors responsible in any way for such injury, including injury sustained from the animals on the properties. I understand that all contact with horses, livestock, and other animals is strictly prohibited.

Parents/legal guardians of minor students and adult students waive the right to any legal action for any injury sustained on studio property and neighboring property resulting from normal dance and tumbling activity or any other activity conducted by the students or parents before, during, or after class time. This includes injuries sustained from the animals housed on the properties. The horse and livestock areas are strictly prohibited.

STUDENT (OR STUDENT’S PARENT OR GUARDIAN) AGREES TO HOLD HARMLESS, INDEMNIFY AND DEFEND NEW HEIGHTS STUDIO AND HAYDEN ACRES AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, JUDGMENTS, ORDERS, COSTS OR EXPENSES, INCLUDING ATTORNEY'S FEES, WHICH MAY IN ANY WAY ARISE FROM OR BE IN ANY WAY CONNECTED WITH STUDENTS'S USE OF OR PRESENCE UPON THE PROPERTY OF NEW HEIGHTS STUDIO AND HAYDEN ACRES AND THE FACILITIES LOCATED THEREON. In the event student is a minor, the parent or guardian shall further indemnify, defend and hold Manager harmless from any such claims by said minor child, regardless of any statute of limitations or contractual limitation of actions.

I agree and understand that I must report immediately to the New Heights Studio staff any injuries to my child that become known to me. It is further agreed that New Heights Studio shall not be liable to me, my child, or our respective heirs, and executors, for any claims, demands, injuries, damages, actions, or causes of action whatsoever, arising from any injury or damage to my child’s person or property arising out of or connecting with the activities of New Heights Studio, or the use of the services, facilities or premises of New Heights Studio or Hayden Acres by my child. Further, for myself and for my child and our respective heirs, and executors, I do expressly hereby forever release and discharge New Heights Studio and its officers, directors, volunteers, agents or employees from all claims, demands, injuries, damages, actions, or courses of action, and from all acts of active or passive negligence on the part of New Heights Studio ,its officers, directors, volunteers, agents or employees. Further, I do expressly agree to indemnify, defend and hold harmless New Heights Studio and its officers, directors, volunteers, agents or employees from all claims, demands, injuries, damages, actions, or courses of action, brought by on or behalf of my child and arising from or related in any way to any and all acts of active or passive negligence on the part of New Heights Studio, its officers, directors, volunteers, agents or employees. To the extent necessary, I expressly waive any claim or defense of parental immunity.

I understand New Heights Studio is located on a working farm with live animals and understand these areas are strictly prohibited. I, my student and accompanying guests agree to not interact with, pet, or feed the horses and livestock on this property and agree to keep my students and accompanying guests off of the horse and livestock areas. Please do not wander throughout the properties, or allow children to play, run or scream while walking to/from gym in barn or across either property.

I understand that the behavior and actions of any animal can be unpredictable and that in being in close proximity with animals, personal injury or property damage may occur. Being aware of the risks that may be involved, I indemnify and hold harmless New Heights Studio, Hayden Acres, and/or their volunteers, officers and employees for any and all personal injury or property damage resulting from any negligence in remaining off these restricted areas.

If a parent or guardian is not present, I authorize New Heights Studio staff, in the event of illness or injury, to administer emergency care and to arrange for any emergency medical transportation to the nearest healthcare facility deemed appropriate. I understand every effort will be made to contact the parent, guardian, or emergency contact PRIOR to any involved treatment. I grant permission to a qualified physician and/or other medical personnel to furnish medical care while my son/daughter/myself is participating in activities at or for New Heights Studio. I also agree that my insurance carrier or I will bear financial responsibility for any medical treatment administered under the above guidelines. I agree to pay all costs, fees and expenses related to or arising from such emergency medical treatment and I expressly agree to indemnify, defend and hold harmless New Heights Studio against any and all claims for such costs, fees and expenses.

Photo Release: The studio is hereby granted permission to take photographs of the students to use in brochures, websites, posters, advertisements, and other promotional materials the studio creates. Permission is also hereby granted for the studio to copyright such photographs in its name.

PARKING LOT PROCEDURES: All visitors must enter the property through the entrance closest to Ocotillo and exit through the exit furthest from Ocotillo. Please note, that this is also a one-way lane. Please do not attempt to drive around cars as there are many blind spots and we want to avoid any harm coming to students or visitors.

DROP OFF/PICKUP PROCEDURES: I understand that I may drop off my child to enter the studio in the designated in the green "Drop Off Zone" that includes entering through the sliding door/patio area or through the main door as illustrated in the Parking Lot Map file located in my parent portal. I understand that NO VEHICLES MAY PARK IN THIS AREA. I understand that this is a DROP-OFF ONLY ZONE. No pick-ups will be allowed. I understand that I may choose to park and walk my student into the studio by parking in the yellow "Parking Zone" as illustrated in the Parking Lot Map file located in my parent portal. Additionally, I understand that all parents must park in the yellow areas and walk into the studio for student pickup (Older students ages 14+ are welcome to walk themselves to their vehicles as long as it is safe to do so).

STUDENT EXPECTATIONS: Students should arrive on time in appropriate dance wear with a a water bottle. Students will be attentive and actively participate during class. Students will show respect to their peers, New Heights Studio instructors and staff at all times. Students will respect the studio, kitchen, dance rooms, and surrounding areas and will clean up after themselves. Failure to follow these expectations may result in student being withdrawn from class.

STUDENT DRESS CODE: Required dance wear and dance shoes must be worn to all classes. Failure to wear required dance wear to class could result in students being asked to sit out the class. Repeated failure to wear required dance wear could result in the termination of lessons. Students are not permitted to wear jeans or shoes worn on the street or outdoors to any class. (For hip hop, we recommend students wear sneakers designated just for class.) For safety reasons, dancers and tumblers are not allowed to wear any jewelry other than stud earrings. Long hair must be pulled away from the face.

CARE OF STUDENTS: New Heights Studio, staff, and instructors are not responsible for providing before or after class care for students. Students are not to be left at the studio for excessive time periods before or after their classes. All students should be escorted by a parent/guardian into the studio and brought to their appropriate classroom. All parents are responsible for making sure their child safely enters our school, regardless of their age. Parents/Guardians are requested to be in the studio's vicinity within 10 minutes of their child’s dismissal from class. A courtesy call/text/email should be made if the parent/guardian of the student will be late, allowing the instructor and student to be notified in a timely manner.

PARENT'S RESPONSIBILITY TO BE AWARE OF DATES AND EVENTS: It is the responsibility of the parent or adult student to be aware of all studio activities, such as viewing days, recitals, extra classes, and dates the studio is open or closed. The studio will send reminders via email and sending text message notices as necessary. It is the responsibility of the parents or adult students to inform the school of any address or telephone number changes. Demographic information (such as address, emails, telephone numbers) can also be updated via the parent portal.

ATTENDANCE AND MAKE-UP CLASSES: Attending class on a regular basis is important in any learning experience. The consistency and repetition of training is necessary for proper technique to be learned. Arrive early to class. Students arriving 15 minutes or more after a class has started will be required to sit out the remainder of the class. If a child misses a class and monthly tuition has been paid, the dancer is allowed one make-up class for each class missed. Make-up classes are a courtesy for registered students only. A make-up class is any other class that we offer for their age and dance level. Our teachers highly recommend that dancers take advantage of make-up classes in order to help them from falling behind in their dance training. Making the class up is the responsibility of the parent and student. There are no transfers, refunds, or credits.

CLASS PLACEMENT AND INSTRUCTION: Class placement is determined by the instructor. Dance education requires “hands-on” instruction as well as verbal instruction. Instructors will regularly correct your child by touching their arms, legs, feet, hips, back, and head to move them to the correct position. Instructors will also verbally correct your child during the class and offer encouraging feedback.
