Release of Liability, Assumption of The Risk and Waiver of Liability Relating to Coronavirus/COVID-19 and Terms & Conditions for Mother Lode Dance Academy, LLC
RELEASE OF LIABILITY
As the adult student or legal parent/guardian or a student, I release and hold harmless Mother Lode Dance Academy LLC, it's owners, operators, and teachers from any and all liability, claims, demands and causes of action whatsoever, arising out of or related to any loss, damage or injury that may be sustained by the participant and/or the undersigned, while in or upon the premises or any premises under the control and supervision of Mother Lode Dance Academy LLC, its owners, operators, and teachers or in route to or from any of said premises.
MEDICAL EMERGENCY
I give permission to Mother Lode Dance Academy, it's owners and teachers, to seek or administer medical treatment for myself or my child if the need arises. I release the Mother Lode Dance Academy, it's owners and teachers, from any liability that may arise from treatment.
ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Mother Lode Dance Academy, LLC cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Mother Lode Dance Academy, LLC could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Mother Lode Dance Academy, LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Mother Lode Dance Academy, LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Mother Lode Dance Academy, LLC employees, volunteers, owners and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at Mother Lode Dance Academy, LLC or participation in programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Mother Lode Dance Academy, LLC, its owners, employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Mother Lode Dance Academy, LLC, its owners, employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Mother Lode Dance Academy, LLC program.
MOTHER LODE DANCE ACADEMY’S TERMS AND CONDITIONS
UNATTENDED CHILDREN - YOUTH PROGRAM
Mother Lode Dance Academy requires a parent/guardian to remain on the premises if their child is six or under to address all needs that may arise. Mother Lode Dance Academy, it’s owners and teachers, are not responsible for any children left unattended while in or upon the premises.
PAYMENT INFORMATION - YOUTH PROGRAM
An annual registration fee of $25.00 per student and tuition for the first month is due upon registration. Whether a registration form is submitted online or in person, you must pay all required fees before your child can participate in class. Tuition payments are due on the 1st of each month. Late fees will start to accrue if tuition is not paid by the 10th of each month (See Late Fee Schedule below). Monthly bills will be provided. Students will be excused from class if tuition is not paid in full within 30 days of original due date. Payments are accepted at the studio in the form of Cash, Check and Credit/Debit card. Automatic & online payments are also available through the Parent Portal. All fees are final and non-refundable. Any checks returned for non-sufficient funds will be charged a $25 return fee plus the check amount, due immediately. All months are billed as full months, no matter how many weeks of dance fall within each month. Monthly tuition will not be pro-rated for any reason. A 15% discount is given to immediate family members living in the same household.
DROPPED CLASSES - YOUTH PROGRAM
Monthly tuition and registration fees are non-refundable if a class is dropped. If you would like to drop a class, you must alert us of the cancellation by sending an email to motherlodedance@gmail.com before the 1st of the new month. If no email is received by the 1st, you will continue to be responsible to pay the full month tuition for that class.
LATE FEE SCHEDULE - YOUTH PROGRAM
Monthly tuition is due on the 1st of each month. Late fees will begin to accrue if payments are not made on time based on the following late fee schedule; $5 per student if payment is made after the 10th of the month, $10 after the 15th and $20 after the 20th. Student(s) will be dismissed from class(es) if outstanding balances are not paid in full within 30 days of original due date. All fees paid to Mother Lode Dance Academy are non-refundable even if student is dismissed due to unpaid tuition payments. Monthly tuition will not be pro-rated for any reason.
ANNUAL RECITAL - YOUTH PROGRAM
Our annual dance recital will occur in Spring each year and all our students are invited to participate. If we are unable to have an in-door recital due to a natural disaster or pandemic, we will hold an outdoor recital. The decision to participate in the recital must be made by January 9th, as this is when costumes are ordered. Recital classes close to new enrollment on December 19th. All costume and tights fees are final and non-refundable. Students participating in the Recital must keep a positive attendance record throughout the dance season, no more than two class(es) missed per month. Communication is key. Please communicate with our staff of an absence beforehand. Due to excessive absences, if your student falls behind with choreography, the teacher may require private lessons at an additional cost, or your dancer may be dismissed from class(es) and lose recital privileges even if a costume is purchased. All tuition must be paid in full no later than 5 days before the recital date. Participation in the mandatory dress rehearsal is required.
CLASSROOM ETIQUETTE AND CODE OF CONDUCT - YOUTH & ADULT PROGRAMS
It is expected that all students and family members show Mother Lode Dance Academy's owners, teachers, fellow dancers, their families and all MLDA property with courtesy and respect. If studio property is damaged due to misuse by a student or their parent/guest, it is the responsibility of that dancer’s family to repair or replace the damaged property at no expense to MLDA. All students must adhere to MLDA’s dress code that is outlined for each class in the Files page on your parent portal. Remember, dance is supposed to be fun! Please leave all coaching to our teachers and be accepting to all dancers. The dance floor is restricted to dancers and teaching staff only. Teachers are available to answer questions before and after class. Dance shoes only on dance room floors, please no street shoes (clean street shoes for Hip Hop is okay). Please enjoy all food and drinks outside. Water is the only exception inside the facility. Studio trash cans are not to be used for food trash. Please dispose of leftover food, food/drink containers, etc. elsewhere. Failure to comply with our Classroom Etiquette/Code of Conduct may result in dismissal of our dance program.
USE OF NAME AND LOGO - YOUTH & ADULT PROGRAMS
Use of Mother Lode Dance Academy’s logo or name in all printed materials and apparel must be approved by Amber and Tricia beforehand.
PHOTO RELEASE - YOUTH & ADULT PROGRAMS
Mother Lode Dance Academy often takes photos and videos during class and at events to be used for advertisements and marketing for their website or other public advertisements. Parents have the option to opt-out of this agreement by signing the "photo opt-out" waiver. This waiver is located in the Waivers section on the parent portal.
BY REGISTERING AND PAYING FOR ANY CLASS (WHETHER JOINING ONLINE CLASSES OR IN-PERSON), EVENT, PRIVATE LESSON, OR OTHER ACTIVITY THROUGH THIS WEBSITE (“PARENT PORTAL”) OR THROUGH IN-PERSON REGISTRATION, YOU ARE AGREEING TO ALL OF THE ABOVE CONDITIONS AND WAIVERS. PLEASE DO NOT HAVE YOUR CHILD/YOURSELF PARTICIPATE IN ANY CLASS OR EVENT UNLESS YOU ACCEPT AND AGREE TO ALL OF THE TERMS IN THIS AGREEMENT.
By singing this policy and liability waiver, you are stating that you agree to uphold all that is listed.
