I agree, unconditionally, to release the Children’s Ballet of San Antonio (hereafter referred to as CBSA) and its affiliates, representatives, agents, employees, and volunteers, in both their representative and individual capacities, from, and defend and hold her harmless against any and all claims, demands, liabilities, losses, suits, actions, proceedings, penalties, fines, costs, settlements, legal expenses (including reasonable attorney’s fee), injuries and damages (including death, bodily injury or damage to real or personal property) asserted by parent/guardian(s) and/or student arising from or related to the minor child’s participation in CBSA events. The claims to which this Release and Indemnity apply include any claims against CBSA for negligence. This Release and Indemnity will apply without regard to whether it is alleged that CBSA was jointly or contributory negligent.

I hereby authorize and give full consent to the CBSA to publish, reproduce in print, on line, on social media, press release and funding applications, and copyright all photographs in which my child appears while participating in classes, rehearsals, community events, field trips, excursions or off-site locations, and productions. Children will NOT be identified by name in photo captions or any photo or video captions without additional written consent from parent/guardian. I agree that the CBSA may use, in whole or in part, photography, videos, written extractions, and voice recordings of student for the purpose of illustrations, publications and websites. I also acknowledge that CBSA may choose NOT to use my minor child’s image at this time but may do so at its own discretion at a later date. I understand that once an image is posted it may be downloaded by a third party. I also agree that I will not hold CBSA and its affiliates, teachers, representatives, agents, employees, and volunteers, in both their representative and individual capacities, from any harm that may result from unauthorized reproduction responsible for any harm that may result from unauthorized reproduction of such photographs or videos. Additionally, I agree that use of a photograph or photograph(s) does not constitute in any manner a waiver of the CBSA’s program policies, program, or rules, nor does the continued use constitute an agreement to continue minor child’s participation and/or enrollment in CBSA auditions, classes, workshops programs, or excursions. I further acknowledge that my participation is voluntary and that I will not receive financial compensation of any type associated with taking or publication of these photographs/videos or participation in company marketing materials or company publications. I acknowledge and agree that publication of said photographs and videos confirms NO right rights of ownership or royalties whatsoever.

I agree that should my minor child not abide by all CBSA rules, he/she may be dismissed from the rehearsal, community event, production, cast, excursion, etc. at my expense and no refund will be made.

I hereby approve the foregoing and consent to the use of photography subject to the terms mentioned above.

I have read this Release and Indemnity Agreement and understand its terms. I affirm that I have the legal right to issue such consent and I execute it voluntarily and with full knowledge of its meaning and effect.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

The Dance Center of San Antonio (“DCSA”) in partnership with The Children's Ballet of San Antonio ("CBSA") has put in place preventative measures to reduce the spread of COVID-19; however, the DCSA and/or CBSA cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending DCSA and/or CBSA classes or programs could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending DCSA and/or CBSA classes or programs and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 at the DCSA and/or CBSA may result from the actions, omissions, or negligence of myself and others, including, but not limited to, DCSA and/or CBSA employees, guest teachers, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Dance Center of San Antonio or participation in DCSA classes or programming (“Claims”), as well as The Children's Ballet of San Antonio.

On my behalf, and on behalf of my children and family, I hereby release, covenant not to sue, discharge, and hold harmless the Dance Center of San Antonio and/or The Children's Ballet of San Antonio, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.
