• I represent and warrant that my child is physically fit and has no medical condition(s) that would prevent full participation in dance classes and/or workshops offered by Unified Motion Dance Academy and that my child has not, nor anyone in our household, within the past 14- days, experienced any symptoms that could be associated with Coronavirus (COVID-19) or, to my knowledge, been close to anyone who was either known or suspected to have had symptoms that could be associated with COVID-19 during the same time period.

• I will update Unified Motion Dance Academy as to any changes in my child’s medical condition or contact with others with known or suspected exposure to COVID-19.

• My child will not enter the Unified Motion Dance Academy premises or participate in any classes, workshops, and recitals offered by Unified Motion Dance Academy if they experience symptoms, or, to my knowledge, come in contact with anyone who was either known or suspected to have had symptoms within the past 14-days, associated with COVID-19 or any other sign of illness, including, without limitation, fever, chills, cough, shortness of breath, or sore throat, or if I have a suspected, or diagnosed or confirmed case of COVID-19.

• My child will take all appropriate actions required by Unified Motion Dance Academy, including but not limited to, (i) wearing a mask in the lobby of Unified Motion Dance Academy premises; (ii) consent to having my child’s temperature taken before entering to participating in any dance classes, workshops, or recitals offered by Unified Motion Dance Academy; and (iii) adhering to all personal hygiene guidelines and social distancing guidelines prescribed by Unified Motion Dance Academy and applicable public health guidelines, including staying at least six (6) feet away from all employees or participants.

If my child has a body temperature above normal or any symptom that could be associated with COVID-19, I acknowledge that they will be asked to leave and not return until they have been COVID-19 symptom-free for at least 14 days. If my child is unable to return with in the 14-day window will participate in the class via Zoom. My signature and acceptance of this Agreement of Release and Waiver constitutes my consent to Unified Motion Dance Academy’s temperature monitoring policy and all other personal hygiene and social distancing policies prescribed by Unified Motion Dance Academy, which may be revised from time to time.

• In consideration for my child being permitted to participate in group or private dance classes, workshops and recitals provided by Unified Motion Dance Academy, I agree to assume full responsibility, and agree to accept and assume any and all risks of injury, and hereby generally and completely release, acquit, and forever discharge and release Unified Motion Dance Academy, its owners, officers, directors, employees, instructors and representatives (collectively, “the Unified Motion Dance Academy Parties”) from any and all liability for any risks, illnesses, injuries or damages, known or unknown, which I might incur as a result of my participation, which shall include, but not be limited to, being exposed to, or contracting COVID-19. In further consideration thereof, I knowingly, voluntarily and expressly waive any claim I may have against the Unified Motion Dance Academy Parties for any illnesses, injury or damages that my child may sustain as a result of their participation. In addition, I shall defend, indemnify, and hold harmless Unified Motion Dance Academy Parties against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees and the costs of enforcing any right to indemnification under this Agreement of Release and Waiver, and the cost of pursuing any insurance providers, arising out of or resulting from any claim of a third party related to my child’s participation in the activities offered by Unified Motion Dance Academy.

• My child will not engage in any inappropriate conduct or conduct which is in violation of this Agreement of Release and Waiver which could result in injury or illness to myself or others.

• This Agreement constitutes the sole and entire agreement of Unified Motion Dance Academy and me with respect to the subject matter contained herein. Any prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter, are invalid and nonbinding on the parties. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable for any reason, the remaining provisions will remain in full force and effect as if this agreement has been executed without the invalid provision. This Agreement is binding on and shall inure to the benefit of the Unified Motion Dance Academy Parties, their successors and assigns, and me and my heirs, beneficiaries, and personal representatives. I agree that this Agreement of Release and Waiver shall be governed by the laws of Kentucky and if any conflict arises between me and Unified Motion Dance Academy, I will attempt to resolve the conflict in good faith through mediation before submitting my dispute to binding arbitration in Kentucky. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be determined by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and Mediation Procedures ("Commercial Rules").

• I agree that this agreement shall be governed by the laws of Kentucky and if any conflict arises between me, my child, and Unified Motion Dance Academy, I will attempt mediation before submitting my dispute to binding arbitration. I have read the above release and waiver of liability and fully understand its contents and voluntarily agree to all of the terms and conditions.

• This waiver is effective for all present and future visits to Unified Motion Dance Academy and shall not have an expiration date until all restrictions have been removed by the studio director.

TUITION AND FINANCIAL AGREEMENTS
• I understand that auto-pay is required for tuition payments.

• I understand that tuition is due the 1st of each month for nine consecutive months (Sept-May), regardless of attendance by my child, closings, holidays, etc. *June/July tuition due June 1st.

• I understand there is an automatic $25 late fee for accounts not paid by the 6th of the month.

• I understand that if my account is more than 30 days past due my child will not be permitted to participate in dance class until the account is current or payment arrangements have been made with the director.

• A $40 service charge will be added to my account for any returned checks.

• I understand tuition is based on a yearly rate and will not be credited or reduced for absences or holiday closings.

• I understand a DROP FORM must be filled out and turned into the director by the 20th of the month in order to stop auto payment, if I wish for my dancer to withdraw from classes at Unified Motion Dance Academy. If the form is submitted after the 20th day of the month I will be charged for the next month.

COSTUME REQUIREMENTS
• A non-refundable costume deposit of a minimum of $70 per dancer is due December 1st. I understand this is just a deposit. Costume balances are due January 15th. Late charges will be assessed where applicable. Once a costume is ordered I understand it cannot be returned and the full balance is my responsibility.

PERSONAL PROPERTY AND NOTIFICATIONS
• I understand that Unified Motion Dance Academy is not responsible for lost or stolen property. We recommend labeling all of your child’s belongings, especially ballet, jazz, and tap shoes.

• I will contact the studio if there are any changes to the information on this form throughout the year and update the parent portal.

• I will frequently check my email for any notifications from Unified Motion Dance Academy and am responsible for reading the contents of the monthly emailed newsletter.

ACKNOWLEDGEMENT OF RISK AND WAIVER OF LIABILITY

As parent/legal guardian of the student listed above, I recognize that participation in dance and tumbling classes and activities could involve some possible personal injury. Despite precautions, accidents and injuries may occur. By signing this form, I assume all risks related to the use of any and all spaces used by Unified Motion Dance Academy. I agree to individually provide for all possible future medical expenses which may be incurred by my child as a result of any injury sustained in training or performance for Unified Motion Dance Academy.

I agree to release and hold harmless Unified Motion Dance Academy including its teachers, dancers, staff members, volunteers, and facilities from any cause of action, claims, or demands now and in the future. I will not hold Unified Motion Dance Academy liable for any personal injury or any personal property damage, which may occur on the premises before, during or after classes. Furthermore, I agree to obey the class and facility rules and take full responsibility for my behavior in addition to any damage I may cause to the facilities utilized by United Motion Dance Academy.

I give Unified Motion Dance Academy permission to use my child’s picture in or on any form of advertisement for Unified Motion Dance Academy or a Unified Motion Dance Academy affiliated event.
