PARTICIPATION WAIVER AND RELEASE OF LIABILITY

By signing below, (parent/guardian on behalf of minor), I hereby agree to the following Waiver and Release of Liability:
1. Waiver and Release: My student’s participation in any and all classes/programs/shows/events is voluntary and subjects the student(s) to the possibility of physical injury (which could be minimal, serious, and/or in extreme cases result in death). Accordingly, the student/parent or guardian of student, agree to the following:
a. I hereby release and hold harmless the Dance Lab, its owners, teachers, assistants, employees, and volunteers from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these risks, including those caused by negligent acts or omissions.
b. I recognize that physical exertion is involved in all activities and attest and certify that my student is fit to attend class, events, competitions, and/or shows; and have not been advised otherwise by a health care professional.
c. I am solely responsible for any and all medical and related bills that my student may incur because of an injury, including those that may occur while traveling to events/shows/competitions regardless of location or mode of transportation.
2. Coronavirus/COVID19: I acknowledge that the Dance Lab has put into place preventative measures to reduce the spread of COVID-19; however, the Dance Lab cannot guarantee that you or your student(s) will not become infected with COVID-19.
a. I and my student(s) voluntarily assume the risk that my student(s) and myself may be exposed to or infected by COVID-19 by attending classes/events/competitions/shows hosted by the Dance Lab and that such exposure or infection may result in personal injury, illness, permanent disability, and death.
b. I am solely responsible for any and all medical and related bills that I or my student may incur because of exposure to COVID-19 and/or illness/infection and the treatment of and for the exposure of COVID-19.
3. Online Participation: I acknowledge that the Dance Lab has given the option of online classes this year so that my student may participate fully as if in class and will take all reasonable steps necessary to protect my student from online known dangers.
a. I am aware of and assume the risk of participating online including but not limited to, the risk of data mining, phishing, viruses, malware, data breach of online information, cyberbullying, exploitation, victimization, cyber stalking, online grooming, cyber predators, digital footprint, reputation loss, compliance violations, image replication.
b. I recognize that physical exertion is still involved by participating in online classes and I hereby hold the Dance Lab, its owners, teachers, assistants, employees, and volunteers from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these risks, including those caused by the negligent acts or omissions.
c. I attest and certify that my student is physically fit to participate in all online classes, events, competitions, and/or shows.
d. I understand that it is my responsibility to ensure my internet connection is working before, during, and after the live online classes for my student provided by the Dance Lab.

This Agreement shall be binding on my estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on my behalf or on behalf of my estate or the estate of my student. This Agreement shall be good for one year from the date of signing.
