I understand that I have enrolled myself/the above child (ren) in a program of physical activity with Claire Ashley Price, DBA Mariposa School of Dance (MSD). I have provided current health status to MSD I realize that participants are under no pressure to physically exert themselves beyond my/his/her capacity and it is the parents and/or participants responsibility to use personal judgment concerning the degree of their participation in all activities. I, the child(ren)’s parent and/or legal guardian represent that I understand the nature of the activities and that the above named child(ren) are qualified, in good health, and in proper physical condition to participate in such activities and that I am authorized to sign this Release and Waiver. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in such activities. I fully understand that the activities involve risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the “releases” named here in; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, cost, and damages I incur as a result of my participation in the activities. I hereby release, discharge, and covenant not to sue Claire Ashley Price and/or Mariposa School of Dance, their respective administrators, directors, agents, officers, managers, members, volunteers, and employees, other participants (the “Releases”) from all liability, claims, demands, losses, or damages, on the child(ren)’s account caused or alleged to be caused in whole or in part by the negligence or the Releases or otherwise, including negligent rescue operations and future agree that if, despite this release, waiver of liability, and assumption of risk I, the child(ren) or anyone on my or the child(ren)’s behalf, makes a claim against any of the Releases, I will indemnify, save, and hold harmless each of the Releases from any loss, liability, damage, or cost, which any may incur as the result of such claim, including without limitation litigation expenses and attorneys’ fees. I have read the Release and Waiver and understand that I have given up substantial rights by signing it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. I give MSD permission to photograph or video my child and I understand that pictures maybe used for publicity purpose including brochures, advertisements, and/or MSD website and social media platforms. Names are not used in any promotional material. Exclusion of photography/video release may be requested in writing prior to class start date to the owner.

I understand that Mariposa School of Dance requires that ALL ACCOUNTS have a credit/debit card on file with Dance Studio Pro/Stripe, the studio's software and merchant processor. Mariposa School of Dance does not keep any individual's account or card information in their possession. It is MY RESPONSIBILITY to review my statements/account status in my "Parent Portal" that can be accessed from any computer or smart phone at any time, to assure my bank account and studio account are noted correctly and to manage my payment methods. If I would prefer to pay with cash or a check to the office, my payment must be received and recorded to my account prior to the 20th of each calendar month. I understand that the merchant processor cannot process my payment method when a zero balance is cited on my account. Otherwise, I acknowledge that my payment method will be processed on the 20th of the month prior to the upcoming month. For example, October 2024 tuition will be processed on September 20, 2024. If one wishes to avoid the processing fee or the payment from processing from that payment method,
I am responsible for sending an email to info@dancemariposa.com to notify and make alternate payment arrangements by delivering cash or check before the studio closes, or through DSP/Stripe or PayPal by the 19th at 11:59PM. It is my responsibility to contact the studio via email if a payment made with an alternate form does not appear correctly in my account as viewed in the "Parent Portal." If there are any errors, I will notify Mariposa School of Dance promptly via email to have all matters corrected. Mariposa will respond within 24 hours of notification.
If I need more time to pay my bill or to establish a payment plan, I will contact Mariposa School of Dance via email prior to the 20th of the month. Mariposa School of Dance will grant one extension to any account. If payment is not received as agreed upon and such is not communicated to MSD, Mariposa School of Dance will deem the account to be in default and payment and late fees will be due immediately.

I acknowledge the contagious nature of COVID-19 and other contagious diseases and viruses and voluntary assume the risk that I and/or my children may be exposed to or infected by COVID-19 by attending and participating in activities at Mariposa School of Dance and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 and other contagious diseases and viruses may result from the actions, omissions, or negligence of myself and others, including, but not limited to, employees, independent contractors, volunteers, and program participants and their families. I acknowledge that I may choose to participate in classes via ZOOM at my request at the full, published, tuition rates. I agree to use my best judgment and stay informed regarding state and regional guidelines.

I acknowledge that all tuition and registration payments made are non-refundable. Class tuition is pro rated the first month of enrollment if beginning after the first class day of the month. Tuition rates are billed in equal monthly installments on the 20th of the prior month, and are due on the first of the calendar month. Tuition amounts are the same regardless of holidays or the number of class days in a month. Absences of classes are not grounds for refunds or pro rates. Tuition is automatically billed monthly for each enrolled student for the duration of the season. I understand that the month of April 2025 is the last month of Season 5 and will be billed automatically.

If I choose to drop a class or classes and do NOT notify via email info@dancemariposa.com with at least two weeks written notice before the first of the next billed month, I am still responsible for paying the billed amount. The only person that drops or account matters should be discussed with is the owner, Ashley Price, via email.

I understand that if I fail to inform MSD of my desire to drop a class, the billed amount and late fees will be assessed if unpaid. I further understand that if I fail to return correspondence regarding my account with the owner, the account will be sent to collections.

If the studio must cancel class due to inclement weather or other circumstances, make up options will be offered. Mariposa School of Dance will not refund due to weather cancellations. Volatile weather is a reality of living in Southeast Texas, and we will always keep the well being of students and staff in mind when making decisions. We also ask that parents/adults use their own discretion regarding weather/road conditions when traveling to and from Mariposa School of Dance.
