MIDLAND FESTIVAL BALLET WAIVERS AND RELEASE OF LIABILITY
In consideration of me or my child/ward being allowed to participate in any way in any Midland Festival Ballet programs, events, or activities, I understand, acknowledge, and agree to the following:
1. I on behalf of myself, my spouse, and my child/ward agree to comply with any and all rules, regulations, terms, and conditions for participation in all Midland Festival Ballet activities. I have read and agree to comply with the attached Midland Festival Ballet Policies and Procedures. I certify that the participant is physically fit and able to participate in Midland Festival Ballet’s programs, events, or activities, and that I have not been advised otherwise by a qualified medical professional.
2. I on behalf of myself, my spouse, and my child/ward acknowledge and fully understand that there is a degree of risk involved in all physical activity including dance, and that the participant will be engaging in activities that may result in serious injury. I knowingly and voluntarily assume all such risks for myself and/or my child/ward, and I assume full responsibility and liability for my participation and/or my child/ward’s participation.
3. I on behalf of myself, my spouse, and my child/ward hereby release and hold harmless Midland Festival Ballet; its directors, officers, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct activities (the Releasees), with respect to any and all injury, disability, death, or loss or damage to person or property relating to or resulting from or arising out of my participation in any programs, events, or activities of Midland Festival Ballet.
4. I on behalf of myself, my spouse, and my child/ward indemnify and hold harmless all the above Releasees from any and all liabilities incident to my involvement or participation in these programs.
5. I on behalf of myself, my spouse, and my child/ward acknowledge that physical contact between dancer and instructor is sometimes necessary for correct training and placement. I hereby consent to such contact between dancer and teacher. This is not a consent to physical discipline of any kind.
6. I on behalf of myself, my spouse, and my child/ward consent to medical treatment as may be appropriate in the event of injury, accident, or emergency circumstances. This includes treatment by physicians, hospital and clinic personnel, or other appropriate health care providers. I release Midland Festival Ballet from responsibility for any such actions. Before providing any medical care Midland Festival Ballet will attempt to contact me, my spouse, and our emergency contact unless circumstances are exigent.
7. I on behalf of myself, my spouse, and my child/ward grant Midland Festival Ballet permission to use photographs, videotapes, or recording of us for any legitimate purpose. This may include use in newspaper and/or media publication including social media. I agree to seek no compensation for such publications. If I do not agree to the use of photography or video materials, I will notify Midland Festival Ballet in writing to deny such use.
8. I, the parent/guardian assert that I have explained to my child/ward: the risks of the activity, his/her responsibilities for adhering to the rules and regulations, and that my child/ward understands this agreement.
I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
