Alma Dance School, LLC and Alma Dance Theater, NFP is pleased to have you as our client. Ballet, or any type of dance, is a wonderful activity for healthy people of virtually all ages and levels of ability. Dance not only improves your strength, coordination, and agility, but also inspires focus, discipline and improves self-esteem. Above all, participating in our dance education program can be a great family experience. However, as in any physical activity, there is an inherent risk of bodily injury, illness, or even death. These risks also extend to those present in our facility, even if they are not actively participating in an organized event. Such risks can be minimized through proper instruction, supervision and education. However, under the best circumstances, such risks can never be eliminated. Your knowledge, understanding and appreciation of these risks is extremely important to you in making an informed decision. By signing this agreement, either individually, and/or in the capacity of a parent or legal guardian, you acknowledge (1) the inherent risks of bodily injury, psychological injury, illness or even death, by participating in the dance education program activities, or any physical activity, at Alma Dance School and with Alma Dance Theater, NFP as a student, or by being present as a guest or spectator, and (2) that the student is sufficiently physically fit and in good physical and mental health to participate in the dance education program at Alma Dance School and with Alma Dance Theater NFP, and does not have any physical/mental problems, restrictions, or conditions that would interfere with participating.

Release of Liability:
In consideration of participating in the dance education program at Alma Dance School and with Alma Dance Theater, NFP, I/we hereby agree to release, waive, covenant not to sue and discharge Alma Dance School and Alma Dance Theater, NFP, its owners, directors, instructors, faculty, employees and agents, from any and all claims, demands, losses or damages, of any nature, on account of any injury, including, but not limited to bodily injury, psychological injury, illness, death, or damage to property, arising out of participation in the dance education program or performance with Alma Dance School or Alma Dance Theater, NFP, whether on the premises of the Alma Dance School, Alma Dance Theater, NFP or elsewhere, before, during or after classes and performances. This agreement includes, but is not limited to, claims or demands on account of injury or damage caused or allegedly caused by the negligence of Alma Dance School, Alma Dance Theater, NFP, its owners, directors, instructors, faculty, employees and agents. In consideration of participating in the dance education program at Alma Dance School and with Alma Dance Theater, NFP, I/we agree to indemnify Alma Dance School, Alma Dance Theater, NFP, its owners, directors, instructors, faculty, employees and agents, and to hold each of them harmless, from any claim or demand on account of injury to or damage suffered as a result of participation in the dance education program at Alma Dance School, and with Alma Dance Theater, NFP whether on the premises of the Alma Dance School, Alma Dance Theater, NFP or elsewhere, before, during or after classes and performances, and whether or not caused by the negligence of Alma Dance School, Alma Dance Theater, NFP, its owners, directors, instructors, faculty, employees and agents. I understand that any studio, gymnasium, auditorium, or theater is not accountable for any injury, illness, or property damage occurring during performance or instruction. I/we understand that dance instruction involves kinetic health corrections to the body that may involve physically touching the student as part of regular class work and rehearsals. In consideration of participating in the dance education program at Alma Dance School, and with Alma Dance Theater, NFP, I/we will not hold Alma Dance School, Alma Dance Theater, NFP, its owners, directors, instructors, faculty, employees and agents, liable for any physical touching which is incidental to and in the course of the dance education program performance at Alma Dance School and Alma Dance Theater, NFP.

The undersigned have read and agree to be bound by the terms and conditions outlined above.

Adult Ballet (Friday 5-7:30pm) Drop-In Class Attendance and Credit Policy

Effective November 1st, 2024, credits WILL ONLY be issued under the following condition:

-School Cancellation: If the school cancels a class that a dancer has already paid for, a credit will be applied toward the following class.

Please note that NO credits will be given for any other reason, including:

-No-Show: If a dancer pays for a class but does not attend, NO credit will be issued.

Since these are drop-in classes (not part of a session where dancers register for a set period of time), our registration system is not designed to track missed classes or issue credits for individual absences. It is not feasible within our system, and our staff cannot manually track attendance and credits on a weekly basis.

-Dancers MUST register 48 hours before the class they wish to attend. Classes with fewer than 4 dancers will not run.

I hereby authorize Alma Dance School, LLC to automatically charge my credit card or bank account on the due date of each installment payment in the amount required for each of the installments or per semester. These payments will be made according to the billing schedule that corresponds to my dancer’s program/level. I understand that payments will be processed via auto-pay on each installment’s due date. Additionally, I understand that auto-payments cannot be re-scheduled for another payment date.

COVID-19 is a highly contagious virus that spreads from person to person. In addition to the normal high standard sanitation measures this Studio has always adhered to, new preventative measures have been put in place to further reduce the spread of this novel coronavirus. However, these best practices still offer no guarantee regarding your potential risk of being infected.

I agree to follow safety procedures, guidelines, and requests from staff as a condition of my participation in dance classes and related events and activities, and understand that I may be asked to exit the building, or proceed to an isolation area if Alma Dance School staff determines that an unsafe situation has arisen.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
ASSUMPTION OF RISK / WAIVER OF LIABILITY / INDEMNIFICATION AGREEMENT

In this Waiver/Release Agreement, “Dance” shall include all activities, events or services provided, arranged, organized, conducted, sponsored or authorized by Alma Dance School and the Releasees and shall include, but not be limited to, “Dance”, orientational and instructional classes, seminars and sessions, performances, rehearsals, and other such activities, events and services in any way connected with or related to “Dance”.

In consideration of being allowed to participate on behalf of Alma Dance School in dance classes and related events and activities, the undersigned acknowledges, appreciates, and agrees that:

1 .Participation includes possible exposure to and illness from infectious diseases including, but not limited to, MRSA, influenza, and COVID-19. While specific rules/practices and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
2 .I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest staff member immediately; and,
4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Alma Dance School, its officers, directors, owners, instructors, employees, agents, independent contractors, suppliers, successors and assigns, and other participants, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 19 AT THE TIME OF REGISTRATION)
This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent provided by law.

COVID-19 is a respiratory condition caused by a coronavirus. Some common symptoms of COVID-19 are fever, fatigue, cough, loss of appetite, body aches, shortness of breath, mucus or phlegm.

I (referring to the “Dancer”) agree to the following:

I understand the above symptoms and affirm that I, as well as all household members, do not currently have, nor have experienced the symptoms listed above WITHIN THE LAST 14 DAYS.

I affirm that I, as well as all household members, are not currently waiting on test results from a test conducted for the purpose of detecting the presence or absence of COVID-19.

I affirm that I, as well as all household members, have not been diagnosed with COVID-19 WITHIN THE PAST 30 DAYS.

I affirm that I, as well as household members have not traveled outside of the country, or to any city considered to be a “hot spot” for COVID-19 infections WITHIN THE PAST 30 DAYS.

I understand that ALMA DANCE SCHOOL cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each Dancer.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

Major Injuries/Serious Health Problems: In the case of a major injury or a serious health problem that prevents a student from attending 20 consecutive days of classes or more, a credit will be issued toward the next semester or the 2024-2025 school year under the following conditions:

1) A letter must be presented from the specialist/physician directly treating the dancer and their condition. The letter must state:

-The dancer's name, last name, and date of birth.
-Explain the dancer’s current medical condition.
-Explain the treatment recommendations/plan for the dancer.
-Mention the number of days a dancer will be unable to participate in class.
-Mention a predicted return date stating when the dancer can resume their dance schedule.
-The letter must be made out to Alma Dance School's directors and must be dated/signed by the specialist/physician directly in charge of the dancer's treatment.

Please note that the letter must contain everything that is requested above in order to be valid. The letter MUST be written by the specialist/physician directly treating the student. More than one letter may be requested by the school if the specialist in charge of your dancer’s treatment is unable to provide an approximate return date on his/her first letter and/or if the letter does not contain all the information requested above.

2) A credit, determined by the number of days as indicated by the doctor/specialist, will be issued toward tuition for the next consecutive semester or the following school year. Please note that if some of the information submitted to the school is incomplete or inconclusive, the school will not be able to issue a credit until all the information needed has been presented.

3) Dancers, physically unable to participate in class, MUST continue to attend their classes, observe, and take notes unless otherwise noted by their doctor. This activity will ensure they do not fall behind in the dance curriculum.

Minor Injuries/Minor Health Problems: In the case of a minor injury or a minor health problem that prevents the dancer from attending a few consecutive classes, the dancer will have the opportunity to make up the missed classes once the dancer has recovered. Make-up classes will not be permitted during the school’s breaks and/or during any other scheduled open or master classes offered outside the year-round program. It is the responsibility of the student/parent to schedule a make-up class. We will offer suggestions for suitable make-up classes, but it is incumbent upon the student to attend the make-up(s) within the school term.

Make-up Classes Policy: To schedule a make-up class, please send an email to the school at info@almadanceschool.com. Make-up classes must be scheduled in another class of the same level/type, if available, or in a lower-level class of the same style. While we will offer suggestions for suitable make-up classes, it is the responsibility of the student/parent to schedule the make-up class. It is important for the student to attend the make-up(s) within the school term. However, please note that classes that have reached their full capacity may not have an option for makeup.
Class Cancellation Policy: Occasionally it may be necessary for Alma Dance School to cancel scheduled classes for, including, but not limited to, inclement weather, teacher illness, inability to find an adequate substitute teacher, and/or performance and schedule conflicts. We will give notice of any cancellations as far in advance as possible. If the same class level is available on another day, students should make up the missed class in a timely fashion, within 4 weeks. Canceled classes may be rescheduled if another class of the same level/type is not available in the term. Tuition will not be pro-rated for canceled classes

Payments/Late Fee/Expired Card/Installment Payment Removal Policies:

1. Registration and all tuition payments will be made online through the Parent Portal. Each family will have their own login and password to register their dancer. The remaining Installment Payments are due on the 1st of each month and will be processed as auto-payments.

2. Late Fee: Payments that are not received on the 1st of each month are considered LATE and will have an automatic late fee of $35 added to their bill. Families who have an expired card when the system runs autopay will be contacted directly by the school. In this scenario, the family will be asked to change their credit card in their portal account on the same day, so that the tuition payment can be processed. Failure to process the payment on the 1st of each month will result in a $35 late fee which will be added to the total tuition amount owed for that installment payment.

3. Non-Sufficient Funds Fees: Any auto-payments returned or with notification of NSF (non-sufficient funds) will have an automatic NSF fee of $30 added to their bill. The $30 NSF fee will be added to the total payment amount due that day. A valid credit card must be maintained in your parent portal account year-round to avoid an NSF fee. Any changes/updates to your credit card information must be completed directly by you in your parent portal account before the 25th of each month to not affect the auto-payment.

4. Families who have TWO incidents in which the autopayment cannot be processed on the due date as a result of problems with their payment method WILL BE removed from the school's installment payment plan and will be required to pay the remaining tuition amount in one full payment to ensure their dancer can continue attending classes at Alma. Dancers with an outstanding balance WILL NOT be able to join the class until all payments have been completed.

Publicity Release: I/we hereby agree that Alma Dance School, Alma Dance Theater, NFP, or any associations or agents, may photograph or videotape the student participating in the dance education program, performance, or any other activity associated with Alma Dance School or Alma Dance Theater, NFP. I/we agree that any images may be used for advertising, marketing, or promotional purposes, including, but not limited to display at Alma Dance School, Alma Dance Theater, NFP, or elsewhere, social media including Facebook, Instagram, newspapers, magazines, news stations coverage, newsletters and the Alma Dance School and Alma Dance Theater, NFP websites.

Medical Emergency: I will be contacted first in the event of a medical emergency. If I cannot be reached, my emergency contact person will be notified. If my emergency contact person or I cannot be reached, I hereby authorize Alma Dance School, Alma Dance Theater, NFP, or its appointed representatives to sign for medical care. I hereby give permission for my child to be treated by an emergency medical technician or other medical professional as deemed necessary by Alma Dance School, or Alma Dance Theater, NFP in the event of an emergency medical situation.

Tuition Commitment/Refunds Policies:
Once a student registers for the Pre-Professional Division or the Dance Division, a student is committing to the entire school year. Once a student registers for the Children's Division, a student is committing to the entire semester. Year-Round Tuition, Semester’s Tuition and any other fees paid to Alma Dance School or Alma Dance Theater, NFP are non-refundable and non-transferable. Alma Dance School’s tuition will not be pro-rated or refunded under any circumstances.

Annual Registration Fee: There is an annual registration fee of $35 per dancer. This fee is only charged once per academic year, at the time of a dancer’s annual registration.

Tuition Late Fee: $35

Class Etiquette Policy:
The dancer must display a positive, respectful, and cooperative attitude during all classes, rehearsals, and performances. We strive to create a healthy and positive training environment for our dancers. Therefore, we expect all dancers to be supportive and respectful of all instructors, staff members, dancers, or any other personnel associated with Alma Dance School. Negative and disrespectful attitudes will not be tolerated. The director reserves the right to dismiss any dancer who displays a repeated poor or negative attitude towards the institution, directors, faculty, staff, dancers or any other person associated with Alma Dance School.
