Any recreational (non-mandatory) class may be cancelled with a 30-day written notice to the studio. Any class cancelled outside of this time frame will be charged the regular tuition rate as scheduled on the 1st and will be cancelled the following month. Our studio tries to provide the best class experience possible, and this includes maintaining our class sizes. Your paid tuition holds your spot in class for an entire month and effects our waitlists. Your adherence to this policy is much appreciated.
"CORONAVIRUS/COVID-19 ACTIVITY PARTICIPATION ASSUMPTION OF RISK,
RELEASE, WAIVER, AND DISCHARGE"
"The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. It is believed that an asymptomatic individual can be infected with and transmit COVID-19 without their knowledge.
Part Time Mountain Man, Inc., doing business as Dance Studio of Orange County (“Dance Studio”) has put in place preventative measures recommended by the State of California to reduce the spread of COVID-19, however, Dance Studio cannot guarantee that you, your child(ren), your spouse, or anyone else will not become exposed to or infected with COVID-19 as a result of participating in a Dance Studio program, event, or activity. Participation in a Dance Studio program, event or activity could increase the risk of contracting COVID-19.
NOW, THEREFORE, in consideration of being permitted to participate in programs, events and/or activities offered by Dance Studio, I understand, acknowledge, and agree to the following:
I have independently evaluated and reviewed the risks of being exposed to or infected with COVID- 19 and have determined to participate in Dance Studio programs, events, and/or activities with full knowledge and acceptance of the risk. Fully understanding these risks, I, for myself, my child(ren), my spouse, my legal representatives, heirs, and assigns, hereby agree to assume full responsibility and liability for the risk of bodily injury, illness, permanent disability, and/or death which may result from exposure to or infection with COVID19 before, during, or after participating in a Dance Studio program, event, or activity.
I further certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child(ren) including the risks of presence and participation and his/her personal responsibilities for adhering to the rules and regulations for protection against communicable diseases. Furthermore, my child(ren) understands and accepts these risks and responsibilities.
I, for myself, my child(ren), my spouse, my legal representatives, heirs and assigns, hereby waive, release, and discharge Dance Studio, its officials, employees, volunteers, attorneys, and agents from any and all liability to me, my child(ren), my spouse, my legal representatives, heirs, and assigns, for any and all losses or damages resulting from bodily injury, illness, permanent disability, and/or death, whether caused by negligence of Dance Studio or its officials, employees, volunteers, attorneys, and agents or otherwise, which claims, losses, and demands arise during or result directly or indirectly from exposure to or infection with
COVID-19 before, during, or after participating in a Dance Studio program, event, or activity."
WAIVER AND RELEASE OF LIABILITY
In consideration of the risk of injury while participating in Dance/Gymnastics (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge The Dance Studio of Orange County, located at 21196 Beach Blvd, Huntington Beach, California 92648, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH TRAVELING TO AND FROM AS WELL AS PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO, PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL, OR THE CONDITION OF THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN OR UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY, INCLUDING TRAVEL TO, FROM AND DURING THIS ACTIVITY.
I agree to indemnify and hold harmless The Dance Studio of Orange County against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If The Dance Studio of Orange County incurs any of these types of expenses, I agree to reimburse The Dance Studio of Orange County.
I acknowledge that The Dance Studio of Orange County and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of The Dance Studio of Orange County.
I ACKNOWLEDGE THAT THIS ACTIVITY MAY INVOLVE A TEST OF A PERSON'S PHYSICAL AND MENTAL LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR
DEATH, SERIOUS INJURY, AND PROPERTY LOSS. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE
TO RELEASE AND DISCHARGE The Dance Studio of Orange County AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAI
The Dance Studio of Orange County FOR PERSONAL INJURY OR PROPERTY DAMAGE.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of The Dance Studio of Orange County, its agents, and employees.
In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant,
, and The Dance Studio of Orange County agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and
enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

I am aware that this is a release of liability and a contract and that I am

Any missed classes may be made up in another class of equal or lower level within 30 days of the missed class. Competition Members can only make up a missed technique class in another equal technique class as these are mandatory.
Prior to taking a make-up class, the studio must be notified, and the class approved for your make up. No more than 2 make-ups can be used for any one particular class. We strive to keep adequate class sizes for the benefit of your child. Our studio offers a wide range of classes and times to accommodate your schedule. Make-ups are not designed to be used in place of paying for a monthly class.
Competition Practices are not eligible for make ups.
CODE OF CONDUCT
All dancers and families at the Dance Studio of Orange County must strive to be courteous, positive and polite to everyone at all times. Our studio has a zero-tolerance policy for bullying or negative behaviors towards others. This includes parents. We pride ourselves on being a cohesive dance family.
It is important that students maintain proper dress code for all classes at all times. This ensures the teachers are able to make adequate corrections to your child.
Pink Leotard preferred with pink tights and pink ballet shoes
Black leotard with pink tights and pink ballet shoes. Hair must be pulled back into a tight ballet bun.
Tight-fitting jazz pants/leggings/shorts with a leotard, sports bra or tight-fitting shirt. Tan Super Jazz shoes or half soles for Jazz/Tricks. Half soles for Lyrical. Black tap shoes for Tap.
Loose fitting clothes with sneakers.
Tight fitting clothing, bare feet
Tuition is due on the 1st of every month. All tuition must be paid via auto pay from a credit/debit card or ACH. No exceptions. Tuition does not fluctuate based on number of weeks, studio/holiday closures or missed classes. A sibling discount of 15% off the total tuition will be given.
A student registration fee will be collected on an annual basis. This cost will be included in your first tuition payment, and every September after that, following the start of our new season. Registration will be $40 per Student. Your dancer may be absent from the studio for 1 month before being charged a re-enrollment registration fee.
