Pelican Productions Terms and Conditions of Sale
Pelican Productions PTY LTD (ABN -51607954496) trading as Pelican Productions provides performing arts development and education services, including the sale and distribution of participant tickets and promoter or person responsible for holding the relevant event (the “Seller”). In providing these services, Pelican Productions owns and operates Music Theatre Camp, Spotlight and musicals.
Please read these Terms and Conditions for Music Theatre Camp or Spotlight, herein referred to as “MTC” and/or Spotlight. By registering for MTC or Spotlight, you agree to be bound by these Terms and Conditions.
These Terms and Conditions relate both to the enrolment for and attendance at our events. These Terms and Conditions apply to the person enroled and any subsequent participants registered (“you/parent/guardian”).
Variation to Terms and Conditions
Pelican Productions may vary these Terms and Conditions at any time by updating them. Any variations will only apply to registrations made after these Terms and Conditions have been updated. In the case of any changes made, all parties will be notified in writing.
Additional Seller Terms and Conditions
Each registration is also subject to any additional terms and conditions of the Seller for the particular event. The additional terms may be disclosed as part of the event information on our website and included in the registration pack.
Refunds, exchanges and replacements
1. Pelican Productions individual deposit fees of $150.00 is non-refundable.
2. Pelican Productions will only offer a refund of your fee if an event is cancelled, rescheduled or significantly relocated by the Seller (and you cannot or do not wish to attend the rescheduled or relocated event), or to the extent otherwise required by law (including the Australian Consumer Law). Pelican Productions does not offer refunds or exchanges as a result of a change in your personal circumstances.
3. A tired refund policy for circumstances for COVID related restrictions which prevent rehearsals and/or performances commencing are (detailed below 3.1). If an event is cancelled, rescheduled or significantly relocated by the Seller, all liability is limited to the amount for which the registration was purchased (including any fees or charges). Unless required by law (including the Australian Consumer Law), neither Pelican Productions nor the Seller will be liable for any other losses incurred by you as a result of the cancellation, rescheduling or relocation of an event, including any travel and accommodation expenses.
3.1 COVID related rehearsal and performance cancellation
In the case of rehearsals or shows not commencing, the initial deposit paid (refer to point 1 above) on enrolment is non-refundable. Should rehearsals commence the following breakdown will apply:
Day 1 rehearsal complete (Monday 10th Jan 2022) – 80% of remaining fee after non-refundable deposit will be refunded.
Day 2 rehearsal complete (Tuesday 11th Jan 2022) – 60% of remaining fee after non-refundable deposit will be refunded.
Day 3 rehearsal complete (Wednesday 12th Jan 2022) – 40% of remaining fee after non-refundable deposit will be refunded.
Day 4 rehearsal complete (Thursday 13th Jan 2022) – 20% of remaining fee after non-refundable deposit will be refunded.
Day 5 rehearsal complete (Friday 14th Jan 2022) – no fee refund applicable.
All performers will retain their MTC/Spotlight t-shirt.
4. Variations to performances or cancellation of events
4.1. The Seller reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.
5. Ticketing
5.1 In the case of no performances full ticket refund will apply.
5.2 In the case of performance with no audience all tickets will be refunded in full and a live stream option will be available to purchase. Note: in the event of live stream only one show will be performed live per cast.
5.3 Proof of purchase may be required for any refund or exchange.
