By signing this waiver I agree to the following terms:
-I agree to receive communications from Valley Dance Studio and its employees via text, phone call, and/or email. I understand that normal messaging rates may apply and are not the responsibility of Valley Dance Studio.
-I understand that this annual registration fee is due every season, is non-refundable, and non-transferable. NO EXCEPTIONS.
-I have read, understand, and agree to Valley Dance Studio's policies: https://www.valleydancestudio.com/policies
-I have read, understand, and agree to comply with the Valley Dance Studio dress code. I understand that if my student shows up to class dressed out of code, that they may be asked to sit out until they are wearing the proper attire. (The dress code policy can be found in our main menu > policy.)
-I have read and agree to the anti-bully policy. I understand that if my student is participating in rude and disrespectful behavior and they do not correct their actions, they will be removed from our programs. (Anti-bully policy can be found under the menu > Policies)
-I have seen the tuition and fee schedule and agree to make these payments in a timely manner. I acknowledge that I may be fined if payments are not made on time. I also understand that a fee may not be listed at this time but may be added later. We will give as much notice as possible if this does happen.
-RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMINITY AGREEMENT (hereinafter “The Release Agreement”) BY SIGNING THIS YOU WILL WAIVER CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE PLEASE READ CAREFULLY THE ACTIVITIES REFERRED TO IN THIS RELEASE AGREEMENT INVOLVE RISKS, DANGERS AND HAZARDS INCLUDING RISK OF DAMAGE, LOSS, PERSONAL INJURY AND DEATH. THESE RISKS, DANGERS AND HAZARDS ARE MORE FULLY DESCRIBED BELOW, ALL PARTICIPANTS IN THESE ACTIVITIES ARE REQUIRED TO SIGN THIS RELEASE AGREEMENT, WHICH IS INTENDED TO PREVENT PARTICIPANTS FROM SUING IN THE EVENT OF AN ACCIDENT. PLEASE TAKE TIME TO REVIEW THIS DOCUMENT CAREFULLY. DEFINITIONS In this agreement the term “programs” shall include all activities, programs, events, classes, and services provided by Valley Dance Studio, use of facilities, orientation or instructional sessions or lessons, and all other such related activities. ASSUMPTION OF RISKS I am aware that my and/or my children/children's participation in the programs at Valley Dance Studio involves many risks, dangers, and hazards, which could result in damage, loss, physical injury to me and/or my child/children. Some of these risks, dangers and hazards include, but are not limited to: - Health: overexertion, dehydration, fatigue, lack of fitness or conditioning - Premises: defective, dangers or unsafe condition of the facilities, falls, collisions with objects, equipment or persons. - Advice: negligent advice regarding fitness programs - My and/or my child/children's conduct and conduct of other persons, including NEGLIGENCE ON THE PART OF THE RELEASES, may increase the risk of damage, loss, personal injury or death. I understand that the Releases may fail to safeguard or protect me and/or my child/children from the risks, dangers, and hazards of the programs at Valley Dance Studio, some of which are referred to above. Despite the risks, dangers, and hazards of the programs at Valley Dance Studio, and fully understanding such risks, dangers and hazards, I wish for myself/child/children to participate in the programs at Valley Dance Studio with the Operator, and I FREELY ACCEPT AND FULLY ASSUME all such risks, dangers, and hazards and the possibility of personal injury, death, and loss resulting there from. INSURANCE I am aware that the Releases do not provide me with any disability, accident, liability or medical insurance or compensation, should I become injured or cause personal injury or property damage to any third party while participating in the programs at Valley Dance Studio. JURISDICTION This agreement and any rights, duties, and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of the State of UTAH. Any litigation involving parties to the Agreement shall be brought solely within the State of UTAH and shall be within the exclusive jurisdiction of the Court of the State of UTAH.
-I do hereby consent and agree that Valley Dance Studio, its employees or agents, have the right to take photographs, videotape, or digital recordings of me and/or my student to use in any and all media, now and hereafter known, and exclusively for the purpose of dance. I further consent that my name may be revealed therein or by descriptive text or commentary. I do hereby release Valley Dance Studio, its agents, and employees with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.
-I understand the importance of attendance. I will give as much notice as possible if my student will be missing class. I understand that there are no refunds given for missed classes.
-By signing this form electronically I agree to all the statements and waivers stated above. This form has been filled out honestly to the best of my knowledge. I understand that this electronic signature is legally binding and constitutes an agreement between myself and Valley Dance Studio and all who are involved such as employees, volunteers, assistants, etc.
