Liability Waiver, Acknowledgement of Risk & Photo/Video Release
For Guests, Trial Classes and Special Events
By signing this Release, Waiver and Assumption of Risk, (the “Releaseâ€), I agree to waive and release all liabilities, claims, actions, damages, costs or expenses of any nature associated with all risks inherent in participation in the activities specified below or other activities conducted in association with The Ballet Company (“TBCâ€). The Release extends to The Ballet Company and its past, present and future owners, officers, successors, personal representatives, assigns, attorneys, agents, instructors, employees, volunteers and locations of classes (all of which are collectively referred as the “Studioâ€). I agreed to indemnity and hold harmless The Ballet Company and the Studio from and against any and all claims, arising out of or in any way connected with my or my minor child’s or ward’s participation in The Ballet Company and Studio activities and events, including by not limited to all classes and rehearsals, and including all fees and costs. I understand and agree that this indemnity includes any and all activities described below suffered by me or my child or ward before, during or after participation in The Ballet Company and Studio activities.
I understand that dance, acrobatics and performing arts activities as conducted and taught at the Studio have inherent risks of injury. These risks include, but are not limited to bodily injuries such as muscle pain and pulls, broken bones, ankle injuries and other personal injuries. I recognize that me or my child or ward is exposing himself/herself to such risks when undertaking these activities. I understand that these risks cannot be fully eliminated without jeopardizing the essential qualities of the activity. I assume and accept all risks of injury or damages resulting from such activities which may occur to me or my child or ward. My, my child’s or my ward’s participation in these activities is purely voluntary, and I, my child, or my ward elect to participate, and join in that election, in spite of the risks.
I also agree that The Ballet Company, and its past, present, and future owners, officers, successors, personal representatives, assigns, attorneys, agents, instructors, employees and the Studio, are not responsible for any property loss or damage suffered by me, my child, or my ward, or any guests, parent guardian, or other family member of mine, my child’s, or my ward’s which may occur at The Ballet Company and in the Studio or its surrounding property.
I further understand that I have been advised of the need for me, my child, or my ward to be covered by adequate insurance to the event of any injury or damage described above that may occur while participating in activities and events at The Ballet Company or the Studio and I have obtained such insurance or have agreed to bear the costs of any such injury or damage myself, my child or my ward.
I have read and understand the terms of this Release and have had the opportunity to consider and discuss it with such individuals and advisors as I deem appropriate. By signing and dating this Release, I confirm that I have read the Release in full, that I understand its terms, and that I agree with those terms. I further confirm that by signing this Release, I acknowledge that if I, my child, or my ward is hurt or injured during participation in any event or activity at The Ballet Company or the Studio, I have waived my right, my child’s right, or my ward’s right to maintain a lawsuit against The Ballet Company and the Studio on the basis of any claim whatsoever, which is released hereby. In consideration of my, my child’s or my ward’s being permitted by The Ballet Company and the Studio to participate in the activities provided by The Ballet Company and the Studio.
I agree to grant to The Ballet Company and its authorized representatives permission to record on photography film and/or video, pictures of my participation. I further agree that any or all of the material photographed may be used, in any form, as part of any future publications, brochure, or other printed materials used to promote The Ballet Company, and further that such use shall be without payment of fees, royalties, special credit or other compensation.
I hereby attest, after reading this Release completely and carefully, that participation in activities and events at The Ballet Company and the Studio is entirely voluntary.
