LIABILITY WAIVER AND RELEASE
On behalf of myself and my children, I understand that there are risks associated with, arising out of, and inherent to the activities provided through Tarrytown Dance, dba TarryTown Dance Center Inc. They include but are not limited to, illness, injury, and death. In recognition of this acknowledged risk, I knowingly and voluntarily waive all right and/ or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to TarryTown Dance DBA TarryTown Dance Center Inc, it’s officers, agents, employees, instructors, subsidiaries, parent corporations, and all affiliated entities (hereinafter collectively referred to as “Tarrytown Dance”.)

I hereby agree to release Tarrytown Dance and hold TarryTown Dance Center Inc harmless of all liability, and hereby acknowledge that I knowingly and voluntarily assume full responsibility for all risks arising out of active participation in classes, performances, and activities through Tarrytown Dance on behalf of myself, the legal guardian, and the participant/s.

I am aware that this is a release of liability and an acknowledgment of my voluntary and knowing assumption of the associated risks. I have signed this document voluntarily and of my own free will in exchange for the privilege of participation.

I also give Tarrytown Dance permission to use my child’s picture in or on any form of advertisement or publication on behalf of Tarrytown Dance or a Tarrytown Dance affiliated event. (Please notify us in writing if pictures cannot be publicly displayed for any reason)

I understand that I must remain on the premises for the duration of the class for any of my children under the age of 5.

The participants for whom I am registering have my permission to participate in all Tarrytown classes, performances, and activities. I warrant the information is complete and correct and that I do have the authority to act and speak on behalf of the participants I enroll in classes at Tarrytown Dance. I further release Tarrytown Dance of all liabilities associated with my children's attendance at Tarrytown Dance.

An annual registration of $50 per dancer is due per dance season (fall/spring. There is no registration fee required for summer classes. All class enrollments are subject to a non-refundable deposit. DANCE SEASON DEPOSIT (fall & spring) is due at the time of registration for the dance season in the amount of $225. This deposit is applied to SPRING tuition and recital fees. If a class is canceled before completing the semester enrolled, this fee ($225) is non-refundable. All class changes and drops MUST BE SUBMITTED TO THE OFFICE IN WRITING. Letting an instructor know or just not showing up to class anymore is not sufficient. If a class is dropped within the first two weeks of the semester, you will receive a refund for any tuition paid LESS the season deposit and registration fee. After the first two weeks of the semester, NO refunds will be given. Account credits may be issued at the studio's discretion. Parents may switch, drop, and add classes with no penalties within the 4 weeks of a semester starting. NO class changes will be accepted unless authorized by an instructor or director after the first 4 weeks of classes.

Tarrytown Dance reserves the right to cancel classes with low enrollment. Any class with less than 4 dancers, will be canceled. If TTD cancels a class, all tuition and fees will be refunded.

Students are placed in class according to age and ability. Instructors have the right to move your child if they feel that another level is more appropriate.

Absolutely no make-up classes are allowed for group classes unless, for some reason, the studio has to cancel the class (inclement weather, etc). No refunds are given for missed classes.

For our dancers’ safety, students may not be dropped at the studio more than five minutes before class time and must be picked up promptly after class. Dancers under 5 years old may not be left unattended at any time in the studio without entering a class, camp, or event.

Any student who is more than 10 minutes late to a class may be asked to sit out and observe class by the instructor.

All instructors reserve the right to ask a student who is disrupting class to leave.

Observers and parents are not allowed to disrupt the instructor/class at any time unless there is an emergency.

Please schedule meetings with instructors through the office. During and between class times instructors are not permitted to leave their classes unattended to speak to parents. It is best to meet privately when the instructor may spend adequate time discussing your questions/concerns.

No gum, food, or drinks are allowed in the dance rooms.

The undersigned represents to Tarrytown Dance Center, Inc. of Austin, Texas, and its shareholders, officers, employees, instructors, and other representatives whether paid or volunteer (collectively the “Center”), that the undersigned is a parent or legal guardian of the child named below and is fully responsible for the care and well being of said child. The undersigned confirms that there are no mental or physical problems or limitations associated with said child’s participation in the programs of the Center.
The undersigned hereby authorizes the Center to obtain medical assistance (or administer simple first aid in the event of minor injuries) and to provide transportation for a said child in the event of any illness or injury to a said child while on the premises of the Center or otherwise in the care of the Center. In connection therewith, if the undersigned parent or legal guardian cannot make timely arrangements for emergency medical attention in the event of any illness or accident of said child while in the care of the Center, I hereby authorize the Center to take my child to the doctor on file or the nearest hospital, where medication or procedures such healthcare providers may deem necessary for said child’s well being may be administered. The undersigned further agrees to be financially responsible for all such medical services.
The undersigned acknowledges and agrees that the Center shall not be liable for any losses, liabilities, claims, causes of action or damages of whatever nature, whether foreseen or unforeseen, direct or indirect, REGARDLESS OF WHETHER ANY SUCH LOSS, LIABILITY, CLAIM, CAUSE OF ACTION OR DAMAGE RESULTS FROM THE NEGLIGENCE OF THE CENTER, BUT SPECIFICALLY EXCLUDING THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE CENTER, ITS SHAREHOLDERS, OFFICERS, EMPLOYEES, AGENTS, INSTRUCTORS OR OTHER REPRESENTATIVES, that may arise in or to the benefit of the undersigned, in the name of or for the benefit of said child, or in the name of or for the benefit of any other person as a result of personal injury to said child while on the premises of the Center or otherwise in the care of the Center, including without limitation, any injuries sustained while said child is being transported as herein authorized, and in connection therewith, the undersigned, on behalf of himself/herself, said child and any other parent or guardian of said child, hereby knowingly, intentionally and willfully RELEASES and DISCHARGES the Center from any and all of said losses, liabilities, claims, causes of action or damages.
In furtherance of the foregoing, the undersigned hereby agrees to indemnify and hold harmless the Center from and against any and all damages, claims, causes of action, liabilities, losses, suits, costs or expenses (including court costs and reasonable attorneys' fees and disbursements) of whatever nature which may arise from any injury to said child while participating in programs of the Center or being transported or medically treated as authorized herein, REGARDLESS OF WHETHER ANY SUCH LOSS, LIABILITY, CLAIM, CAUSE OF ACTION OR DAMAGE RESULTS FROM THE NEGLIGENCE OF THE CENTER, BUT SPECIFICALLY EXCLUDING THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF THE CENTER, ITS SHAREHOLDERS, OFFICERS, EMPLOYEES, AGENTS, INSTRUCTORS OR OTHER REPRESENTATIVES.
If one or more provisions of this instrument are held to be invalid, illegal or unenforceable under applicable law, such invalid, illegal or unenforceable provisions in their entirety or portions thereof, to the extent necessary, shall be severed from this instrument, and the balance of this instrument shall be enforceable in accordance with its terms.
The undersigned acknowledges that the child named below will or may be videotaped or photographed by the Center for educational, performance, or promotional purposes, and any likeness of the said child may be used by the Center for promotional purposes without further consent and without payment of any compensation by the Center to a said child or any other person. I have read the foregoing Release and Medical Care/Transportation Authorization and fully agree with and understand it in all respects.

I grant Tarrytown Dance the right to take photographs/video footage of my dancer and family in connection with the studio. I authorize Tarrytown Dance, its assigns and transferees to copyright, use and publish the same in print and/or electronically.
I agree that Tarrytown Dance may use such photographs and/or video footage of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.

CC payments are charged a 3.5% processing fee. To avoid this fee- sign up for ACH or pay your account by CC BEFORE auto pay is run. Contact or email the studio directly if you have questions regarding this fee or would like to set up a payment plan.

A $50 registration fee per dancer is due upon registering to reserve space in the class. This fee is non-refundable, and class space is not reserved until this fee is paid. A $225 SEASON deposit is due during enrollment. For fall students, this deposit IS applied to your tuition and fees. For new students entering the spring semester- this deposit is collected at the time of registration and also applied to your tuition and fees and is NON-REFUNDABLE if the class is canceled before a dancer completes the dance season. (Aug-May)

Tuition is due Aug 1 (fall) and Jan 3 (spring) and MUST be paid in full by the first day of class. Tuition is billed by semester. Alternative payment options are available by request. All accounts not paid in full by the end of the first month of dance class starting, will pay a late fee of $45 for each month their account is past due.

All statements are visible in their parent portal 24/7.

There will be a spring show in May. All participation is voluntary, and a recital participation fee of $245 per dancer and will be charged by Dec15th. Additional costume fees in the amount of $85 per costume, will be posted AFTER spring tuition and will be due by Feb 15th. The studio must be notified if a dancer does not wish to participate in the recital PRIOR to reital fees being paid. Recital participation includes ONE costume, acessories, tights, and unlimited show tickets.

Dancers enroll in a dance seaon- consisting of 2 semesters (fall and spring). Our dance season runs Aug-May. Semester withdrawals are permitted but must be submitted in writing before the start of the new semester to avoid charges.
