Our Parent/Student Handbook will be distributed during the first week of classes.

This Parent and Student Handbook has been prepared to enhance your understanding of the policies, practices, and benefits of Etoile Dance + Yoga Studio; it is important that you read this entire handbook. We reserve the right to make changes at any time without notice and to interpret these policies and procedures at the discretion of the directors. This Parent and Student Handbook supersedes all prior handbooks and previously issued policies.

After you finish reading this Parent and Student Handbook and within seven (7) days of receipt of it, please sign, date, and return this Acknowledgement Form. Make a copy of these pages for your records before submitting them.

By signing below, you acknowledge that you have read and understood the policies outlined in this Parent and Student Handbook. You agree to comply with the policies contained in this handbook and to read and understand any revisions to it and be bound by them. You understand that this handbook is intended only as a general reference and is not intended to cover every situation that may arise during your employment. This Parent and Student is not a full statement of Etoile Dance + Yoga Studio policy. Any questions about its contents can be discussed with the directors.

You acknowledge that this Parent and Student Handbook is not intended to create, nor shall it be construed as creating, any express or implied contract of employment for a definite or specific period of time between you and Etoile Dance + Yoga Studio or to otherwise create, express or imply legally enforceable contractual obligations on the part of Etoile Dance + Yoga Studio concerning any terms, conditions, or privileges of employment. If you are subject to a written employment agreement, and if any terms of that agreement conflict with the contents of this handbook, your employment agreement shall control and shall be considered binding.

Your execution of this Waiver will prevent you, your heirs and legal representatives from recovering or bringing a claim in any way connected with your or your minor child's participation in the Programs and/or Classes against Etoile Inc., its affiliates, or subsidiaries together with any of its officers, directors, agents, shareholders and/or employees thereof ("Etoile Dance + Yoga Studio").

As the parent of my child, I hereby give consent for my child(ren) to fully participate in all programs, events, and activities offered by Etoile, Inc. (all classes and programs referred to both separately and collectively as the "Programs"). I understand the nature of the program, events, and activities and my child(ren)'s experience and capabilities and believe he and/or she to be qualified to participate.

I understand and acknowledge that participation in such Programs could result in injury to program participants. I fully accept and assume all risk and responsibility as a result of my child(ren)s participation. I hereby release, waive, discharge and covenant not to sue Etoile, Inc., its owners, officers, instructors, employees, contractors and agents ("Releasees") from any and all liability, claims, demands or causes of actions whatsoever for personal injury, harm, loss, damage and/or damage to personal property that may occur while participating in Etoile, Inc. Programs and/or while on any premises where Etoile, Inc. is running activities, classes and/or camps whether or not owned, rented or managed by Etoile, Inc. I further agree that if, despite this release I, my child(ren) or anyone on behalf of my child(ren) makes a claim against any or all of the Releases, I will indemnify and hold harmless each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage or cost any Releasee may incur as the result of any such claim.

I further understand that participation in the Programs may expose me and/or my minor child to the risk of serious physical and/or psychological injury, incapacitation and/or death and that in the course of these activities I or my minor child may cause the same to others. I knowingly acknowledge and expressly assume the risks associated with my and/or my minor child's participation in the Programs and am voluntarily participating in the Programs with knowledge of the dancers involved and agree to accept any and all risks of damage, injury or death.

In the event of an accident or emergency, I hereby consent to Etoile, Inc. obtaining medical care from any licensed physician, hospital or clinic, including transportation and emergency medical services, for my child(ren).

I, having acknowledged awareness of the risks to health, life, and damage associated with the Programs, hereby expressly acknowledge and warrant to Etoile Dance + Yoga Studio that I will take all precautions necessary to protect myself and/or minor child against such risks.

I hereby agree that I, my heirs, legal representative, guardians and family agree not to make and do hereby waive any and all claims, demands, losses, suits and actions of any kind, whether at law, in equity, through litigation or arbitration, known or unknown, in connection with any injury or death to person or damage to our loss of property in connection with, or resulting from, my or my minor child's participation in the Programs, however caused.

I understand that Etoile, Inc. may take pictures and/or video of my child(ren) participating in Programs. Unless I notify Etoile Dance + Yoga Studio by email to the contrary, Etoile may use my child(ren)'s photographs, images and/or likeness for any print or web advertising or other promotional purposes. I authorize the reproduction, sale, copyright, exhibit, broadcast, electronic storage and/or distribution of said photos, videos and sound recordings without limitation at the discretion of Etoile Dance + Yoga Studio. I specifically waive any right to any compensation I may have for any such use or publication. I hereby release Releasees from any and all liability from such use and publication.

I understand that Etoile, Inc. has rules and policies set in place to provide a safe and kid-friendly atmosphere. In registering for, and participating in, the Programs and services provided by Etoile, Inc., I understand that my child(ren) and I must adhere to and follow any rules and policies as well as terms and conditions set forth by Etoile, Inc. At the discretion of the owners, management and/or staff, Etoile, Inc. reserves the right to deny service to anyone.

I understand that the information provided on this form and/or in the online registration process will be maintained in an online account for our access to future Etoile Dance + Yoga Studio Programs. Personal information will be shared with third parties only in accordance with the policies as listed at www.etoiledanceyoga.com.

I understand that Etoile Dance + Yoga Studio may inform me about future programs, events and specials via email, phone, etc. and that I will then have the opportunity to opt-out of each method of communication, if I so choose.

Policies, rules and terms of service are available online at www.etoiledanceyoga.com and are subject to change with or without notice.

This waiver shall be governed by the laws of the Commonwealth of Massachusetts. I expressly agree that the foregoing terms are intended to be as broad and inclusive as permitted by Massachusetts and that if any portion hereof is held invalid, it is agreed that invalid provision shall be deemed modified to provide the broadest permissible scope of protection for Etoile Dance + Yoga Studio and that the remaining provisions shall notwithstanding continue in full force and legal effect.

I am over the age of eighteen (18) and, if applicable, am the parent or guardian of the minor child identified below. I have carefully read this Waiver and fully understand its content. I am aware this is a full release of liability and contract between myself and/or my minor child and Etoile Dance + Yoga Studio and I sign it of my own free will.

If I am under the age of eighteen, I have read, understood, and discussed with my parent or guardian identified below, and we hereby accept the terms and conditions stated in this Participation Authorization Agreement/Waiver.

I hereby irrevocably consent to and authorize the reproduction, publication, and/or any other use by Etoile Dance + Yoga Studio and grant permission to the rights of my childs image, likeness, and the sound of his/her voice as recorded on audio- or videotape without payment or any other consideration. I understand that my childs image may be edited, copied, exhibited, published, or distributed and I waive the right to inspect or approve the finished product wherein my childs likeness appears. Additionally, I waive any right to royalties or other compensation arising from or related to the use of my childs image or recording. I also understand that this material may be used for any lawful purpose, including illustration, promotion, advertising, web content, and television.

By signing this release I understand that this permission signifies that photographic or video recordings of my child may be electronically displayed via the Internet or in a public setting.

There is no time limit on the validity of this release, nor is there any geographic limitations on where these materials may be distributed.

This release applies to photographic, audio, or video recordings collected as part of my childs classes, rehearsals, or performances for Etoile Dance + Yoga Studio.

By signing this form I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.
