TERMS, CONDITIONS and ASSUMPTION OF RISK and WAIVER of LIABILITY February, 2024
In checking that you agree to the terms and conditions, you are agreeing to the following:
LIABILITY RELEASE
I hereby release, discharge, and covenant not to sue the Dance It Forward d/b/a Greater York Dance (DIF), its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the "RELEASEES" herein) from all liability, claims, demands, losses, or damages, on my account caused or alleged to be caused in whole or in party by the negligence of the "releasees" or otherwise, including negligent rescue operation and future agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes claim against any of the Releasees, I will indemnify, save, and hold harmless each of the Releases from any loss, liability, damage, or cost, which any may incur as the result of such claim.
I release DIF and agree that I am aware that dance training at DIF and the athletic exercises associated with it may place unusual stress on the body and carry the risk of physical injury that include but are not limited to muscle strains and tears, broken bones, or even death. On behalf of my child and myself (and if I am no longer a minor, on my own behalf), I assume the risk and in consideration of the benefits derived from DIF, I waive all costs, liabilities, expenses or judgments, including attorney fees and court costs that may arise. I waive all rights, causes of actions, release any claims from the student while participating in said activity or while in the act of being transported to and from said activity including any and all consequential damage claims which I may be entitled to recover from said injury or property damage claim without regard to the negligence of the parties.
ILLNESS
I acknowledge the contagious nature of pandemics/various illnesses and voluntarily assume the risk and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed at DIF may result from the actions, omissions, or negligence of myself and others, including, but not limited to, DIF employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for such to my child(ren) or myself I hereby release, covenant not to sue, discharge, and hold harmless DIF, its employees, agents, and representatives, of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.
HANDS ON APPROACH TO TEACHING
I understand that faculty and staff use a hands on approach and from time to time a student may be touched in order to physically place the body for reasons of learning, understanding and feeling positions and movements related to dance technique. The art requires movement across the floor, close interactions with other dancers and possible faculty corrections which may include physical touch. If a dancer runs around or needs more direction, staff may lead them with hands on their shoulders or by holding their hand to a better place in which to participate. DIF faculty or staff is not responsible for injury as the result of physically correcting, placing or moving a student. There is never an intent to harm per our Child Protection Policy. Our sole intent is proper dance education.
HEALTH INSURANCE & AUTHORIZATION OF TREATMENT
I agree to provide health insurance for each enrolled student or guarantee payment of all medical expenses incurred and transport to the healthcare facility. In the event I cannot be reached, I authorize treatment.
TUITION
Tuition is divided into 11 equal monthly installments (due the 1st of each month, August 1 to June 1). Please note: We do not send invoices of any kind except when a payment is past due and all accounts are on autopay.
Your first monthly installment will include tuition and Annual Membership. Credit Card or ACH (your checking account) is REQUIRED as each account will be on AutoPay and processed automatically the 1st of each month (August to June). If your method of payment on file is declined, a late payment fee of $15 will be added to your account on the 15th of the month. Returned Check Fee – $25
WITHDRAWAL/DISMISSAL/REFUND
Enrollment continues for the season from August to June. Nonattendance does not constitute withdrawal from our program. All requests for Early Withdrawal must be submitted 15 days in advance in writing sending an email to CS@danceitforward.org. If paid more than one month in advance, a 75% refund less a $45 admin. fee will be returned with withdrawal notification. No refunds are available for Summer Sessions, Performance Dues, Tickets, or Awards. If discontinued prior to the performance, costumes/use of costumes are forfeited. Whether attending or not, tuition will be charged until the end of the month that the office has been notified in writing of withdrawal. Any scholarships or discounts (if applicable) will be relinquished if the student withdraws or is dismissed before the completion of the course or season. If classes go virtual for pandemic or similar reasons, tuition remains the same.
USE OF IMAGES/PHOTOGRAPHY
By enrolling, you are authorizing us to use any still and/or moving image including, but not limited to, video footage, photographs and/or audio footage, or Zoom recordings of the student(s), which may be used for online or printed advertisements, marketing, flyers, programs, social media and other purposes. The video recording of classes by parents or students is prohibited without written permission from the director. This is in protection of the students.
INJURY-ACCIDENTS
In the event that a child or youth is injured while under our care, the following steps should be
followed:
For minor injuries, scrapes, and bruises, we will provide First Aid (Band-Aids, etc.) as appropriate.
For injuries requiring medical treatment beyond simple First Aid, the parent will immediately be summoned. If warranted by circumstances, an ambulance will be called.
Once the child has received appropriate medical attention, an incident report will be completed.
If a child joins a class, production or activity with an obvious physical injury, a record of this will be made. Parents are required to provide this information in writing upon arrival prior to taking a class. This record will ascertain that the child did not sustain the injury while participating in our programs.
PRIVACY POLICY
The privacy of your personal information is very important to us. We will not sell, rent or trade your personal information to any third party.
NON-DISCRIMINATION POLICY
DIF is open to everyone regardless of age, gender, color, religion, and national or ethnic origin or status. We value diversity and do not discriminate. The full non-discrimination statement is on our website.
DISMISSAL/REFUSAL OF SERVICES
A student may be dismissed for negative attitude of self or parents and overall non-compliance to regulations, especially those stated under Dance Etiquette on our website. Greater York Dance may refuse services to students who have delinquent accounts or whose attitudes are perceived as negative or insubordinate.
ACCEPTANCE OF POLICIES
I accept and agree to all policies that are listed on the website - gydance.org. In addition, we try to include as many of our policies as possible, there are some that may appear on our website, be written in handouts, bulletin board, DSP student portal or verbal.
