The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. COVID-19 is present in every state in the United States, including Texas. Information on the exact methods of spread and contraction are still evolving, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death. I acknowledge the contagious nature of COVID-19 and that many public health authorities still recommend practicing social distancing and a face covering.
I acknowledge that the TMJ School of Dance has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19, including social distancing where possible, increased sanitation efforts, use of face masks and the attestation by attendees that they are not experiencing any COVID-19 related symptoms (see below). I also understand that TMJ School of Dance cannot guarantee I or my child/children will not become infected with COVID-19, and that social distancing may always not be possible when attending events. I further understand that the risk of becoming exposed to and/or infected by COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to TMJ School of Dance representatives, other student artists and their families.
I agree to comply with all TMJ School of Dance procedures, policies, rules, instructions, and signage to reduce the spread of COVID-19 while attending all events.
I represent and attest that:
If I am experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell, I will not attend TMJ School of Dance classes and/or events.
I will not travel internationally 14 days prior to attending any TMJ School of Dance class or event.
I will not travel to a highly impacted area within the United States of America 14 days prior to attending any TMJ School of Dance class or event.
I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
If I have been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities, I will not attend TMJ School of Dance classes or events
I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
TMJ School of Dance cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending TMJ School of Dance classes and/or events. It is not possible to prevent against the presence of the virus. Therefore, if you choose to attend TMJ School of Dance classes and/or events, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.
ASSUMPTION OF RISK: I HAVE READ AND UNDERSTOOD THE ABOVE WARNING CONCERNING COVID-19. I HEREBY CHOOSE TO VOLUNTARILY ACCEPT THE RISK OF CONTRACTING COVID-19 FOR MY CHILD AND I IN ORDER TO ATTEND TMJ SCHOOL OF DANCE CLASSES AND EVENTS. THE EVENTS ARE OF SUCH VALUE TO ME THAT I ACCEPT THE RISK OF BEING EXPOSED TO, CONTRACTING, AND/OR SPREADING COVID-19 IN ORDER TO ATTEND THE EVENTS IN PERSON.
WAIVER OF LAWSUIT/LIABILITY: I AGREE THAT, IN EXCHANGE FOR THE CONSIDERATION RECEIVED, AND ON BEHALF OF ANY AND ALL OF MY REPRESENTATIVES, HEIRS, ASSIGNS, AND/OR NEXT OF KIN, I HEREBY RELEASE, WAIVE, AND DISCHARGE TERRANCE M. JOHNSON DANCE PROJECT, TMJ SCHOOL OF DANCE, AS WELL AS THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, VOLUNTEERS, SUBSIDIARIES, AND/OR AFFILIATES FROM ALL LIABILITY, LOSS, OR DAMAGE, AS WELL AS ANY CLAIM OR DEMANDS ON ACCOUNT OF ANY PROPERTY DAMAGE, OR ANY PERSON INJURY TO ME, INCLUDING BUT NOT LIMITED TO ILLNESS OR DEATH, WHETHER CAUSED BY THE NEGLIGENCE, ACTIVE OR PASSIVE, OF TMJ SCHOOL OF DANCE, ITS AFFILIATES, ITS EMPLOYEES OR AGENTS. LIKEWISE, I AGREE TO INDEMNIFY, SAVE, AND HOLD HARMLESS TERRANCE M. JOHNSON DANCE PROJECT, TMJ SCHOOL OF DANCE, THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS AND AGENTS, AND EACH OF THEM, FROM ANY LOSS, LIABILITY, DAMAGES, OR COSTS, INCLUDING ATTORNEY’S FEES, THEY MAY INCUR RESULTING FROM ANY DAMAGE, LOSS, OR INJURY I EXPERIENCE, OR EXPERIENCED BY ANY THIRD PARTY TO THIS AGREEMENT THAT I COME INTO CONTACT WITH AFTER THE EXECUTION OF THIS AGREEMENT, THAT IS RELATED TO COVID-19 AND ARISES FROM MY ENGAGEMENT WITH TMJ SCHOOL OF DANCE BY THE NEGLIGENCE, ACTIVE OR PASSIVE, OF TMJ SCHOOL OF DANCE, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS AND/OR AGENTS.
I also agree that, if any term or provision of this agreement is to any extent invalid, illegal, or incapable of being enforced, that term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms shall remain in full force and effect.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS RELEASE, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS CONCERNING LIABILITY AS DESCRIBED ABOVE:
