Indemnification and Hold Harmless Agreement
Agreement made this day, between Kathy Costa-Mckeown and DanceWorks Studios, (collectively referred to as "Instructor") and the parents or parent of the student.
Instructor is in the business of providing dance and other instruction to students who pay Instructor for the services pursuant to a contractual arrangement.
Instructor will be performing dance and performance instruction on Student’s behalf to Student at Instructor’s studio located at 127 Grove Street, Montclair, New Jersey (hereinafter referred to as the “Premisesâ€).
Instructor intends to conduct the dance and performance instruction to Student on the Premises during the COVID-19 Pandemic. Student acknowledges that Student will be enrolled in a class or classes with other individuals during the Pandemic. Instructor will follow all COVID-19 protocol to attempt to prevent the transmission of COVID-19 between students, and between Student and Instructor’s staff. Student acknowledges that Student might come in contact or proximity with other students or with a staff member or members during a class or while on the Premises and that any such contact might enhance the possibility of COVID-19 transmission.
Student hereby releases Instructor from liability, and indemnifies and holds Instructor harmless should Student contract COVID-19 during or after Student’s enrollment in a class or classes conducted by Instructor, caused in any manner from Student’s participation in any program offered by Instructor, or arising from Student’s presence on the Premises.
The promises, release, indemnification, representation and conditions contained herein are binding on _____________, his or her heirs, his or hers minor children, executors and assigns and shall extend to Instructor, Instructor’s staff, and all of its assignees, it being the intention of the parties that the hold harmless be a blanket hold harmless to cover all acts and all parties, corporately and individually
