Waiver and Release
CHADWICK STUDIOS (“the Studios’”) takes all reasonable care in conducting classes, rehearsals and event performances.
1. EXPRESS ACCEPTANCE OF RISK
In consideration of participating in the Studios’ programs (as an enrolled Student or Participant named on this form, and the parent/legal guardians of the Student are hereby referred to as “I”/“me”), I acknowledge and agree as follows:
a. I confirm that the answers I have provided (in enrolling as a Student at the Studios) are true and correct, and I understand that the Studios has relied on those answers in accepting my enrolment as a Student and allowing me to participate in the activities.
b. I confirm that the answers I have provided (in the alternative of registering as a Participant), are true and correct and understand that the Studios has relied on those answers in accepting my registration and allowing me to participate in the Activities.
c. that my participation in dance classes, training and performance (“the activities”) at the Studios, and at event locations decided upon by the Studios, is done so at my own risk. I acknowledge and agree that I understand the nature of those activities, and I confirm that any pre-existing injuries or medical issues will be disclosed to a staff member or the instructor prior to any participation in today’s activities.
d. that I am engaging in the activities for my own personal goals including, physical fitness and strength, skills building, personal development and performance techniques, and that understand fully that the activities involve a degree of risk of physical harm.
e. that in my understanding the activities could involve risk of harm to myself, and I accept that this could include serious bodily injury, which could also result in permanent disability, paralysis and/or death, and that this may be caused by my own actions/inactions, those of others participating in studio activities, the conditions in which the activities take place, or the negligence of another person/s.
f. that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such injuries that I may suffer to my person, and all responsibility for losses, costs, and damages that I may incur as a result of my participation in the activities.
2. RULES OF ACCEPTABLE BEHAVIOUR
I acknowledge and agree that;
a. I will not engage in reckless, negligent or foolish behaviour or any other behaviour that is reasonably likely to cause injury to me, any other student, participant, the Studios, or any other person whatsoever.
a. I agree to abide by the Rules at all times while I am at the Studios, and participating in the activities.
b. I acknowledge that my inability or refusal to abide by the Rules may result in the Studios not allowing me to participate in the activities.
c. I agree to follow the directives of the Studios at all times.
d. I acknowledge that the Studios may restrict my participation in the activities if the Studios deems I am acting in an unacceptable manner.
e. I agree that if I am injured or observe any other participant to be injured, I shall immediately notify the Studios of the incident.
3. RELEASE & WAIVER FROM ANY CLAIM FOR INJURY OR LOSS
a. I unconditionally release, waiver, discharge and forever hold harmless, the Studios from all claims for any loss sustained by me, whether caused by an act or omission through a breach of contract, breach of statutory duty, error or otherwise in connection with the activities and the Studios.
b. If the Studios is found liable to compensate me for any reason, I agree that such liability is limited to the cost of the activities provided to the Participant only
c. I agree that this document may be submitted as a bar to any proceedings undertaken by me arising out of or as a consequence of the activities
d. I agree to indemnify and keep indemnified, the Studios, from all claims that may be made as a result of or in connection with any act, omission, default, failure or error on the part of the Studios (including any negligent act, omission, default, failure or error) occurring wholly or partially during the course of the activities.
4. PARENT/GUARDIAN UNDERTAKING
By continuing to the completion of this document,
a. I confirm that I am at least eighteen (18) years of age and that the information that I have entered and is contained in the form is true and correct, and I undertake the terms of this waiver, release and indemnity, or
b. where any enrolment or registration with the Studios is completed by the parent or guardian of a minor (being a person under the age of eighteen 18 years), the parent/guardian confirms that the information entered and contained in the form is true and correct, and personally undertakes the terms of this waiver, release and indemnity.
5. FILM, IMAGE AND RECORDINGS STATEMENT
Having regard to all operational aspects of the Studios, and only applicable to the Studios,
a. I consent to the use, publication, storage and/or reproduction of the film, images and recordings in any form (in whole or in part) and by any medium, including but not limited to newspapers, magazines, brochures, television advertisements, promotional videos, websites, CD-ROM or other multi-media, for public relations, promotions, commercial and advertising purposes (Promotional Materials) by the Studios, and
b. I agree that this clause applies to Chadwick Studios, and any controlling or managing entity of the Studios at any time.
c. I agree that in reference to paragraph a. & b. above, I will not receive nor require any payment, royalty, nor any other consideration for inclusion in any film, image or recording at any time; now, or in the future.
6. TERMS AND CONDITIONS OF THE 7-DAY UNLIMITED CLASS PASS
The 7-Day Unlimited Class Pass (“Pass”) is a promotional product designed to introduce potential new clients (“Participant”) to the Studios. The following are the terms and conditions to being granted a Pass by the Studios. The Pass;
a. is restricted to one only continuous period of 7 days ("7-Day Period”).
b. is restricted to one Pass per Participant.
c. are permitted to commence on a date elected by the Participant, provided that the 7-Day Period is within the Studios’ normal programming schedules.
d. are only permitted to be applied to programs which are age-appropriate to the Participant.
e. are only permitted to be applied to programs which are conducted during the elected 7-Day Period.
f. the programs at paragraphs c. d. & e. above are regulated solely by the Director of the Studios.

7. TERMS AND CONDITIONS OF CHADWICK STUDIOS’ INVOICE PAYMENTS (PAYMENT PLAN - AUTO-PAY)
Fees and charges, and invoice payments;
a. an enrolment fee, separate from term fees is charged in advance for student insurance and administration, and this is renewed annually each January. c. term fees <a href='https://s3.amazonaws.com/dspstudiocloud/618b51e5d3422.pdf'>Click here to view </a> are non-refundable for;
i) non-attendance
ii) missed classes
iii) for any decision by the student/parent/guardian to discontinue classes completely mid-term
d. all invoices are payable in advance through the Chadwick Studios’ preferred online payment system (please note that NO cash is held on the premises).
e. in order to make regular payments of the Studios’ invoiced fees & charges
