Release & Indemnification: I hereby, recognize and acknowledge my child's participation in dance class may involve bodily injury and/or emotional injury to myself and/or my child. In consideration of my child being able to participate in such events, I, for myself, my child, my heirs, my executors and administrators, hereby voluntarily and knowingly indemnify and hold harmless, defend, release, waive, and discharge Ashlee Maxwell, Maxwell Dance Studio, A&A Maxwell, from any and all suits, claims or liability, including negligence, based on any injury except that caused solely by the willful misconduct of Ashlee Maxwell, that may result from my child's participation in this dance class. In addition, I agree that I or my insurance company will pay for medical, hospitalization or any other expenses resulting from my child's participation.
2. Payment: Once you receive confirmation of your enrollment payment must be made within 3 business days to hold your spot. Invoices are only sent upon monthly requests. Late fee of $25 is applied on the 1st if account has any balance.
3. Refund Policy: Tuition and costume fees are non-refundable and non-transferrable after the week prior to class starting. Costumes will not be released until the family has a balance of $0. Credit for missed classes, in the form of monetary value, or make up classes, will NOT be offered.
4. Emergency Treatment: I hereby authorize Ashlee Maxwell to act on my behalf in accordance with their best judgment in case of an emergency involving my child, and agree to assume full responsibility for all expenses, medical or otherwise, that may arise there from. I understand that I or my insurance company will pay for such emergency treatment.
5.Payment in full is due within sixty (60) days from the date of service. If payment in full is not made as required, then in addition to all other amounts that may be due I agree to pay a collection fee of up to 40% of the principal amount as provided by §12-1-11 of the Utah Code Annotated, and further agree to pay all other costs of collection (whether incurred by Maxwell Dance Studio or its assigns) including but not limited to court costs, reasonable attorney fees, and interest (both pre-and post-judgment). Any interest due hereunder shall be calculated at a rate equal to 18% per annum and may, as determined by Maxwell Dance Studio or its assigns: (a) accrue on some or all amounts due and (b) compound as frequently as daily--meaning that accruing interest may be added to the balance owing as frequently as daily such that it shall thereafter constitute part of the amount upon which interest accrues during the next accrual period.
6. Should another pandemic sweep our area, MDS will continue holding classes via whatever method we deem safe. All payments and due dates will continue. We reserve the right to postpone or modify recital dates or organization, but will not cancel the recital all together. In turn Recital Payment Plan will remain non refundable.
