Assumption of the Risk and Waiver of Liability

Parent/Guardian Legal Disclaimer:
I (the enrolling Parent/Guardian/Other) represent to Rejoice Dance Studio that I have the full and complete legal authority to register the child, that Rejoice Dance Studio is entitled to rely on such representation in good faith, and that the registrant will indemnify, defend, and hold Rejoice Dance Studio harmless from any claims or expenses in the event the registrant had no such authority.

Release of Liability:
As the legal parent or guardian, I agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren), other related family members, other invited guests, or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I, my children, or those who I have invited to RDS events may experience or incur in connection with my child(ren)s participation and or attendance at RDS events. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless RDS, its employees, agents, and representatives, including RDS event-related facility employees and their workplace of and from any claims, including all liabilities, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of RDS, its employees, agents, representatives, and RDS event-related facility employees. I certify that I am the parent or legal guardian and have the right to waive these rights.

Photography/Video Release:
I understand and release to Rejoice Dance Studio Dance Studio the irrevocable and unrestricted right to use, reproduce, and publish photographs and/or videos of my child for editorial, trade, advertising, or any other purpose or manner and medium. I hereby release Rejoice Dance Studio Dance Studio and its owner, administrative staff, and instructors from any and all claims, actions, and liability relating to its use of said photographs. Any exception/objection must be submitted via email to contact@rejoicedancestudio.com prior to the start of each season so we can proactively prevent photos/videos from being taken of your child.


Weather Closing Policy:
In the event of inclement weather and/or poor road conditions, classes may be canceled for the safety of our students. Rejoice Dance Studio Dance Studio will make our own independent decisions regarding weather closings. If the decision to cancel classes is made, we will send out an email and text message to let families know a minimum of 60 minutes prior to the start of classes for the day. You can also visit the website or check social media to receive weather updates. As weather-related closings are outside of the control of Rejoice Dance Studio Dance Studio, we do not credit, refund, or prorate tuition for classes canceled due to inclement weather.

I grant permission to the staff of Rejoice Dance Studio, LLC to take first aid or emergency measures as judged necessary for the care and protection of my child while under the supervision of the studio. In case of a medical emergency, I understand that my child will be transported to an appropriate medical facility by the local emergency unit for treatment if the emergency unit deems it necessary. I also understand and agree that the child's parents or legal guardians shall be responsible for any expenses incurred.

By participating in the Rejoice Dance Studio Recital, I agree to the below terms and conditions:

- I understand that the date for Recital 2025 is tentatively set for May 23 & 24, 2025. If this date changes due to theatre availability, I will be notified promptly via email.
- I understand that recital fees ($75) and costume fees ($75 per costume) are non-refundable. I will be charged for the recital fee on December 1, 2024, and the costume fee(s) on January 1, 2025 unless I notify Rejoice Dance Studio (RDS) in writing by November 30, 2024 that my child will not participate in recital.
- I understand regular class attendance is extremely important. Excessive absences or lateness to class will impede students' progress and could jeopardize their participation in the Recital.
- I understand that costumes might not fit my child perfectly and that I am responsible for making any appropriate alterations if needed, prior to the performance.
- I understand that tuition and fees must be current and not late in order for my child to perform.
- I understand it is my responsibility to check my e-mail for recital schedules and updates.
I authorize and agree that RDS may take and use photographs and videos of me and/or my child for purposes of record keeping, advertising, and marketing. I understand that I do not have any rights to these photographs and videos and will not be compensated for them.
- Should any unnatural or natural event occur that prevents us from holding our Recital on the scheduled dates, it will be postponed until a later date.
