1. Our agreement with you
As a customer of Dance Avenue Mackay these terms and conditions form the basis of your agreement with Dance Avenue Mackay. Dance Avenue Mackay’s agreement with you also include your registration form, which you complete and provide to Dance Avenue Mackay. I agree to adhere to Dance Avenue Mackay policies and procedures.
2. Costs, Refunds, Payments
The yearly registration fee is to be paid by the due date and is non-refundable. Fees will be paid by the due date of each term and are non-refundable. If you require a Payment Plan, please contact dance@danceavenuemackay.com.au. The late rate in the fee schedule will be added to all accounts as per our late fee policy. These fees are applied every fourteen days on outstanding balances.
Students are invited to participate in exams, eisteddfods, performance teams and annual concerts all of which will incur additional charges including but not limited to, exam fees, performance uniform purchase, extra rehearsal and eisteddfod cost fees, costume purchase, concert ticket purchase, DVD purchase, photograph purchase. The Studio provides plenty of information to enable you to make an informed decision as to whether to participate.
Dance Avenue Mackay reserves the right to cancel or change the timetable and price structure at any point in time. No refunds, discounts or credits are given for missed classes for any reason. Dance Avenue Mackay reserves the right to suspend or cancel an enrolment at any time should any fees/invoices/costumes not be paid, and the matter referred to a Debit Collector at your expense.
3. Studio and Class Procedures/Safety
All students are to wear the full Dance Avenue Mackay uniform to ensure they are appropriately dressed and to feel a part of the DA Team. All jewellery is to be removed to ensure safety for themselves and other students. A decent sized water bottle is to be brought to every class. No hot food or drinks (other than water) are to be consumed in the studio. Please take all other rubbish with you when you leave the studio.
All parents are to use street parking until Bridgestone Mackay (downstairs) is closed (5pm weekdays) anytime the roller door is up street parking must be used on either Victoria or Peel Street. There is ample street parking available.
Remember the responsibility lies with you as parents/guardians to deliver your students safely into the studio.
To ensure the safety of all students we ask parents/guardians of younger students to ensure that where possible they arrive 5 minutes prior to the class end time to pick up their child. Parents are responsible for safety prior to class and after class time. Please try to be punctual on arrival and ensure your child is collected strictly on time.
No student, parent, sibling, friend is to enter a classroom without a teacher for safety reasons. Students are asked not to leave the building without an adult at any time. The studio waiting area is a quiet zone where students may wait in between classes but it is expected that they are quiet and behaving as teachers will be on site but will be actively engaged in teaching classes, therefore not always supervising children in the waiting area. The waiting area is strictly for students only due to space. Parents/Siblings/Friends etc are to wait downstairs (this excludes DA Tots Parents).
If you are running late to pick your child up please notify the Studio Director prior to the end of their class so that we can arrange suitable supervision until you arrive. If at any time this becomes an ongoing issue a *fee will be charged to cover teacher’s wages to provide adequate supervision for your child. *(based on time required and teacher’s hourly rates)
Dance Avenue Mackay requests that small children (Baby/Tiny/Kindy Tots) are taken to the toilet before their class commences to avoid disruption during class - If any accidents occur, we ask that you please help the teacher by cleaning up so the lesson can continue as quickly as possible.
For Dance Avenue Mackay to maintain a positive teaching environment, classes during term are closed to all visitors. Information on viewing/watching days will be emailed to classes involved (pending Covid restrictions) Baby Tot parents are the only parents invited to stay in the classroom for lessons from Term 1 to 3.
For Viewing/Observation Days, mobile phones are to be switched off and there is to be no photo or video recording without teacher permission. All Videoing recording, photography and social media uploading (such as Tik Tok) is strictly not allowed by any student or parent whilst in the studio, classrooms, waiting area, bathroom/change area of any students/teachers/parents/choreography without permission of Dance Avenue Mackay. If videoing or photography is permitted in the classroom, please DO NOT place these on social media sites such as YouTube, Facebook, Instagram etc due to copyright.
Smoking in or around the studio is strictly prohibited.
4. Damage/Loss - property and belongings
Parents/Guardians are liable for any damage to the studio or studio contents caused by their children. Dance Avenue Mackay takes no responsibility for any damage or loss of items brought into the studio.
5. Communications
Dance Avenue Mackay will communicate with you primarily by email and will not provide your details to any other company, entity or organisation unless consented to by you and all other information will be kept by the studio in accordance with the Privacy Act. Dance Avenue Mackay will use its best endeavours to ensure that all communications are virus free, however, Dance Avenue Mackay is not responsible for any loss of damage suffered by you in the event that a virus or like issue is transmitted unknowingly by Dance Avenue Mackay.
If your child is going to be away from dance classes or being picked up by another person, please message the studio phone – 0437 323 687 to inform us.
6. Social Media
Dance Avenue Mackay is aware that social media provide opportunities for us to communicate, engage, connect, and develop unique relationships with people in a creative and dynamic medium where users are active participants. Information about classes, performances or events can be dissipated virally amongst supporters within online communities. Social media refers to the latest generation of interactive online services such as Facebook, Instagram, TikTok, Snapchat and instant messaging. This list is not exhaustive and will include future developments in social media. It is important for Dance Avenue Mackay to consider the use of social media and to balance the benefits of creativity, spontaneity, and immediacy of communication with the potential risks, including the risks to children, young people, and vulnerable adults.
If you and/or your children have Social Media and you would like to be connected with your child’s teachers you will need to give your consent for your children to interact with us, utilising social media. This will in no way obligate our teaching staff to accept ‘friend’ and other message and connection requests. This is also detailed in the studio social media policy.
Always remain mindful that your behaviour on social media should be in keeping with Dance Avenue Mackay’s expectations about standards of behaviour as detailed below.
Any comments or posts perceived to be obscene, defamatory, threatening, harassing, discriminatory or hateful towards Dance Avenue Mackay staff, students or families may subject the owner to disciplinary or legal action.
Intellectual property laws (for example, costume design and choreography), must be observed by all studio patrons when posting online. This includes but not limited to manuals, forms, handbooks, and syllabus, etc.


While affiliated with our studio, (for example, images of your child in Dance Avenue Mackay uniform) we will not tolerate any posts that are racially, sexually, physically or religiously offensive.
All matters pertaining directly to the studio – whether it be fees, scheduling, or performance opportunities – may not be communicated via open Social Media. We have an open-door policy and encourage all communication, complaints, and feedback to be communicated to the directly as per clause 7 below.
Should you wish to engage on Social Media while identifying as a studio dancer, parent, guardian you may only do so with integrity, respect, and adhere to privacy and confidentiality. Any content revealing or referring to sensitive studio information is not allowed to be shared online.
7. Teacher Consultations/Grievances
We understand that you may have questions from time to time regarding your child’s class, their progress or other issues. To ensure that teachers are not delayed between classes, we encourage you to contact us via email at dance@danceavenuemackay.com.au to schedule a phone call/appointment with the relevant teacher and/or Director.
We are committed to continual improvement in all areas of the Dance Studio. As we are only able to address issues that have been brought to our attention, we welcome your feedback (positive or constructive). As part of our commitment, we will endeavour to work towards a positive outcome for all parties in the event of any issues.
*Note: If you have an issue that cannot be resolved by your child’s teacher, we ask that you contact our Studio Director, Demi Reck on 0437 323 687 to discuss.
8. Behaviour and Expectations
All students and parents are expected to be kind, friendly and respectful of one another, both in and out of the studio and at studio events. Dance Avenue Mackay has the right to suspend or terminate an enrolment should behaviour not be of standard from any parent or student. Inappropriate behaviour can be in person/text message/social media and includes but is not limited to yelling, swearing, lying, constant complaining, bad sportsmanship, gossiping, walking out, disruptive/unsafe behaviour or continually not wanting to participate and disrupting the learning of others.
Dance Avenue Mackay has zero tolerance for this type of behaviour when it is continual and of a repetitive nature. The Dance Avenue Studio is a safe place.
We co-share a building environment with Bridgestone Mackay and will always strive to be good neighbours. This means applying the same standards of behaviour we hold ourselves accountable to at Dance Avenue Mackay to our interactions with our neighbour’s downstairs at Bridgestone.
It is expected that all students are working hard and are on their best behaviour in class and at all studio events. Dance Avenue Mackay wants everyone’s experience to be positive, happy, and fun throughout the year. We ask that you encourage and support your child and the studio in making this happen. Our school is based on loyalty and support. We believe that an environment that fosters encouragement and support will produce high performance and happy performers. Teachers and parents are here for one reason and that is the children. Together as a collective of teachers, students, and parents we are a TEAM and a DANCE FAMILY. Dance Avenue Mackay has in place a ZERO TOLERANCE bullying policy.
9. Working with Children
All staff at Dance Avenue Mackay take the safety of your child very seriously and we have all undergone the Government working with children check and hold current blue cards. We will endeavour to ensure the highest safety standards are always adhered to. Dance Avenue Mackay takes no responsibility for students or their siblings whilst outside of the studio.
All staff hold a First Aid Certificate.
10. Online Participation
If, for any reason, Dance Avenue Mackay are unable to provide lessons in person (including, but not limited to, disaster events, damage to the studio or government regulation) same will be delivered online, via Zoom. In such circumstances, all Dance Avenue Mackay policies will apply (including the uniform policy). There will be no refunds available should online lessons become necessary.
11. Choreography
All choreography including solos, remains the intellectual property of Dance Avenue Mackay and may not be used elsewhere without the permission from the Director. The solo fee paid entitles the student to perform that solo for a period to be mutually agreed upon with the teacher/choreographer. In other words, you are paying for the right to perform that solo, you are not actually purchasing the solo. This also applies to Guest Choreography.
12. External Classes
To ensure your child receives the maximum benefit from our program, no student whilst registered with Dance Avenue Mackay will be permitted to attend private lessons or class tuition with any other dance studio or similar establishment without prior discussion/consent from the Director (Demi Reck).
13. Limit of Liability
Dance Avenue Mackay do not exclude or limit –
(a) The application of any provision of any statute (including the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of this clause 13 to be void.
(b) All care will be taken by teachers of Dance Avenue Mackay, but no responsibility for injury or loss to person or property howsoever caused and without limiting the generality of the afore going damage or injury resulting from or caused by any negligence of the owner, principal, teachers, instructors or other employees of the said Dance Avenue Mackay.
14. Consent
Your child’s enrolment in Dance Avenue Mackay is voluntary and participation in class and activities involved in Dance, Dance Blast/Acro, TECHnique, Music Theatre can involve risk of personal injury, including but not limited to muscle strains, sprain and falls and you freely assume these risks for your child as outlined in clause 15. The participant will immediately fully inform each teacher of any physical difficulties or injuries that occur before or during class. Where the participant may require medical assistance, Dance Avenue Mackay has permission to seek First Aid or Medical attention as per your enrolment consent. Where a parent, guardian or carer requires that First Aid or Medical attention be provided in the event of an accident/injury whilst involved in Dance Avenue activities, Dance Avenue Mackay has permission to seek attention as required as per the enrolment form.
Teachers and Students may have to assist your child’s understanding of an action, posture, position, support or to form sequences by physical contact e.g., holding hands in a circle; lifting; correcting posture. You consent to teachers and students of Dance Avenue Mackay having contact with your child in this regard. You consent for yourself/child to be photographed or videographed while at the studio or studio events for social media, advertising, online marketing, promotions, learning purposes or publicity by Dance Avenue Mackay and anyone associated with the school i.e. - Concert/Eisteddfod video/photos etc.
15. Indemnity and Release
By enrolling with Dance Avenue Mackay, and accepting these terms and conditions you:
(a) acknowledge that there are certain risks and hazards involved in dancing that may result in injury, including but not limited to studio conditions, equipment and other students.
(b) agree to indemnify and release Dance Avenue Mackay, its officers, agents, employees or any person connected with Dance Avenue Mackay from any and all claims, loss, damage or injury that may arise, whether now or in the future, including where said claim, loss, damage or injury was caused by the negligence of the owner, director, teachers, instructors or other employees of the said Dance Avenue Mackay.
By ticking the box and signing the enrolment form you accept our terms and conditions including release of liability of Dance Avenue Mackay and its teachers, assistant teachers and staff.
