Release Form for In Motion Academy
Please read carefully. This document affects your legal rights and is legally binding. By signing this agreement, you are releasing In Motion Academy, LLC from all liability and giving up any claims therefor.
Dance is a strenuous physical activity. You understand that such activities carry the risk of injury and that it is your responsibility to judge your physical and mental capabilities for such activities. You waive and release any claim that you may have at any time for injury of any kind arising out of your participation at In Motion Academy, LLC or the use of our facility. In Motion Academy, LLC is not a medical organization, and its instructors and staff cannot give you medical advice or diagnosis. Any comments or suggestions made by employees of In Motion Academy, LLC are only observations. All dancers should seek professional medical guidance when in need.
Assumption of Risk
I acknowledge and agree that any use of In Motion Academy, LLC facilities, services, and equipment comes with inherent risks that include, but are not limited to: (1) limited, moderate, or severe physical injury, (2) property damage, (3) disability, (4) sickness or disease. I accept and assume full responsibility for these risks, as well as any other risks of the use of facilities and participation in programs.
Waiver, Release, Indemnification & Covenants
In consideration of the use of our facilities and participation in programs, the undersigned agree that In Motion Academy, LLC, its officers, directors, agents, employees, and volunteers will not be liable for any personal injury, property damage, disability, or sickness.
I further agree, on behalf of myself and any and all legal successors, to release and hereby do release, waive, and covenant not to sue from any cause of action, claims, suits, liabilities, or demands of any nature whatsoever including, but in no way limited to, claims of negligence against Releasees on account of any kind arising out of or in any way related to the use of Facilities or participation in Programs.
In further consideration of the use of Facilities and participation in programs, I agree to indemnify and hold harmless Releasees from all causes of action, claims, demands, losses, suits, liabilities, or costs of any nature. This includes claims of negligence arising out of or in any way related to the use of Facilities and participation in Programs by myself, my family members, dependents, or guests, including any minors.
I acknowledge that I have read and understood each item:
1. I hereby authorize the employees of In Motion Academy, LLC to obtain medical treatment for my child if a parent/guardian and emergency contact cannot be reached.
2. Waiver and Release: I am fully aware and appreciate the physical risks associated with dance.
3. I further agree that In Motion Academy, LLC, along with the employees and directors of these organizations, shall not be held reliable for any losses or damages occurring as a result of my child’s participation unless resulting from intentional or reckless conduct of one of the employees or directors.
4. I understand that dance requires hands-on contact in the process of learning some new skills.
