Code of Conduct Acknowledgement

I will not be involved in any matter of disrespect towards any members of Academy of Gymnastics and Dance staff, parents, or students. This includes but not limited to texting, emails or any social media.

Anyone threatening to quit or pull their child from a squad or team may be dismissed from the program immediately.

I understand that all athletes/dancers are required to wear the appropriate practice attire to every practice.

I understand the importance of punctuality and will arrive at all scheduled events on time.

I will not participate in negative gossip or communications that adversely affect Academy of Gymnastics and Dance. This includes but is not limited to Facebook, Instagram, Snapchat Twitter, Chat Rooms, or other Websites. I will not use inappropriate language.

I will not post any Academy of Gymnastics and Dance music, choreography, routines, stunts, or practice videos etc. on any website. I will conduct myself with respect and integrity, displaying positive sportsmanship at all times during practice.

I understand all athletes/dancers at Academy of Gymnastics and Dance are expected to arrive at practices and competitions on time with a positive attitude and give their best effort in every endeavor.

I understand everyone is enrolled in our Studio must keep a credit card on file. All bills must be paid in full by the 15th of each month or if on average billing the amount averaged out over the year, or my card on file will be charged for the amount on my account. You must also leave a voided check at the Studio.

I understand that I must fill out a form at the front desk if my child is not planning to participate in recital. I understand that once costumes have been ordered, I will not receive a refund if I change my mind about recital participation.

I understand that the Staff may find it necessary for athletes/dancers to be moved from one team to another.

I understand that the parent viewing area should be a positive atmosphere, and I may be prohibited from using the parent viewing area if I cannot maintain a positive attitude while there.

I understand that it is my responsibility to keep track of my invoices. I understand that I am obligated to make my payments on time. If my billing email address changes, it is my responsibility to notify the Academy of Gymnastics and Dance front desk.

I understand this is a 12 month commitment I am making. I will honor my commitment.

I understand that if I quit or my child is removed from the program, I will not be entitled to a refund of any kind. This includes all competition fees paid, tuition, and other expenses.

I understand Attendance to all competitions, performances, and recital are mandatory. If your child has a conflict you must get written permission to miss competition, performances or recital 2 weeks prior from Director/Coach. If you are vomiting or running a fever competition day you must provide a doctor’s note for the competition day missed, otherwise you are expected to attend all competitions. Performances, and recitals.

By not allowing my athlete/dancer to attend practice(s), it hinders the development and progress of the performance/competition routines as wells as registered for competition.

Cheerleaders, Dancers, parents, relatives, and friends are never allowed to contact competition companies or their officials for any reason. Contact Academy of Gymnastics and Dance if you have questions or comments relating to competition companies or their officials.

I understand a doctor’s note is required for an athlete/dancer to sit out more than one practice. I understand that after my 2nd absence, my placement in the cheer routine/dance routine will change.

I understand that cell phones are not allowed at practice. At no time should a coach or teacher see or hear a cell phone.

I understand that regularly schedules practices will be as follows; Cheer Elite and Dance Elite practice 2 days a week all year and Ballet Company will practice two times a week during the summer and one time a week during the school year. This does not include extra practice that might be scheduled.

I understand that gymnastics is a part of Cheer Elite class and I am not required to take any additional gymnastics.

RECITAL INFORMATION

The Academy provides the opportunity to perform at an end of the year Recital. Recital is not mandatory, a child may participate in class and will not be discriminated against if they choose not perform in recital. Participation in recital includes additional cost outside of class tuition, and dance shoes. Additional expenses will be: costumes, $65-$80 each, tights, $7-$9 for child and $9-$11 for adult, up to two pairs may be needed. Pricing will depend on current supplier costs. Everyone that would like to come and watch recital must purchase a ticket, this includes parents and students. Tickets are $12.00 each. There are two additional rehearsals at the Auditorium on Wednesday and Thursday the week of recital. There is no cost for these practices.

ACADEMY OF GYMNASTICS AND DANCE

COSTUME AGREEMENT AND UNDERSTANDING

You, the parent/legal guardian of enrolled students, realize that all costume fees for the recital are due by December 15, 2022. If fees are not paid by this date, then you are aware that the costume(s) will not be ordered. You also realize that all costume money and fees are non- refundable and non-transferrable for any reason. If the costumes are ordered after this date, you realize that you are responsible for all fees incurred on late orders. You are also aware that after the order deadline, some costumes may not be available: this stems from the fact that costume suppliers make each costume when the orders are places. Receiving dates take at least three to four month once the order is placed. Once costumes are posted the first of December, there may be changes and/or cancellations of a certain costume due to availability from the company. The studio will then pick out another costume without notice to you. You understand that if you pay after the due date, there is no guarantee that costumes will be in for recital. If you drop from a class, please make sure to come by and pick up your costume in May. Any costume that is left after the last day in June will be sold or given to charity. We will not be responsible for storage of left over costumes.

Tights (pantyhose) are not included in the cost of the costume.

Costumes will cost approximately $65-$80 each plus tax.



Feel free to begin making monthly payments on costumes at any time until the December due date.

Advertising and Publicity Consent and Release Form

You agree and consent that Academy of Gymnastics and Dance, Inc., and it’s nominees and assigns, may use my name and/or photograph likeness, as applicable, or any reproduction (full or partial) thereof, in any form, style, or color, together with any writing and other advertising material, including television, in connection therewith, including the use of my name, as they may select. The consent and release is given without limitation upon, or liability for, any use for advertising, illustration, publication or broadcast of every kind, or in trade or media, or for any purpose. You further agree that such photography and/or likeness and the film, tape, plates, and negative thereof, shall be and remain their exclusive property. You further waive any right to inspect or approve the commercial or advertising material.

HOLD HARMLESS AGREEMENT





I (we) the undersigned student, parent, or legal guardian of a student of the academy of gymnastics and dance, Inc., for and in consideration of my enrollment or the enrollment of my child or a student for whom I’ve been granted legal custody hereby voluntarily and knowingly execute this release with the expressed intention of effecting the extinguishment of and complete release from any and all claims, actions, demands, or rights to monetary judgment arising from and all injury or physical harm which may arise or be sustained as a result of my participation of the participation of my child and/or legal ward in the various programs of instruction, practice and physical activity associated with the study of dance, gymnastics, and related activities conducted by the academy of gymnastics and dance, Inc., Darlene Atkinson, or any staff member of academy of gymnastics and dance, Inc. By the execution hereof, I do further bind myself, my child, my legal ward, their heirs, executors, administrators, successors, or assigns.



I am the parent/legal guardian of the student/students I am signing up for classes. I accept all responsibilities and liabilities listed above and throughout this paperwork in order for the student/students to be enrolled at academy of gymnastics and dance, Inc.



Everyone enrolled at Academy of Gymnastics and Dance Inc., must leave a credit card on file and/or VOIDED check whether in recreational or competitive classes. You can still pay by check, cash or put on average billing, however, if not paid by the 15th of each month or the selected date for average billing or your check is returned, your credit card will be charged.



I, the parent/legal guardian, realize that the academy does not send out a monthly bill. Tuition is due by the 15th of every month. All returned checks will be sent to the county attorney, who will assess their own fees. For all accounts that are not paid and handed over to the studio attorney, you will be responsible for all additional fees that are incurred. The academy will charge a $35.00 returned check fee. After the second returned check, all payments thereafter will be paid in cash, money order, or credit card.



I, the parent/legal guardian, realize that there will be no refunds for any reason, whatsoever for tuition, dance shoes, leotards, costumes or any other expenses.



I, the parent/legal guardian, understand that after an account is past due by one month; my child will be removed from class/classes/semiprivate/private lessons.



I, the parent/legal guardian, realize that all parents/legal guardians of a student must give a written 30 day notice before resigning from a class/classes. If notice is not given, I will be billed for that month and will be responsible for payment. I have received a drop/add written notice form that may be filled out and mailed in for my convenience in the event of dropping or resigning from a class or adding another class.



I, the parent/legal guardian, received a copy of the rules and requirements of the academy of gymnastics and dance and a drop/add slip. I have read and understood all of the policies included therein.



I, the parent/legal guardian, understand that there are no reductions in tuition due to a student’s absence. I also realize that monthly tuition has been set to average holidays, performance dates, extra practices and rehearsals and are therefore charged equally each month.



I, the parent/legal guardian, understand and accept that if my child does not come properly attired for class, the student will not be allowed to participate in class.



I, the parent/legal guardian, understand that it is my responsibility to keep up with all information posted at the studio or emailed. I understand that I should stop by regularly to keep up with current events and happenings.



I, the parent/legal guardian, understand that security cameras are in use inside and outside the building.





RECITAL INFORMATION

Everyone that would like to come and watch recital must purchase a ticket, this includes parents and students. Tickets are $10.00-$12.00 each. There are two additional rehearsals at the Auditorium on Wednesday and Thursday the week of recital. There is no cost for these practices. After Spring Break a student cannot miss more than 1 class per month. Students that miss more than 1 class per month can be removed from recital without refund.

WAIVER AND RELEASE OF LIABILITY

IN CONSIDERATION OF the risk of injury that exists while participating in COVID-19 (hereinafter the "Activity"); and

IN CONSIDERATION OF my desire to participate in said Activity and being given the right to participate in same;

I HEREBY, for myself, my heirs, executors, administrators, assigns, or personal representatives (hereinafter collectively, "Releasor," "I" or "me", which terms shall also include Releasor's parents or guardian if Releasor is under 18 years of age), knowingly and voluntarily enter into this WAIVER AND RELEASE OF LIABILITY and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation in the Activity; and

I HEREBY release and forever discharge ACADEMY OF GYMNASTICS AND DANCE, located at 1604 Tulane Dr, Lufkin, Texas 75901, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (collectively "Releasees"), from any physical or psychological injury that I may suffer as a direct result of my participation in the aforementioned Activity.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY OWN RISK. I AM AWARE OF THE RISKS ASSOCIATED WITH PARTICIPATING IN THIS ACTIVITY, WHICH MAY INCLUDE, BUT ARE NOT LIMITED TO: PHYSICAL OR PSYCHOLOGICAL INJURY, PAIN, SUFFERING, ILLNESS, DISFIGUREMENT, TEMPORARY OR PERMANENT DISABILITY (INCLUDING PARALYSIS), ECONOMIC OR EMOTIONAL LOSS, AND DEATH. I UNDERSTAND THAT THESE INJURIES OR OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE, CONDITIONS RELATED TO TRAVEL TO AND FROM THE ACTIVITY, OR FROM CONDITIONS AT THE ACTIVITY LOCATION(S). NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS ACTIVITY.

I FURTHER AGREE to indemnify, defend and hold harmless the Releasees against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs.

I FURTHER ACKNOWLEDGE that Releasees are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Releasees. In the event that I should require medical care or treatment, I authorize Academy of Gymnastics and Dance to provide all emergency medical care deemed necessary, including but not limited to, first aid, CPR, the use of AEDs, emergency medical transport, and sharing of medical information with medical personnel. I further agree to assume all costs involved and agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

I FURTHER ACKNOWLEDGE that this Activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. I agree not to participate in the Activity unless I am medically able and properly trained, and I agree to abide by the decision of the Academy of Gymnastics and Dance official or agent, regarding my approval to participate in the Activity. I HEREBY ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE Academy of Gymnastics and Dance AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST Academy of Gymnastics and Dance FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of Academy of Gymnastics and Dance, its agents, and employees.

I agree that this Release shall be governed for all purposes byTexas law, without regard to any conflict of law principles. This Release supersedes any and all previous oral or written promises or other agreements.

In the event that any damage to equipment or facilities occurs as a result of my or my family's or my agent's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.

THIS WAIVER AND RELEASE OF LIABILITY SHALL REMAIN IN EFFECT FOR THE DURATION OF MY PARTICIPATION IN THE ACTIVITY, DURING THIS INITIAL AND ALL SUBSEQUENT EVENTS OF PARTICIPATION.

THIS AGREEMENT was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both Participant, _________________________ and Academy of Gymnastics and Dance agree that this agreement is clear and unambiguous as to its terms, and that no other evidence shall be used or admitted to alter or explain the terms of this agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into. In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

I, THE UNDERSIGNED PARTICIPANT, AFFIRM THAT I AM OF THE AGE OF 18 YEARS OR OLDER, AND THAT I AM FREELY SIGNING THIS AGREEMENT. I CERTIFY THAT I HAVE READ THIS AGREEMENT, THAT I FULLY UNDERSTAND ITS CONTENT AND THAT THIS RELEASE CANNOT BE MODIFIED ORALLY. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND THAT I AM SIGNING IT OF MY OWN FREE WILL.
