I, the parent or guardian of a student of Westbrook Dance Academy LLC, do hereby release from all liability Westbrook Dance Academy, LLC and its staff for any and all injuries sustained during the course of dance or dance related study on the physical premise of Westbrook Dance Academy, LLC, Westbrook, CT and any other Westbrook Dance Academy, LLC dance functions. I acknowledge and understand that there are risks associated with participation in Westbrook Dance Academy, LLC activities and the use of different performance areas and facilities (outdoor stages, dressing rooms, lobbies, etc.) These risks include, but are not limited to: contusions, fractures, broken bones, sprains, dental injuries, scrapes, cuts, bumps, paralysis, or death. I, for myself and the participant’s names, willingly assume the risks associated with participation and accept that there are also risks that may arise due to other participants which I also willingly assume. I agree that the participants named, and I shall comply with all stated and customary terms, rules, and verbal instructions as conditions for participation in any performance and/or program at Westbrook Dance Academy, LLC. I, for myself, the participants names, our heirs, assigns, representatives, and next of kin agree to hold harmless and indemnify the owners of Westbrook Dance Academy, LLC, their predecessors, parent, subsidiaries and affiliates, officers, and employees for any defense cost or expense arising from any and all claims, injuries, liabilities or damages arising from participation resulting from or arising out of the negligence of Westbrook Dance Academy, LLC and/or its staff, or the negligence of any other person present on the premises of Westbrook Dance Academy, LLC. I acknowledge that in using the facilities, programs and equipment Westbrook Dance Academy, LLC, he/she does so entirely at his/her own risk. I acknowledge that Westbrook Dance Academy, LLC does not conduct any medical screening, and will not suggest any medical treatments, diagnosis or opinions regarding member’s disability that would prevent member from utilizing any of the facilities at Westbrook Dance Academy, LLC, and member has not been instructed by any physician not to do so. I will not hold Westbrook Dance Academy, LLC, or any other person in charge of venues responsible for any bodily injuries or property damage of any kind. I further acknowledge, understand, appreciate and agree that my participation may result in possible exposure to and illness from infectious diseases, including, but not limited to, MRSA, Influenza, and COVID-19. I understand that Covid-19 virus has a long incubation period during which carriers of the virus may not show symptoms and still be contagious. It is impossible to determine who has it and who does not, given the current limits in virus testing. I confirm that I (nor my child/student, if applicable) are not experiencing and have not experienced any of the following symptoms of Covid-19 listed below: Fever, temperature, shortness of breath, loss of taste or smell, dry cough, runny nose, sore throat. To prevent the spread of contagious viruses and to help protect each other, I understand that I will have to follow Westbrook Dance Academy’s guidelines. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I knowingly and freely assume all such risks, both known and unknown. I am of physical ability to participate and am legally competent to understand and complete this agreement. I hereby execute this agreement without coercion. Westbrook Dance Academy, LLC reserves the right to refuse or suspend services. All clients are required to submit a credit/debit card or bank draft information at registration. Westbrook Dance Academy, LLC reserves the right to suspend services to any student whose tuition and/or costume fees are more than two months past due. I hereby give my permission for images and video taken at studio functions be used for promotional purposes.
The following does not apply to Summer Programming, Adult Classes or Mommy and Me.
After registering for the 2024/2025 dance season, tuition will be debited from your account (or charged to your credit card) on the first Tuesday of each remaining month beginning September 9, 2024, provided no other payment type is made. I will notify Westbrook Dance Academy, LLC on or before October 15, 2024 if the above student is not able to participate in recital so a costume will not be ordered. Any student who leaves a class after this date is will remain responsible for payment of costume(s) and any tuition up to the date of notification. Costume fees will be sent to families in October. Costume fees will be automatically charged to your account on December 1, 2024 provided no other payment type is made. There are no refunds or returns on costumes.
