RELEASEE shall mean Movement Dance Studio (LLC), its agents, servants, employees, successors or assigns, and any activity or event holder, sponsor or volunteer.
RELEASOR HEREBY ACKNOWLEDGES that this Certification, Accident Waiver and Release of Liability form will be used by the Releasee and will govern Releasor’s rights, actions and responsibilities at activities, classes and events held by Releasee, or held by sponsors or organizers whether held at Movement Dance Studios or other locations. In consideration of Releasor’s application and permitting Releasor to participate in classes at Movement Dance Studio, or to participate in any event in which Movement Dance Studio may be associated, Releasor hereby takes action for itself, executors, administrators, heirs, next of kin, successors, and assigns, and certifies and agrees as follows:
RELEASOR HEREBY CERTIFIES that he or she (a) is in good health and does not pose a health risk to the public, (b) is physically fit, has sufficiently prepared or trained for participation in the activity or event, and has not been advised to not participate by a qualified medical professional, and (c) has no health-related reasons or problems which preclude participation in this activity or event.
RELEASOR HEREBY ASSUMES ALL RISKS OF PARTICIPATING ACTIVITIES AND EVENTS, INCLUDING ALL ACTIVITIES RELATED TO SAID PARTICIPATION. This includes, by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the Releasee, from dangerous or defective equipment or property owned, maintained, or controlled by Releasee, or because of any possible liability without fault.
RELEASOR HEREBY WAIVES, RELEASES AND DISCHARGES Releasee from any and all liability and fault whatsoever, including negligence, gross negligence or recklessness resulting in Releasor’s death, disability, personal injury, property damage, or property theft, arising from any action that may occur to Releasor during lessons, camps, private lessons, or any activity in which Releasor may participate, including actions that may or occur while traveling to and from events, and including any and all liability for injuries, sickness, pandemics, accidents, natural disasters and/or acts of God.
RELEASOR HEREBY INDEMNIFIES, PROMISES NOT TO SUE AND HOLDS HARMLESS Releasee from any and all liabilities or claims made as a result of participation in activities or events, whether caused by the conduct of Releasee or otherwise.
THIS CERTIFICATION, ACCIDENT WAIVER AND RELEASE OF LIABILITY shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A CERTIFICATION AS TO MY MEDICAL CONDITION, AN ACCIDENT WAIVER, A RELEASE OF LIABILITY AND A CONTRACT, AND I SIGN IT OF MY OWN FREE WILL.
PARENT/GUARDIAN WAIVER FOR MINORS (Only if student is under 18 years old) Parent or guardian does hereby represent that he/she is acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of this documents as set forth above. The undersigned parent or guardian agrees to save and hold harmless and indemnify Releasee from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon Releasee because of any defect or lack of capacity in Parent or Guardian’s right to act on behalf of the minor.
