I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY OR EVENT, including by way of
example and not limitation, any risks that may arise from negligence or carelessness on the part of the
persons or entities being released, from dangerous or defective equipment or property owned, maintained, or
controlled by them, or because of their possible liability without fault.

I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event,
and have not been advised to not participate by a qualified medical professional. I certify that there are no
health-related reasons or problems which preclude my participation in this activity or event.

I certify that I am in good health and that I do not pose a health risk to the public.

I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders,
sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions
and responsibilities at said activity or event. In consideration of my application and permitting me to
participate in this event, I hereby act for myself, my executors, administrators, heirs, next of kin, successors,
and assigns as follows:

I HEREBY WAIVE, RELEASE, AND DISCHARGE Janka’s Level Up Dance Academy, LLC. and all divisions thereof of
any and all liability and responsibility for injuries, sickness, pandemics, accidents, natural disasters and/or acts
of God incurred during participation in and/or instruction of camps, private lessons, or any activity I may
participate.

I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from
the negligence or fault of the entities or persons released, for my death, disability, personal injury, property
damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and
from this event, THE FOLLOWING ENTITIES OR PERSONS: Janka’s Level Up Dance Academy, LLC. and their
employees, volunteers, or the activity or event holders, activity or event sponsors, activity, or event
volunteers.

I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver,
release and registration form from any and all liabilities or claims made as a result of participation in this
activity or event, whether caused by the negligence of release or otherwise. The accident waiver and release
of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible
under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT
THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

Photo & Video Release Waiver:
I understand the photograph(s), video, audio recording(s) taken of me or my child (ren) by agents,
employees or representatives of Janka’s Level Up Dance Academy, LLC. shall be used in connection with
the company’s promotional and marketing efforts. This may include websites, social media, printed
materials, and other marketing and promotional outlets. I hereby irrevocably authorize Janka’s Level Up
Dance Academy to copy, exhibit, publish or distribute any and all such images, video, and audio of me or
my child (ren) or wherein I or they appear, including composite or artistic forms and media, for purposes
of publicizing Level Up Dance or for any other lawful purpose. In addition, I waive any right to inspect or
approve the finished product, including written copy, wherein my likeness or their likeness appears. I
hereby hold harmless and release and forever discharge Janka’s Level Up Dance Academy, LLC from all
claims, demands and causes of action which I, my heirs, representatives, executors, administrators or
any other persons acting on my behalf or on behalf of my estate have or may have by reason of this
authorization.

TUITION & REGISTRATION:
There is a $50.00 annual registration fee (September - June) per student. This does not include future recital and costume fees. Tuition is posted monthly on the 1st of every month, with the last tuition charge to be posted on June 1st, 2023.

ABSENCE:
Parents and/or students should mark their student absent in the DanceStudio Portal, alert
the director by calling 856-420-1949, or emailing LevelUpDance22@gmail.com in the case
of an absence from class.

MAKE-UP CLASSES:
Dancers can make-up missed classes by attending another same or similar level class on
the schedule. Make-up classes must be completed within 30 days of the absence. It is the
student or parents’ responsibility to schedule a make-up class—you must alert the director
before showing up for a make-up class. All make-ups must be made before the end of the
dance season in June-- make-ups DO NOT roll over to the following dance season or
summer camps/classes. There are NO REFUNDS or DISCOUNTS for missed classes or
dropouts. Our 2022-2023 calendar dates consider set holidays and scheduled closures;
therefore, make-up classes DO NOT pertain to holidays or scheduled studio closures.
Make-up classes should be used for class absences due to sickness or other circumstances
as well as weather closures. NO EXCEPTIONS.

TRANSFER OF CLASSES:
A student may transfer into a new class during the year with approval from Miss Janka.

LATE PAYMENTS:
A $10 late fee, will be applied to tuition that is not paid by the 15th of the month. NO
EXCEPTIONS.

REFUND POLICY:
It is highly encouraged that the student finishes out the paid month of dance before
withdrawing from the class. NO REFUNDS will be issued. NO EXCEPTIONS. Annual registration fees are non-refundable. NO EXCEPTIONS. All merchandise is non-refundable. NO EXCEPTIONS. Tuition is non-transferable. NO EXCEPTIONS.

ENROLLMENT:
Space in our classes are limited. If a class is full, it may be necessary to join a waiting list.
We will contact you as soon as a space becomes available.

CLASS COMMITMENT:
Students should register for classes with the intent to regularly participate and attend the
session from September 19, 2022 through June 17, 2023. In order for us to provide the
safest possible training at Janka’s Level Up Dance Academy, we expect that once you
register, you will be completing the season in its entirety. We understand that
unforeseeable and unavoidable circumstances may occur, in this case, we invite you to
take full advantage of our make-up policy and/or discuss the possibility of transferring classes with
Miss Janka. If you choose to discontinue from a class, your class reservation will end at the
end of the month in which you told the studio director that you were cancelling. You are
responsible for tuition payments until the end of that month. NO REFUNDS OR
DISCOUNTS. NO EXCEPTIONS.

CANCELLATIONS:
In the event of an emergency and/or snow or weather cancellation, an email will be sent to
the email address on file. In addition, cancellations will be posted on our website,
Facebook and Instagram pages. When a class is canceled due to an emergency and/or
weather, a refund will NOT be issued, and additional classes will NOT be
scheduled. Students are highly encouraged to make-up missed classes by taking another
similar or same level class on the schedule. There are NO
REFUNDS or DISCOUNTS for weather cancellations, instead, as stated above, students
are highly encouraged to make-up in another class.

INJURIES/ SAFETY DISCLAIMER:
There are possible risks involved in the art of dance. Parents and legal guardians assume
the risk of all injuries or damages that may arise from participation in dance activities of
Level Up Dance Academy or any other activity conducted by the student before, during or
after class time. Parents and Guardians hold harmless Level Up Dance Academy, its
agents, and employees from and against any liability or claim for any loss or property,
injury, misadventure, harm, cost, or damage sustained as a result of child’s participation in
Level Up Dance Academy’s classes and activities.

STUDENT, PARENT, TEACHER COMMUNICATIONS:
Any questions for teachers can be sent to the studio email, phone or scheduled with studio
director. Please refrain from pulling a teacher in between classes as instructors want to
give you proper attention but schedules are tight, and instructors need to be in class.

Contacting teachers and staff via text message, email or phone is not permitted. All contact
should be done through the studio phone or email or brough to studio directors’
attention.

Please respect our teachers. Do not tap on windows or talk to your child while
class is in session. Teachers will dismiss students from class. Teachers will help and
assist dancers during their class time if they should need anything.

STUDIO & LOBBY POLICY:
Please no running or screaming in the lobby. Our office area is off limits to anyone other
than teachers and staff. Please no gum, food, or colored sports drinks inside the dance studio. Street shoes are not permitted in the dance studio. Cell phones should not be brought into the dance studio
rather they should be kept in the lobby with other belongings. Please use the bathroom
before class as leaving during class is disruptive.

ZERO TOLERANCE POLICY:
Level Up has a zero-tolerance policy for disrespectful and rude behavior. LUDA reserves
the right to dismiss any dancer or family who does not abide by these policies.
