Hold Harmless Agreement/Release Waiver
Dreamer's Dance Company
1. I hereby release, indemnify and agree to hold harmless Dreamer's Dance Company (DDC), and/or their directors, officers, managers, teachers, employees, volunteers, representatives, and agents, from any and all liability whatsoever, for any damage or injuries, and from any and all claims and demands, including attorney fees, arising out of the party’s participation in dance lessons, classes, workshops, performances, and other related activities provided by and/or at the facility of DDC. I understand that students may occasionally appear in promotional performance videos, photos, brochures, and other materials as a result of his/her association with DDC. Such use of the student’s name and likeness are agreed to and acknowledged and, accordingly, all right, title and interest in same are waived. Dancer and Dancer’s Guardian(s) understand that dancers may be photographed or videotaped from time to time in rehearsals, performances, competitions or studio related events. Dancer and Dancer’s Guardian(s) understand that all studio areas may be recorded by studio security cameras (with the exception of restrooms) at all times.
2. Acknowledgment of Risks: I/We understand that there are numerous risks associated with participating in dance activities, including those risks present during classes and activities, on the premises before, during, and after various classes and events, as well as in travel to and from DDC and various venues of performance. Some of the specific risks include the placement of unusual stresses on the body, falls and tripping which may lead to accidents resulting in, but not limited to, mild to severe bodily injury. I/We understand that Dreamer's Dance Company cannot be responsible for any injuries or damages experienced by my/our child during her/his participation in such activities.
3. By accepting this waiver, I HEREBY WAIVE, RELEASE, AND DISCHARGE Dreamer's Dance Company and all divisions thereof of any and all liability and responsibility for injuries, sickness, pandemics, accidents, natural disasters and/or acts of God incurred during participation in and/or instruction of camps, intensives, private instruction, choreography or any activity I may participate. I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, illness, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: Dreamer's Dance Company and/or their directors, officers, managers, teachers, employees, volunteers, representatives, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers; I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver, release and registration form from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise.
4. Medical Care: In an emergency situation, when parental permission is not available, I/We hereby grant and give my/our permission for a staff member at Dreamer's Dance Company to seek emergency medical treatment for my/our child. In my/our absence or inability to communicate with emergency and hospital personnel, I/We hereby grant Dreamer's Dance Company authority to release for the purpose of providing medical treatment, my/our child to the care of medical personnel or physicians as Dreamer's Dance Company determines as reasonably appropriate.
5. Release, Covenant Not to Sue, Waiver of Liability and Indemnification Provisions Parents (of Minors): I/We have read and clearly understand the terms of this Agreement. I/We give my/our permission for my/our child to participate in all Dreamer's Dance Company activities, including those described above. I/We also release and hold harmless Dreamer's Dance Company, its officers, directors, agents and employees, and those acting under its authority, from all actions, claims and liabilities relating to my/our child’s participation in any and all programs.
I further agree to indemnify and hold harmless and defend Anna Rose, Dreamer's Dance Company LLC, its teachers, officers, agents, and employees from injuries, damages and losses sustained by me or my child arising out of, connected with, or in any way associated with the activities of the program(s). I have read and fully understand the above program details and waiver and release of all claims.
Rules and Policies
Dreamer's Dance Company
1) I understand that all Dreamer’s Dance Company information will be sent via email. It is my responsibility to make sure I read all information. I will keep you updated on any changes in my email address.
2) I understand that class placement is determined by the instructor, and I am willing to support the decisions and selection of class placement.
3) I explicitly give my consent to the instructor to gently lay their hands on the student for purposes of dance instruction.
4) I understand that if I have a question or concern regarding the policies or decisions made by the Dance Director, I will request a personal appointment with the appropriate party. I understand that negative comments, concerns, or complaints should be addressed with the Dance Director and not with other parents or on social media.
5) As a parent, I understand that a positive attitude and continued support is necessary in order for my child to continue the privilege of participating in the dance program. I also understand that if I, or my child, choose to have a negative attitude or cause volatile scenes in any way, my child will be asked to leave Dreamer’s Dance Company and there will be no refunds, credits or transfers of funds paid.
6) I understand that there will be no adjustments or credits for missed classes.
7) Minimum Class Size: I understand the minimum class size is 5 students. Fewer students may result in a schedule change.
8) Payment: All payments must be received by the 1st of each month. After the 5th of the month, a $25 late fee will be added to the account.
9) Withdrawal from Dreamer’s Dance Company can happen at the parent or studio owner’s discretion. At no point does withdrawing constitute a refund. In the event of a withdrawal, a $60 withdrawal fee per class will be charged and due immediately.
10) I understand that there will be a $35.00 charge applied to account for returned checks. I understand that if my amount due is not paid on time, my child will not be allowed to participate in Dreamer’s Dance Company classes.
11) I understand that I must have a current credit card on file and autopay is required.
12) Dreamer's Dance Company requires a 24 – hour notification from students wishing to cancel scheduled Private, Semi-Private or Private Group Sessions; accounts will be charged the full-session rate for cancellations made less than 24 hours prior to the scheduled appointment.
13) I give permission for my child to be photographed and videotaped during productions, performances, rehearsals and for Dreamer’s Dance Company promotional purposes.
14) I agree to not attend or send my child to Dreamer’s Dance Company should they become ill with any other contagious illness or condition, and/or is displaying any symptoms such as headache, fever or chills, shortness of breath or difficulty breathing, sore throat, cough, loss of smell or taste, diarrhea, etc. I understand that no refunds will be provided, and classes can be made up within 30 days. I agree to all safety procedures and plans put forth by the DDC that are currently in place.
15) In the event of a studio shut-down due to government regulations, Zoom/Live Streaming classes will take the place of in-studio classes. There will be no tuition refunds unless the class is canceled and does not occur in the studio, on zoom, or any live stream medium.
16) I have read and understand the above rules and policies and I understand that Dreamer’s Dance Company reserves the right to refuse service to any person who does not support the policies and decisions set forth. I have read and understand that these policies apply to all DDC classes and events in-studio, at home, or any other venue.
17) I have read and understand the Parent/Student Handbook (displayed on https://www.dreamersdanceco.com/tuition) and agree to all policies and procedures set forth by Dreamer’s Dance Company and I will follow all new guidelines set forth by the director of Dreamer's Dance Company.
