RELEASE AND WAIVER
All participants must complete this Release and Waiver Form (“Waiver”) before participating in any Studio 180, LLC (d/b/a Ballet 180 School) classes, workshops, rehearsals, or performances. If the participant is under age 18, a parent or legal guardian must also sign this Waiver.

Assumption of Risk
I recognize and understand that participating in dance and dance training as part of Studio 180, LLC (d/b/a Ballet 180 School) rehearsals, workshops, classes, and performances (“Activities”) poses the risk of physical injury, illness, or death. Any of these may occur with or without the negligence of others, defective equipment, property, and/or facilities. I fully and knowingly assume these risks.

Waiver of Liability; Indemnification
In consideration of being permitted to participate in the Activities, I, on behalf of myself and my heirs and assigns, hereby release Studio 180, LLC (d/b/a Ballet 180 School) and its affiliated dance studios, event sponsors, employees, volunteers, directors, and dance teachers (collectively “Releasees”) from any and all claims, causes of action and liabilities, and any associated damages and costs (including attorneys’ fees and costs) relating to or in any way arising from the Activities, including, without limitation, those arising from the fault or negligence of the Releasees. By signing this Waiver, I am giving up rights that I would otherwise have. I agree to indemnify, defend, and hold harmless the Releasees against any and all liabilities, costs and judgments arising from acts of omissions committed by me or my child which result in injury or damage to any person or property.

Protection of Property
I understand and agree that it is my sole responsibility to safeguard my personal property while attending or participating in any classes, rehearsals, workshops, or performances. I hereby release the Releasees from all liability for loss or damage to my personal property while attending or participating in classes, rehearsals, workshops, or performances.

Medical Attention
In case of physical injury or medical emergency, I hereby authorize Studio 180, LLC (Ballet 180 School) to make necessary arrangements to transport myself or my child to a medical treatment facility as necessary. All such transportation and medical treatment will be at my sole cost and expense. In extreme emergency, or if my child is under 18 years of age, I understand that Studio 180, LLC (d/b/a Ballet 180 School) will attempt to notify the person(s) I have named below as my emergency contact(s) of my condition and how to reach me.

Photo Release
Studio 180, LLC (Ballet 180 School) reserves the right to use photographs and videos taken during the Activities or other affiliated events for the purposes of instruction, advertising, and promoting Studio 180, LLC (d/b/a Ballet 180 School) and its programs. Participants, or parents of participants who are minors, who do not wish to comply with this policy must notify Studio 180, LLC (d/b/a Ballet 180 School) in writing prior to participation.

This Waiver and the rights and obligations of the parties hereto shall be interpreted, construed and enforced in accordance with the laws of the Commonwealth of Pennsylvania without regard to its conflict of law provisions. I further understand and agree that any legal matter arising out of my relationship with Studio 180 (d/b/a Ballet 180 school) must be brought In Chester County Pennsylvania or the Eastern District of Pennsylvania.

Acknowledgement of Waiver
In signing this Waiver, I acknowledge, warrant, and represent that I have fully informed myself of its contents by reading it before I sign it, that I sign this Waiver as my own free act and deed, and that I have not been induced by any oral representations, promises or statements. I further state that I am at least eighteen (18) years of age and am fully competent to sign this agreement, and that I execute this release for full, adequate, and complete consideration fully intending to be bound by the same. I further affirm that there are no health-related reasons or problems which preclude or restrict my or my child’s participation in the Activities.

Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore may be able to spread the disease without being aware they have been infected. The exact methods of spread and contraction are still being studied. While there is no known cure, there are treatments and vaccines for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life-threatening illness and even death.

Studio 180, LLC dba Ballet 180 School cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading COVID-19 while at Studio 180, LLC dba Ballet 180 School’s services or premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to utilize Studio 180, LLC dba Ballet 180 School’s services and/or enter onto Studio 180, LLC dba Ballet 180 School’s premises you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children in order to utilize Studio 180, LLC dba Ballet 180 School’s services and enter Studio 180, LLC dba Ballet 180 School’s premises. These services are of such value to me and/or to my children, that I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize Studio 180, LLC dba Ballet 180 School’s services and premises in person rather than arranging for an alternative method of enjoying the same services virtually.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Studio 180, LLC dba Ballet 180 School and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to utilizing Studio 180, LLC dba Ballet 180 School’s services and premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

CHOICE OF LAW: I understand and agree that the law of the State of Pennsylvania will apply to this contract.
CHOICE OF VENUE: I understand and agree that any legal matter connected to COVID-19 or other claims of liability must be brought in the Courts of Chester County, Pennsylvania or in the Federal Courts for the Eastern District of Pennsylvania.

BALLET 180 SCHOOL POLICIES AND PROCEDURES

All parents and students must read and abide by all policies associated with being a registered student of Ballet 180 School. Students will be accepted on a first-come, first-served basis with registration form complete, including consent signature, tuition, and registration fee payment.

Ballet 180 School is committed to providing a healthy and supportive environment that promotes respect, kindness, and inclusion. This policy applies to our students and their families, our staff, and any guests and visitors. It applies throughout our entire space, lobbies, hallways, bathrooms, studios, dressing rooms, and any Ballet 180 School events. Ballet 180 School reserves the right to remove or dismiss anyone who Ballet 180 School determines, in its discretion, has engaged in any conduct violating any part of this policy. No refund of tuition will be given.

STUDIO ETIQUETTE:
No street shoes, food, cellphones, or gum are allowed inside the classrooms. Water bottles are acceptable to bring to class. Please be respectful of all Ballet 180 furniture and property. It is ok to bring food or snacks into the waiting area, but please be sure to clean up after yourself. Due to student allergies, we are a nut-free facility.

All children (dancers and siblings) must maintain quiet indoor voices and are not permitted to run in the lobby or hallways. It is a safety hazard and it is disturbing to the teachers and students who are in class.

Dancers should use a dance bag to carry their dance shoes, water bottle, and extra hair accessories to the studio. Remember to label all of your belongings, including water bottles. Dancers are responsible for their own belongings at all times and are expected to clean up after themselves in the studio and lobby.

DRESS CODE:
All classes have a required uniform. Students must wear appropriate attire for the class(es) they attend. Students who do not come in proper attire and hair may not be allowed to participate in class.

LOST AND FOUND:
Items left at the studio will be placed in our lost and found bin for two weeks before being discarded/donated. Please have your dancer’s name written on their belongings so that we can contact you if it is left behind.

DROP-OFF/PICK-UP:
Please arrive before class begins so that you have enough time for parking/drop off, using the restroom, and getting ready for class (shoes on, stretching, etc.). If a student arrives more than 10 minutes late, they may be asked to sit and watch their peers as they will have missed the warm-up portion of class.

Since our classes run on a tight schedule, it is important that dancers are picked up on time so that our staff can help the next class. Parents arriving more than 10 minutes late for pick-up will be charged a $15.00 late pick-up fee.

Note: Students carpooling together should notify the office via email.

ATTENDANCE:
We expect dancers to take class seriously and to only miss class for valid reasons. Valid reasons include illness and school or religious events. Unexcused, non-valid reasons include birthday parties, social events, and local theater productions. Regular class attendance is the most reliable factor in a child’s growth and progress. Dancers who show up regularly and on time display confidence and comfort in class. Conversely, poor class attendance increases a dancer’s risk of injury, delays progress, and affects the progression of the class as a whole.

Dancers are entitled to three (3) absences per season (Seasons = September through December & January through June), which equals 15% of class time. Missing more than this may affect level placement for the upcoming school year and may require private lessons to make-up missed class time and/or choreography. Ballet 180 reserves the right to remove a dancer from a dance performance if they are not prepared for the show. It is the responsibility of each family to keep track of attendance. No refunds or deductions in tuition will be made for classes missed.

Absences are entitled to a make-up class by attending a class of equal or lower level within four weeks of the absence. Make-ups cannot occur during parent observations or dress rehearsal/show weeks and they cannot be carried over into summer sessions or future school years.

SCHOOL CLOSINGS:
In the event of inclement weather, Ballet 180 will send out an email. These decisions are made for the safety of our students and staff. No deductions of tuition may be made for inclement weather. Students are entitled to a make-up class on another day in the same level or lower level class, if they so choose.

INJURIES:
In the event of withdrawal due to a medical issue, a medical note is needed from a doctor.

COMMUNICATION & COLLECTION OF INFORMATION:
Ballet 180 School collects personal information, including email address, parent/guardian contact information, student data, and payment information. Information collected is used solely for student registration, billing, and school related communication.

PERFORMANCE PARTICIPATION
A Nutcracker Sweets performance fee of $75.00 will be automatically charged to each dancer’s account on September 15th. If you are unable to perform in the Nutcracker, please email school@ballet180.org by September 10 to opt out of the performance. Dancers must be registered in classes by September 15th to perform in our performance of Nutcracker Sweets.

A Showcase performance fee of $85.00 per class will be automatically charged to each dancer’s account on February 15th. If you are unable to perform in the Showcase, please email school@ballet180.org by February 1 to opt out of the performance. Dancers must be registered in classes by January 15th to perform in our Showcase performance.

WITHDRAWAL:
Our classes follow the academic school year. If a student withdraws prior to our year end they will incur an early withdrawal fee equal to one month’s tuition to cover the teaching and administrative costs associated with an early withdrawal. To drop a class, written notice must be emailed to school@ballet180.org before the 1st of the month. Notifications received after the 1st of the month cannot be retroactively applied. Therefore, if notification is not received by the appropriate date, your student will be considered a registered participant and you will be responsible for the full installment amount. Withdrawals are not accepted via telephone. Notifying a teacher does not qualify as a withdrawal.

TUITION & FEES
First and last month’s tuition installment plus a $40 registration fee is due upon registration. Full tuition is expected regardless of snow days, holidays, illness, or vacations taken. Tuition and fees are non-refundable and non-transferable; NO EXCEPTIONS. Prorated refunds will only be given when a physician’s note confirms an injury that prevents physical activity, or if a class must be removed from the schedule by Ballet 180 School.

Autopay
Autopay divides tuition payments into 10 installments with the first and last installment made upon registration. Future installments are deducted on the 1st of the month with the final installment on May 1.

Tuition Discounts
We offer a 5% tuition discount for families paying in full for the entire school by September 1st. Families with more than one dancer receive 5% off the tuition of the second family member (i.e. the student with the fewest class hours).

Due Dates & Fees
All tuition and performance payments are due on the indicated dates. A $30 late fee is charged for any payment more than seven (7) days overdue. This includes returned checks, declined credit cards, and payments that result in non-sufficient funds (NSF). This charge is to cover administrative costs associated with tracking late payments. Students may not attend class if tuition is not received within fourteen (14) days of the tuition due date.

If a student withdraws prior to our year end they will incur an early withdrawal fee equal to one month’s tuition to cover the teaching and administrative costs associated with an early withdrawal.

We allow a two-week courtesy period for adjustments to your schedule. Class changes after this period will incur a change fee of $30 to cover the administrative costs associated with a class change. Class changes cannot be made after showcase dances have begun in February.
