Waiver and Release and Assumption of Risk
1. Waiver and Release of all claims (including negligence)
I hereby waive and release Main Street Dance Center, its agents, servants, employees, insurers, successors, and assigns from all claims, demands, causes of action, damages, or suits at law and equity of whatsoever kind, including but not limited to claims for personal injury, property damage, medical expenses, loss of services, on account of or, in any way related to my presence at this facility. This waiver and release are intended to and does release Main Street Dance Center from any and all liability for damages or injuries on account of or in any way related to or growing out of my negligence, the negligence of third parties, and the negligence including but not limited to negligence in the construction, maintenance, and upkeep of the facility and any equipment, negligence in training, instruction, or negligence in supervision. This is not intended to release Main Street Dance Center from liability resulting from intentional misconduct.
2. I understand that Main Street Dance Center is not responsible for any lost or stolen valuables or property from within the facility.
3. While at the facility, I agree to conduct myself in a responsible manner and will refrain from engaging in inappropriate conduct, including the use of loud, foul, slanderous language or any intimidating or offensive conduct.
4. In the event that any damage to equipment or facilities occurs as a result of my or my family’s or my agents willful actions, neglect, or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any such actions of neglect or recklessness.
Assumption of Risk
I am voluntarily participating in dance and movement classes, and I am participating in the classes entirely at my own risk. I am aware of the risks associated with participating in dance and movement, which may include, but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others negligence, conditions related to travel to and from Main Street Dance Center, or from conditions at Main Street Dance Center. Nonetheless, I assume all related risks, both known and unknown to me, of my participation in dance and movement classes at Main Street Dance Center.
I understand that if for any reason, I am or have been under medical supervision or if I have not exercised regularly in the recent past, a doctor’s approval should be obtained prior to engaging in dance instruction and training at Main Street Dance Center. I understand and agree that it is my sole responsibility to obtain medical approval.
I further covenant and agree not to institute any claims or legal action against Main Street Dance Center for any claim released by this Agreement. I further agree that should any claim be made against Main Street Dance Center in contravention of this Agreement, including but not limited to derivative claims, I will protect, defend, and completely indemnify and reimburse for any such claim and expenses including attorney fees and costs incurred in defending themselves or security indemnity hereunder.
I recognize, clearly acknowledge, and understand the hazards involved while engaging oneself in dance and movement training and dance participation and I agree to enter such participation entirely at my own risk and agree to hold harmless Main Street Dance Center, its agents, servants, employees, insurers, successors, and assigns from all negligence.
I hereby acknowledge that I have carefully read this Waiver and Release and fully understand that it is a release of liability. I expressly agree to release and discharge Main Street Dance Center and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representative, predecessors, successors, and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against Main Street Dance Center for personal injury or property damage. I agree any violation of the agreement and its terms and conditions will void and terminate this agreement and may result in the loss of the ability to participate in dance and movement instruction and training and Main Street Dance Center.
This waiver and release of liability shall remain in effect for the duration of my participation in dance and movement training, during this initial and all subsequent events of participation at Main Street Dance Center.
I have read the Agreement and understand that by signing the Agreement, I have consented to be bound by its terms and conditions including the waiver/release of any legal right I may have to bring legal action for any costs because a claim or legal action is brought in violation of this Agreement.
I, the undersigned participant, student or parent/guardian of a minor/s, affirm that I am of the age of 18 years or older and that I am freely signing this Agreement. I certify that I have read this Agreement, that I fully understand its content, and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.
