I understand that there are specific risks of physical or property damages, losses, or injury that may result from my or my child’s participation with Creative Motion Studios, and I voluntarily assume the risks associated with such participation.

Waiver and Release

In consideration of accepting my or my child's participation in the dance and fitness program at Creative Motion Studios, LLC (the “Activity”), I represent that I understand the nature of this Activity and that I or my child, as the case may be, is qualified, in good health, and in proper physical condition to participate in such Activity. I fully understand that this Activity involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by mine or my child’s own actions, or inactions, those of others participating in the Activity, the conditions in which the Activity takes place, or the negligence of the “Releasees” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for injury, liability, losses, costs, and damages that me or my child incurs as a result of participation in the Activity. Furthermore, I authorize Creative Motion Studios, LLC to administer first aid to me or my child in the case of an emergency. I, the undersigned, intend to be legally bound for myself, my child, my executors, administrators, heirs, successors and assigns hereby WAIVE, RELEASE, DISCHARGE AND COVENANT AND AGREE NOT TO SUE Creative Motion Studios, LLC, Natalie Orr­-Andrea and its or her respective members, managers, officers, employees, representatives, affiliates, heirs or permitted assigns or other participants (each considered one of the “RELEASEEES” herein) from any and all injuries (including but not limited to personal injury, property damage or death) suffered by me or my child and any and all other liability, claims, demands, losses, or damages, on my account or my child’s account caused or alleged to be caused in whole or in part by the negligence of the “RELEASEES” or otherwise, including negligent rescue operations and further agree that if, despite this release and waiver of liability agreement I, or anyone on my or my child’s behalf, makes a claim against any of the RELEASEES, I will indemnify, save, and hold harmless each of the RELEASEES from any loss, liability, damage, or cost, which may incur as the result of such claim. By signing this form, I certify that I have read and understand the contents of the release and waiver of liability agreement and agree to be legally bound by all of its terms and conditions. I have read the RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extend allowed by law and agree that if any portion of this agreement is held to be invalid, the balance, notwithstanding, shall continue in full force and effect.

PARENT/GUARDIAN/AGENT: The undersigned verifies that he/she is the parent/guardian/agent of the Child and it is the undersigned’s desire on his/her behalf that the Child be permitted to participate in the dance and fitness program provided by the Activity and that the undersigned has authority to enter this agreement on the Child’s behalf and agree that the undersigned and the Child be bound by the terms of this Release and Waiver of Liability.

I certify that I have read and understand the contents of the release and waiver of my right to sue and agree to be legally bound by all of its terms and conditions.
This form also authorizes Creative Motion Studios, LLC to administer First Aid in case of an emergency.

I understand that if I am not receiving email newsletters from Creative Motion Studios, it is my responsibility to let the front desk know so records can be updated. Creative Motion Studios is not responsible if I miss events and information due to not reading the email communications sent or failing to provide a current email address. All email updates and newsletters will also be posted on the info board in the front entry of the studio. Creative Motion Studios uses email as its main form of communication, and will send schedule changes, studio closings, recital information, and studio news and updates, including special events, through email. Newsletters and recital information are also posted on the studio website under Parent Resources.

I understand that it is my responsibility to make sure the studio has an updated email address and to read all studio communications.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.

Creative Motion Studios, LLC (CMS) has put in place preventative measures to reduce the spread of COVID-19; however, CMS cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending CMS could increase your risk and your child(ren)’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending CMS and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at CMS may result from the actions, omissions, or negligence of myself and others, including, but not limited to, CMS employees, volunteers, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at CMS or participation in CMS classes. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless CMS, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of CMS, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any CMS program, class or event.

I understand that Creative Motion Studios does not give credit and/or refunds for class(es) missed due to holiday, vacation, illness, weather, etc. I understand that tuition is due prior to the start of the month for which the tuition applies. I agree to Creative Motion Studios' financial policies as stated on their website and posted at the studio. I understand that these policies are subject to change without notice.

All original choreography remains the property of Creative Motion Studios, LLC and its instructors and may not be used or reproduced without the permission of the studio owner or instructor. Videography is not permitted during class without the permission of the instructor.

Creative Motion Studios, LLC has permission to use photos and videos of myself or my child for advertising and promotional purposes.
