RELEASE OF LIABILITY WAIVER
DISCLAIMER: Level Up Dance Center (Further mentioned in this waiver as LUDC) IS NOT
RESPONSIBLE FOR ANY INJURY OR LOSS OF PERSONAL PROPERTY TO ANY PERSON WHILE
PRACTICING, TRAINING, VIEWING, ENROLLED IN A CLASS AT OUR FACILITY OR PARTICIPATING IN
ANY OPEN FLOOR, WORKSHOPS, PERFORMANCES, SPECIAL EVENTS OR ARE IN ANY OTHER WAY
INVOLVED IN DANCE, TUMBLING, MOVEMENT OR ANY OTHER ACTIVITIES FOR ANY REASON
WHATSOEVER, INCLUDING ORDINARY NEGLIGENCE ON THE PART OF LUDC, ITS OWNERS, STAFF
OR REPRESENTATIVE AGENTS.
In consideration of my participation and in recognition of LUDC’s commitment to safety, I agree
to all the terms and conditions set forth in this release of liability waiver.
1. I hereby expressively waive and release any and all claims, now known or hereafter
known, against LUDC, its owners, staff, representative agents, volunteers, or other
student members on account of property damage, loss of property, personal injury, or
wrongful death, whether arising out of ordinary negligence or otherwise a result from
engaging or receiving instructions in dance, tumbling, movement or any other physical
activity type in relation to practicing, training, or performing or any incidental activity.
2. I hereby expressively waive and release any and all claims, now known or hereafter
known, resulting from ordinary negligence that may be made by me, my family, estate,
heirs, or otherwise assigned.
3. I am fully aware and understand that dancing and aerobic activities are categorized as
vigorous sporting activities involving lifts, tricks, and unique environments that pose the
risk of injury. I acknowledge and understand that dance, tumbling, movement, and
other related physical activities involve certain risks, including but not limited to, death,
serious neck/spinal injuries and serious injury to any and all bones, joints, muscles, and
internal organs. I acknowledge and understand the safety equipment and apparatuses
provided for my protection and safety, including the active participation of LUDC staff
who will spot/assist during performances of certain skills that may be currently
inadequate to prevent serious injury. I am fully aware and understand that my
participation in dance, tumbling, movement, and other related physical activities
incidental to active participation including moving from event to event, conditioning,
stretching and other physical activities which may leave the student vulnerable to the
reckless actions of other participants (students) who may not have complete control of
their actions OR who may not see/ have seen other students on the floor.
NOTWITHSTANDING THESE RISKS, I ACKNOWLEDGE THAT I AM VOLUNTARILY
PARTICIPATING WITH KNOWLEDGE OF THE DANGERS INVOLVED. I HEREBY AGREE TO
ACCEPT AND ASSUME ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY
DAMAGE ARISING FROM MY PARTICIPATION, WHETHER CAUSED BY THE ORDINARY
NEGLIGENCE OF LUDC OR OTHERWISE.
4. I shall indemnify and hold harmless LUDC, its owners, staff, representative agents,
volunteers, or other student members against any and all damages, liabilities, claims,
actions, and penalties arising out or resulting from any claim of a third party related to
LUDC, including any claim related to my own negligence or the ordinary negligence of
LUDC, its owners, staff, representative agents, volunteers, or other student members.
5. This Release constitutes the sole and entire agreement of LUDC with respect to the
subject matter contained herein and supersedes all prior and contemporaneous
understandings, agreements, and representations, both written and oral, with respect
to such subject matter. If any term or provision of this Release is invalid, illegal, or
unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not
affect any other term or provision of this Release or invalidate or render unenforceable
such term or provision in any other jurisdiction. This Release is binding on and shall
inure to the benefit of LUDC and myself. All matters arising out of or relating to this
Release shall be governed by and construed in accordance with the internal laws of the
State of Florida without giving effect to any choice or conflict of law provision or rule
(whether of the State of Florida or any other jurisdiction). Any claim or cause of action
arising under this Release may be brought only in the federal and state courts located in
Martin County, Florida and I hereby consent to the exclusive jurisdiction of such courts.
BY SIGNING, I AFFIRM I AM OF LEGAL EDUCATIONAL AGE AND I ACKNOWLEDGE THAT I HAVE
READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY
GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.
By signing this release of liability waiver, I hereby represent that I am the parent or legal
guardian of the minor/minors named within the portal. I have the legal right to consent and, by signing Electronically.
