**AGREEMENT**
I, the student or the parent on behalf of the student (hereafter referred to as the Dancer), understand that under the terms of this agreement, Illumination Dance (hereafter referred to as the studio) obligates itself to provide me with competent instruction. The Dancer, hereby represents that she/he is physically fit to receive and participate in the prescribed course(s) of instruction. The Dancer, agrees to faithfully comply with all the rules and regulations of the studio outlined below.

** INJURY & IMAGE AGREEMENT**
The Dancer acknowledges and is fully cognizant of all the inherent dangers in connection with the execution of dance and acknowledges that the execution of dance requires physical exertion and contact, and realizes that there is a risk of physical injury which may be incurred while engaged in this activity. The Dancer hereby waives any and all claims for any physical injury in connection with the training at the studio and expressly assumes the risk of all dangers or injury inherent to dance. The Studio will not be liable for any injury or associated cost. The Dancer further acknowledges and gives consent for the studio to use any and all images of the Dancer without compensation or remuneration.

**MEDICAL AGREEMENT**
The undersigned gives permission to the Studio, its owners and operators to seek medical treatment for the Dancer(s) in the event they are not able to reach a parent or guardian. The Dancer have declared in Dance Studio Pro any physical/mental problems, restrictions, or conditions, and/or declare the Dancer to be in good physical and mental health.

**TEXT MESSAGES**
The Dancer agrees to receive text messages in the event of urgent studio notifications. The Dancer assumes all financial responsibilities for costs associated with receiving any related text messages from the Studio..

The Dancer declares that the above information is true and correct to the best of my knowledge, and I acknowledge receiving a copy of this agreement.

COVID - 19 Illumination Dance, LLC - Participation Release

Thank you for your continued support and trust in Illumination Dance. As with the transmission of any communicable disease like a cold or the flu, you may be exposed to COVID-19, also known as the “Coronavirus”, at any time or in any place. Be assured that we have always followed state and federal regulations to limit transmission of all diseases in our studio and continue to do so.

Despite our careful attention to sterilization, disinfection, and use of personal barriers, there is still a chance that you could be exposed to an illness in the studio, just as you might be at your gym, grocery store or favorite restaurant. Social distancing has reduced the transmission of Coronavirus. Although we have taken several measures to provide social distancing and contactless participation, please know that participation in Illumination Dance instructional classes is at your own risk.

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin HEREBY RELEASE AND HOLD HARMLESS Illumination Dance, LLC, their officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

***REGULAR SEASON (September - June)***
-The Dancer, assumes responsibility to pay the assigned fees for the current season, which are due by the 10th of each month.

-Each family is required to have a BACKUP credit card on file for the entire season. This card is ONLY charged if tuition is not paid by the 10th of the month.

-The first month’s tuition will be due by the first night of classes in September.

-In the event that tuition is not paid by the 10th of the month, the Dancer understands that the BACKUP credit card on file will be charged tuition and an additional $15 late fee on the 11th, and will forfeit all discounts received that month.

-An additional $5 late fee will be added every 5 days after the 10th until your outstanding fees are paid. NO EXCEPTIONS!!

-Any check returned for insufficient funds will incur a $35 penalty non-sufficient funds fee.

-Any modifications, changes, amendments or cancellations of enrollment by the Dancer must be put in writing and given with 30 days notice.

-The monthly tuition payment plan is not affected by the Dancer’s training schedule and/or attendance.

***SUMMER SEASON (July - August)***
The Dancer, assumes responsibility to pay the assigned fees for the current season, which are due at signup. Any check returned for insufficient funds will incur a $35 penalty non-sufficient funds fee. Season fees are non-refundable if cancellation of enrollment is made 10 days or less before the class start date. Class fees are not pro-rated by the Dancer’s training schedule and/or attendance.
