This Liability Waiver applies to and authorizes myself and any minors under my supervision to attend classes and other organized activities sponsored or associated with Bend LLC d/b/a Bend Gymnastics & Fitness. These activities include, but are not limited to gymnastics, dance, acrobatics, personal training, pilates, sculpt & tone classes, high intensity interval training, open gym time, and other organized instruction held at 2337 Philmont Avenue, together with any annual shows and/or special recitals offered by Bend that may be located at a separate facility.
I hereby understand and acknowledge that the Activities held by Bend may expose me and/or my children/dependents to many inherent risks, including accidents, injury, illness, or even death. I assume all risk of injuries associated with participation in the Activities including, but not limited to, falls, contact with other participants, the effects of the weather, including high heat and/or humidity, and all other such risks being known and appreciated by me. I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in any Activity offered by Bend and/or occurring on the Property. I acknowledge that I am physically fit and mentally capable of performing the Activities I choose to participate in, and that any minors under my supervision are also physically fit and mentally capable of performing all Activities selected.
I understand that Bend makes no representations with regard to the risks associated with the Activities, including risks of exposure to the COVID-19 virus, or coronavirus. In consideration of all risks associated with my and/or my children/dependents’ participation in the Activities, and as consideration for the right to participate, I hereby, for myself and all minors under my supervision, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims, or causes of action of any kind whatsoever arising out of attendance at classes and any participation in Activities associated with Bend, whether on or off the Property, and do hereby release and forever discharge the Bend, its owners, members, employees, agents, and volunteers, for any injury or illness I, my children, and/or my dependents may suffer in connection with Bend’s Activities, including, but not limited to, exposure to COVID-19, illness, physical injury, paralysis, death, damages, economic or emotional loss.
I agree to indemnify and harmless Bend against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If Bend incurs any of these types of expenses, I agree to reimburse Bend.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS LIABILITY WAIVER AND FULLY UNDERSTAND THAT IT IS A FULL AND IRREVOCABLE WAIVER OF LIABILITY FOR ANY INJURY THAT I, MY CHILDREN, AND/OR DEPENDENTS MAY INCUR AS A RESULT OF ANY ACTIVITY OFFERED BY OR CONDUCTED IN ASSOCIATION WITH BEND. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE BEND, ITS OWNERS, MEMBERS, EMPLOYEES, AGENTS, AND VOLUNTEERS, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION WHETHER CAUSED BY THE NEGLIGENCE OF ANY PARTY AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OR MY CHILDREN AND/OR DEPENDENTS OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST BEND AS A RESULT OF ANY INJURY THAT I/WE MAY SUSTAIN.
