IMPACT Dance Complex Dance Waiver Form
Please review the following carefully. The study of dance involves inherent risks and can result in physical injury. This agreement contains important information and releases. If you have any questions regarding this Agreement, please feel free to inquire.
I acknowledge that the study of dance entails inherent risks and may lead to physical harm. I am fully cognizant of the risks and dangers involved. By participating in IMPACT Dance & Performing Arts classes, performances, rehearsals, or activities, there is a possibility of experiencing intense physical exertion and encountering unforeseen risks and injuries. As the participating student or as the parent or legal guardian acting on behalf of the participating student, and with the intention to be legally bound, I hereby release, discharge, and agree to hold harmless IMPACT Dance & Performing Arts, LLC, Tony Azzaro, Colleen Dougherty, their subsidiaries, and affiliates, as well as each of their respective managers, directors, teachers, members, shareholders, officers, agents, employees, representatives, and volunteers (referred to herein collectively as the "Released Parties"), from any liability whatsoever for any claims of any nature that may arise from or relate to my or my child's attendance, participation, or association with movement, dance, and related classes, rehearsals, or other activities organized, sponsored, or participated in by IMPACT Dance & Performing Arts, LLC or during any IMPACT Dance & Performing Arts, LLC activity or event (including recitals, competitions, fundraisers, etc.) taking place outside the studio (including travel to or from any such event) or any hazardous conditions of any property where the activities may occur (collectively referred to as the "Released Claims"). Furthermore, I covenant and agree not to file any lawsuits against the Released Parties for any Released Claims.
In the event of an emergency, I grant permission for my student(s)
to be transported to a hospital and receive medical treatment from a qualified professional.
I authorize IMPACT Dance & Performing Arts, LLC or any of its authorized agents to create and publish videos, films, photographs, interviews, or any other forms of media capturing me or my child's involvement in IMPACT Dance & Performing Arts, LLC activities or events. I also consent to the publication, broadcasting, or other utilization of the images and/or words for promotional purposes without expecting compensation for myself or my child(ren).
I certify that I am either 18 years of age or older or the legal guardian, representative, and/or parent of the student attending IMPACT Dance & Performing Arts (IMPACT Dance Complex) and possess the authority to sign this document on behalf of the minor. If I am signing for a minor student, all waivers, releases, assumptions of risk, terms of agreement, representations, acknowledgments, and certifications apply equally to said minor.

SCHOOL POLICIES:
ATTENDANCE
IMPACT Dance & Performing Arts, LLC (“Impact, Impact Dance, IDC or Impact Dance Complexâ€) was created to educate the whole dancer in various styles by cultivating technical proficiency and creativity. Students must attend class regularly and in a timely manner in order to progress. The school reserves the right to ask students that are late for class to sit out that class. If a student is repeatedly late or absent without notice, IMPACT Dance & Performing Arts may terminate lessons. IMPACT Dance & Performing Arts encourages its students to make up any missed classes by taking another class of an equal skill level. However, it is the student’s responsibility, not that of IMPACT Dance & Performing Arts, to sign up and attend any make-up classes. Missed classes will not be reimbursed. TUITION IS NON-REFUNDABLE. NO EXCEPTIONS.
STUDENT CONDUCT
No chewing gum, food or open containers are allowed in the dance studios. Students may not leave class without permission from the instructor. All students are expected to conduct themselves in a safe, courteous and responsible manner. Students are expected to be polite to each other as well as to IMPACT Dance & Performing Arts employees and guest faculty. Any rude or aggressive behavior from students or parents will not be tolerated. Any use of offensive language or harassment of IMPACT Dance & Performing Arts employees will result in dismissal without refund. There will be a $25 charge to anyone who opens the fire safety door, without instruction to do so or proper cause. No one, other than IMPACT Dance & Performing Arts employees, are permitted to be in private office space, or storage areas at any time unless the Studio Director(s) give permission.
PARENT CONDUCT
Parents are not to discipline a child that is not their own. Please report any problems to the IMPACT Dance & Performing Arts office and/or directors immediately. Students and parents are expected to be polite to one another as well as IMPACT Dance & Performing Arts employees. Any rude or aggressive behavior from students or parents will not be tolerated. Any use of offensive language or harassment of IMPACT Dance & Performing Arts employees will result in dismissal without refund.
DISMISSAL
Every IMPACT Dance & Performing Arts student is expected to behave in a disciplined, responsible and courteous manner when on IMPACT Dance & Performing Arts premises or participating in events or activities as an IMPACT Dance & Performing Arts student or performer. Any consistently disruptive behavior will be reported to parents. Rude or aggressive behavior from students or parents will not be tolerated. Any use of offensive language, drugs, alcohol or tobacco products at IMPACT Dance & Performing Arts will result in dismissal without refund. IMPACT Dance & Performing Arts reserves the right to suspend or expel any student, at any time, whose attitude, class attendance, work habits,
payment record, overall conduct or physical fitness for dance training is judged unsatisfactory by IMPACT Dance & Performing Arts directors, employees or representatives. All tuition paid to IMPACT Dance & Performing Arts on behalf of any discharged student is forfeited.
ATTIRE
Students are required to dress and arrange hair properly for class—this includes having correct shoes. IMPACT Dance & Performing Arts teachers reserve the right to prohibit improperly dressed students from participating in class. Please talk to the specified instructor for more information on appropriate dance class attire.
BEFORE/BETWEEN/AFTER CLASSES
Students should not be left at the studio (or performance locations) for excessive amounts of time before or after lessons, performances or rehearsals. Students are welcome to relax in the reception area and do homework between classes. Siblings must be monitored at all times by a parent, guardian or caretaker and the parent, guardian or caretaker assumes all responsibility of any action performed by the student or siblings when on IMPACT Dance & Performing Arts property. Students must arrive no sooner than 15 minutes prior to class time. IMPACT Dance & Performing Arts is not responsible for caring for students who are dropped off early or not picked up in a timely manner. If an emergency occurs hindering timely pick up, please notify the directors and/or office. If a director, teacher, employee or volunteer must wait for a student to be picked up after closing or pickup times, a childcare fee of $25 per 15 minutes will be charged.
HANDS-ON TEACHING
IMPACT Dance & Performing Arts teachers may make physical adjustments of students’ bodies during instruction. If you do not wish to receive physical adjustment (for yourself or your child), please inform the instructor prior to beginning class. For further explanation of this policy, or questions regarding why it is in place, please ask IMPACT Dance & Performing Arts staff.
INJURIES
By participating as an IMPACT Dance & Performing Arts student, parents, legal guardians of minors, students, and adult students waive, among other things, the right to any legal action against IMPACT Dance & Performing Arts and its affiliates and subsidiaries and their respective owners, employees and agents for any injury sustained on dance studio property, or at any IMPACT Dance & Performing Arts event away from school grounds (i.e., performances, shows, recitals, competitions, etc.), resulting from any activity conducted by the students before, during, or after class time. Students must have a completed liability release turned in BEFORE attending their first lesson(s).
INSURANCE
IMPACT Dance & Performing Arts does not carry medical insurance for its students. It is required that all students be covered by their own family medical insurance policies. If injury occurs, it is understood that a medical insurance policy in the student’s name or student’s family or guardian is the only source of reimbursement.
PAYMENT
All fees must be paid on time. Cash, checks, credit cards and money orders are accepted. There will be a $25 penalty for any returned checks. There will be a processing fee, determined by the card processor and IMPACT Dance & Performing Arts, added to all credit card transactions. Any account with a balance not paid by the posted due date will receive an additional late fee.
WITHDRAWAL FROM CLASSES
If it is necessary for a student to withdraw from classes, IMPACT Dance & Performing Arts must receive written notice during the first week of the month. Any pre-paid lessons following IMPACT Dance & Performing Arts’ receipt of written notice during the first week of the month will be refunded after the notice has been received. Tuition will be refunded at the rate it was paid, including any discounts or credits.
