Truckee Dance Factory General Terms and Conditions for Services
Herein stated are the terms and rates for student membership to Truckee Dance Factory LLC (“TDF”), located at 10975 Pioneer Trail #3, Truckee, CA 96161, for the term (“season”) beginning on September 3, 2024 and ending June 30, 2025.
Fees and Expenses.
One-time Registration Fee: Each student will be charged a one time non refundable registration fee for dance season beginning on September 5, 2023 and ending June 30, 2024 in the amount of $30.00 for a single student and $10.00 for each additional family members, not to exceed $50.00 for the family. This fee covers registration for one or more classes throughout the season.
Billing and Payment.
Tuition: Student tuition fees are assessed on a monthly basis and NOT on a per class basis. The monthly tuition rate remains the same regardless of the number of classes that fall within a given month. The monthly fee is based on enrollment, not attendance and will remain whether the student attends class or not. No refunds will be given for missed lessons. See “Class Make Up Policy”
Auto-Pay: Tuition will be charged on the 1st of each month via auto draft from a credit card or bank account. Credit card or bank draft information must be submitted upon registration through our secure, online payment processing system.
Tuition Options.
Tuition Option 1: Month to Month Commitment: This option is good for students who may not be able to commit to the entire season between September 3, 2024 through June 30, 2025, for any reason. In the event a dancer must withdraw participation from one or more classes, a thirty (30) day notice and a TDF withdrawal form must be submitted. Students will remain enrolled in their class until canceled by parent/adult student. See “withdrawal policy” section herein for specific instructions that must be followed in order to discontinue billing.
Option 1 Month to Month Tuition Rates:
Unlimited Rate (5 or more classes/week) = $450.00/month
4 classes/week=$400.00/month
3 classes/week=$300.00/month
2 classes/week=$200.00/month
1 class/week= $100.00/month
Tuition Option 2: [Discounted] Season Commitment: Here at Truckee Dance Factory we value commitment and dedication. TDF is offering a 15% “commitment discount” for signing a financial agreement obligating payment through the end of season. This option is great for dancers who want and will be able to commit to their enrolled classes from their date of registration through the end of the season ending June 30, 2025. To request this discounted rate please contact the studio. *This offer is only good for students enrolled before February 1, 2025.
Option 2: [Discounted] Season Commitment Rate:
Unlimited Rate (5 or more classes/week) = $385.00/month
4 classes/week=$340.00/month
3 classes/week=$255.00/month
2 classes/week=$170.00/month
1 class/week= $85.00/month
Withdrawal and Early Termination.
TDF reserves the right to terminate lessons to any students without notice, in such a case a refund for canceled lessons will be given, notwithstanding scheduled holiday breaks. Please note, planned holiday closures are not considered canceled lessons. No refunds will be given for costume fees, registration fees nor for classes not attended.
Option 1 Month to Month Cancellation: In the event a student must drop any or all classes the parent or guardian/adult student must notify TDF thirty (30) days prior to the intended last day, by completing an electronic withdrawal form which can be found on www.truckeedancefactory.com. Upon termination the final payment will be assessed and charged on the date the completed withdrawal form is received, regardless of student’s attendance during final 30 days. Withdrawal forms may not be supplanted by a verbal notification to a teacher or any staff member of TDF, neither over the phone or in person or any other way besides the electronic withdrawal form.
Option 2 Season Commitment Cancellation: Upon early termination a cancelation fee will be applied in the amount equal to the total “commitment discount”, which will be calculated by the difference of (option 2) and (option 1) for all paid months during the season prior to cancelation. In the event a student must drop any or all classes the parent or guardian/adult student must notify TDF thirty (30) days prior to the intended last day, by completing an electronic withdrawal form which can be found on www.truckeedancefactory.com. Upon termination the final payment will be assessed and charged on the date the completed withdrawal form is received, regardless of student’s attendance during final 30 days. Withdrawal forms may not be supplanted by a verbal notification to a teacher or any staff member of TDF, neither over the phone or in person or any other way besides the electronic withdrawal form.
Severe Weather Cancellations: In the event TDF closes due to extreme weather conditions, students are welcome to take a makeup class in its place provided it coordinates with their age and level. No refund or discounts will be given to monthly tuition fees in response to canceled class based on severe weather.
Government Mandated Shutdown: In general, in the event of a required closure mandated by a governmental agency or body and the required closure period exceeds one month, all contracts will be suspended and payment not required until TDF may, by law, reopen. If the studio remains out of operation beyond the date in which the season would have ended, the contract will expire on the date originally contracted.
Attendance/Tardiness: In the event a student is late to class, the instructor may require the tardy student to perform warm up exercises before joining the class, or alternatively may ask the student to sit out and watch. If a student is late too many times and falls too far behind, at the instructor’s discretion, the student may be removed from class and placed in a lower level.
Class Make Up Policy:
If the studio is closed or cancels a class, students will be welcome to attend a make-up class.
If a student is absent for any reason they will be allowed one make-up class per calendar month.
All make-up classes must be used within 30 days of the absence including snow day cancellations.
All make-up classes must be completed in an age and level appropriate class.
Parents/students must call or email to schedule a makeup class prior to the start of class.
If the desired makeup class is at capacity, make-up students will be on a standby/first come first serve basis and will not be guaranteed a spot in that class.
Care of Students: TDF is not responsible for the care and safety of students before or after class. It is understood that TDF will not be held responsible for supervision outside of the classroom. Young children are not to be left at the school for excessive time periods before or after their classes.
Injuries: Parents, legal guardians of minors, and students waive the right to any legal action for any injury sustained on TDF property resulting from normal dance activity or any other activity conducted by the students before, during or after class time or TDF performances or events.
I further understand that there are specific risks of physical or property damages, losses, or injury that may result from my or my child’s participation with TDF, and I voluntarily assume the risks associated with such participation.
Emergencies: Parents/adult students are responsible for keeping emergency contact info up to date and accurate within your account. I authorize Truckee Dance Factory and their agents, employees, representatives and contractors, to arrange for or provide such medical assistance to me or my child as any of them deems necessary, and authorize any physician, other medical or paramedical provider, and any medical facility to provide medical or surgical care, including without limitation anesthetization and hospitalization, which any of them may determine to be necessary or advisable, pending receipt of a specific consent from me. If my condition renders me incapable (as determined by Truckee Dance Factory and/or medical provider) of providing a specific consent at the time that medical provider present determines any treatment to be necessary and/or advisable in such the medical provider's sole discretion, I authorize such that I or my child may receive as a result of injuries or illness suffered during my attendance and/or participation in Events or Activities.
Photo/Video Waiver: I understand that Truckee Dance Factory LLC from time to time produces audio-visual programs, promotions, and other materials. I (and my Guardian if under 18) hereby grant Truckee Dance Factory LLC and its agents, successors, assigns and licensees the perpetual right to use the registered dancer’s name, likeness, biographical information, photographs, voice, personal characteristics, and other personal identification (collectively "Likeness") and any digital, videotape, sound and audio-visual recordings in any way (collectively "Recordings") in any and all manner and media, now known or hereafter devised, throughout the world, for any and all purposes including, without limitation, in productions and in connection with the advertising and promotion of productions and/or Company, provided that Truckee Dance Factory LLC is under no obligation to exercise any of the foregoing rights.
Email Communications: TDF will communicate important information such as fee announcements/due dates, class closures/cancellations, extra rehearsals etc. primarily through email. Parent/adult student agrees to keep email addresses up to date and frequently check for info emails from TDF. TDF does not share email addresses or any private info and will only use such info for communications regarding dance training at TDF.
Electronic Signature Agreement: By selecting the "I Accept" checkbox, I am signing this agreement electronically. I agree this electronic signature is the legal equivalent of my manual signature on this agreement.
I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
