By signing this release, Waiver and Assumption of Risk (“Release”), I, on behalf of my child(ren) and or myself, and the heirs, executors, agents, assigns, and representatives of myself and/or my child(ren), hereby indemnify, release, and forever hold harmless Nancy Chippendale’s Dance Studios Inc., Nancy Chippendale's Dance Studios LLC, as well as its subsidiaries, parent companies, affiliates, owners, officers, directors, instructors, staff, employees, volunteers and locations of classes (all of which are collectively referred to herein as “Studio”) from any and all claims of liability arising from any accident, personal injury, death, or property loss or damage sustained by me/my child/myself/the minor child for whom I am a legal guardian (hereinafter referred to as “Student”). The Release extends to every claim, demand or liability of any kind based on any injury or damaged described below.

I understand that dance activities as conducted and taught at the Studio have inherent risks of injury. These risks include, but are not limited to, muscle pain and pulls, broken bones, ankle injuries and other personal injury. I recognize that the Student is exposing himself/herself to such risks when undertaking dance activities. I understand that these risks cannot be fully eliminated without jeopardizing the essential qualities of the dance activities. The Student and/or his or her parent/legal guardian assumes and accept all risks of injury or damage resulting from such dance activities. The Student’s participation in the activity is purely voluntary, and the Student elects to participate, and I join in that election, in spite of the risks.

I understand and acknowledge that because of the physical nature of dance activities, there may be physical contact between the Studio and the Student during rehearsals, shows, workshops, productions, and especially during dance instruction. I understand that at times for proper instruction and safety, physical contact is required and necessary. I agree that the Studio is not responsible for any property loss or damage suffered by the Student, or any guests or parents of the Student, which result upon entry into or presence in the studio or its surrounding property.

I understand and acknowledge that by signing this Release, I declare that the Student is in good health, with no physical conditions that might prevent his/her/my participation in potentially strenuous and rigorous dance activities and other training and performance connected with dance activities.

I understand that I have been advised of the need for the Student to be covered by adequate insurance to cover any injury or damage that may be suffered while participating and I have obtained such insurance or agreed to bear the costs of any such injury or damage myself.

I understand the terms of this Release and have had the opportunity to consider and discuss it with such individuals and advisors as I deem appropriate. By signing and dating this Release, I confirm that I have read the Release in full, and that I understand its terms, and that I agree with those terms. I further confirm that by signing this Release, I acknowledge that if the Student is hurt during participation in this activity, I may be found in a court of law to have waived my right and any right of the Student to maintain a lawsuit against the Studio on the basis of any claim which is released hereby. In consideration of the Students’ being permitted by the Studio to participate in the activities provided by the Studio, I further agree to hold harmless and indemnify the Studio for any and all claims which are brought by or on behalf of any Student who is minor and which are in any way connected with the activities performed at the studio by any such minor student.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my or my child(ren)’s attendance at the Studio or participation in Studio programming (“Claims”). On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge and hold harmless the Studio of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Studio.

Upon enrollment, all dancers grant permission to Nancy Chippendale's Dance Studios to use their image/likeness online, in print, or on television to promote the studio or offer virtual and online instruction. This usage may include (but is not exclusive to) displaying publicly, distributing or publishing photographs and/or video for use in materials that include, but may not be limited to printed materials (i.e. - brochures, newsletters), online and offline advertising and promotion, videos and digital images for use on social media or virtual and online instruction.

I, the undersigned, give permission for Nancy Chippendale's Dance Studios to use video footage and / or photographs of my child. I acknowledge that I am giving unrestricted permission for my child's image to be used in print, video, and digital media. I agree that these images may be used by the Studio for a variety of purposes and that these images may be used without further notification.

Assumption of the Risk and
Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. According to the Centers for Disease Control and Prevention, senior citizens and individuals with underlying medical conditions are especially vulnerable.

The Studio has taken enhanced health and safety measures – for its students, instructors, staff, employees, and other guests, and has put in place preventative measures to attempt to reduce the spread of COVID-19. You must follow all posted instructions when visiting the Studio, and the Studio reserves the right to change, remove, or modify any and all instructions at its sole discretion. Despite these efforts, however, the Studio cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Studio could increase your risk, your child(ren)’s risk, and/or your family’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren), myself, and anyone I bring to the Studio may be exposed to or infected by COVID-19 by attending the Studio and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Studio may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Studio instructors, employee, staff, and program participants and their families.

I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my or my child(ren)’s attendance at the Studio or participation in Studio programming (“Claims”). On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge and hold harmless the Studio of and from the Claims, including all liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Studio, whether COVID-19 infection occurs before, during, or after participation in any Studio program.
