The parent/guardian is financially responsible for payment before services or goods are rendered. Any and all tuition/ fees paid are non refundable.Tuition is due on the 1st of every month. There will be a $15 late fee added to all tuition payments made after the 5th of the month. Student absences do not affect tuition prices. Tuition remains the same whether it is a short 2 week or a long 5 week month. Proper dance attire should be worn for all classes. Parents are required to notify us in writing of any physical condition of a student of which we should be aware. There is a $25 charge for all returned checks. In signing this contract, you are binding yourself, and any other person seeking to assert claim on your behalf, that the New Attitude PAC faculty, or staff associated with any of our dance programs shall be released from liability for any illnesses or injuries that occur while attending the school or our off-campus programs. We are not responsible for loss or damage to personal property. I further agree to abide by the rules and understand all rules, including payment and refund policies, and I agree to comply with them. Permission is hereby granted to transport my child to a doctor or hospital in case of serious illness or injury when unable to contact parents or guardians.
In the event that New Attitude Performing Arts Center, LLC must retain a collection agency or law firm to collect past due balances owed to NAPAC, you agree to pay any and all collection agency fees, court costs, attorney fees or incidental costs associated with collecting.
I authorize this payment in full to New Attitude Performing Arts Center. I understand that all payments are non refundable and nontransferable
I understand that tuition is due on the 1st of each month. I understand that I must pay an Annual Membership Fee, Costume Deposit(s), Costume Balance(s), Recital Fee, and Costume Rental Fee for Recital(s) I understand that I have until the 5th of each month to pay any fees with an alternate payment method. I acknowledge that my credit card will be charged on the 10th of each month for any outstanding payments. I understand that all other fees will be drafted on their due date
Verbal and Email consent of future registration changes: By signing this document you agree that verbal and/or email consent is sufficient in order to approve re-registrations, add or change classes for future registration and/or tuition changes, including consent to these policies and procedures.

Withdrawals and Refunds
All fees are non-refundable. No refunds will be given for missed lessons. Tuition Remains the same whether it is a short 2 week month or a long 5 week month
Students may withdraw at any time with 1 month notice prior to withdrawing.
In order to withdraw from lessons a parent, guardian, or adult student in person must complete and sign a withdrawal form provided by the studio. You must sign and submit a withdrawal form in order to be dropped from class and avoid automatic tuition withdrawal on the due date of the next month. No refunds on tuition will be given because of late withdrawal notice.
No withdrawals will be accepted after April 1st, except for private music students who are registered for ongoing lessons.

Substitutes, Snow Days, and Make Up Lessons
NAPAC reserves the right to provide a substitute instructor if the regularly scheduled instructor is unable to attend a lesson. If NAPAC cannot arrange a substitute, any missed lessons will be made up. NAPAC reserves the right to replace an instructor with a new qualified instructor in the event an instructor is no longer with the studio, unavailable at a student's desired lesson time, or for any other reason.
There are no make up lessons for music or dance classes. No make ups or refunds will be given if a student misses a lesson.
Virtual classes will be utilized in the event of a state of emergency, pandemic, or any even that causes the studio building to close. These classes will be charged at normal tuition cost.
There will be no refunds or credits for any classes, lessons, workshops, or performances that are cancelled, moved to a virtual platform, or are unable to proceed as the result of venue damage/cancellation, weather, governmental orders, natural disasters, or pandemic
School Closures: In the event of inclement weather or other unexpected interruption, NAPAC may cancel classes.

WAIVER AND RELEASE OF LIABILITY
In consideration of the risk of injury while participating in Dance, Aerial Silks, Acting, Music, Cheerleading and/or Gymnastics, Acro, rehearsals, performances, Open Gym, Camps, Clinics, Birthday Parties, Fitness Classes (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge New Attitude Performing Arts Center LLC, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I am voluntarily participating in the aforementioned Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated with traveling to and from as well as participating in this Activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I understand that these injuries or outcomes may arise from my own or others' negligence, conditions related to travel, or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during this Activity.
I agree to indemnify and hold harmless New Attitude Performing Arts Center, LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If New Attitude Performing Arts Center, LLC incurs any of these types of expenses, I agree to reimburse New Attitude Performing Arts Center, LLC.
I acknowledge that New Attitude Performing Arts Center LLC and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of New Attitude Performing Arts Center, LLC.
I acknowledge that this Activity may involve a test of a person's physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I acknowledge that I have carefully read this "waiver and release" and fully understand that it is a release of liability. I expressly agree to release and discharge New Attitude Performing Arts Center, LLC and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring a legal action against of New Attitude Performing Arts Center, LLC.
for personal injury or property damage. To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of of New Attitude Performing Arts Center, LLC.

In the event that I should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance. In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant, or Legal Guardian if Participant is a minor, and of New Attitude Performing Arts Center, LLC.
agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
I, the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.
