General Liability Release and Waiver of Claims for Dance Instruction

"I", "my", "myself" refers to the person participating in the dance classes provided by Forty106 Dance Project, Limited.
"My child(ren)" refers to children registered under the family of the signee.

General Liability Waiver
I, of my child agree to participate in dance instruction given by Forty106 Dance Project, Limited. I acknowledge that I understand the nature of the activities I/or my child will be participating in and that I am/or my child is in the proper physical condition and capable of participating in the rated activities, understanding that Forty106 Dance Project, Limited, is not in any way responsible for making such a determination.

I understand that there are risks of physical injury, illness and/or death associated with, arising out of an inherent to the participation in classes, activities, programs associated with this company. In recognition of this acknowledged risk of injury, I knowingly and voluntarily waive all rights and/or causes of action of any kind, including any and all claims of negligence arising as a result of such activity from which liability could accrue to Fort106 Dance Project, Limited, its officers, agents, employees, instructors, subsidiaries, parent corporations, and all affiliated entities.

In consideration of my/or my child’s enrollment in any dance instruction program, I understand and agree on behalf of myself and/or my child, to release, hold harmless, and discharge Forty106 Dance Project, Limited from all claims, costs, liabilities, expenses or judgements, including attorneys’ fees and court costs for any occurrences in connection with any dance instruction. I assume all risks to myself/or my child in connection with any instruction and further release Forty106 Dance Project, Limited and its owners and employees from liability for any injury sustained by myself/or child while enrolled in any dance instruction program, including all risks reasonably connected with such activity whether foreseen or unforeseen.


I understand that Forty106 Dance Project, Limited is not responsible for myself or my child or other persons under my supervision who are left unsupervised in the common areas and areas surrounding the dance studio (Steamboat Dance + Fitness) and that Forty106 Dance Project, Limited will only be supervising me/my child when participating in scheduled dance activities, programs, or instruction. I understand that Forty106 Dance Project, Limited is not responsible for personal property that is lost, damaged, or stolen while I or my child is at or on the studio's (Steamboat Dance + Fitness) property.

I acknowledge and agree that it is my sole responsibility to maintain my own accident and health insurance coverage that provides adequate coverage for myself and my child participating in Forty106 Dance Project, Limited activities and that Forty160 Dance Project, Limited does not provide accident or health insurance for those participating in its instruction, activities, or programs.


Image Release
I authorize and agree that Forty106 Dance Project, Limited may take and use photographs, videos or likenesses of myself or my child as needed for its record-keeping, advertising, and/or public relations projects and that I have no rights to the same and will not be compensated for the same. I understand that these materials will become the property of the organization and will not be returned. I hereby irrevocably authorize the organization to edit, alter, copy, exhibit, publish or distribute these images for the purposes of publicizing the organization’s programs or for any other lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image. I hereby hold harmless
and release and forever discharge the organization from all claims, demands, and causes of auction which I, my heirs, representatives, executors, administrators, or any other persons action on my behalf or on behalf of my estate has or may have reason for this authorization. Furthermore, I grant permission to use my statements that where given during an interview or otherwise, with or without my name, for the purpose of advertising and publicity without restriction.


Agreement of Classroom Protocol
I understand that the accepted practice and methodology of professional dance training entails “hands on” and other forms of physical contact with instructors and other students, and that this is necessary for a student to learn at an appropriate pace. I understand that if there is currently, or ever would be, any reason why I should not be touched, or should only be touched in a specific way, this is my responsibility to inform EACH instructor as to what is acceptable, and
to discuss any related physical or mental issues with them.


Medical Emergencies
I understand Forty106 Dance Project, Limited’s agents, employees, owners, administrators, and instructors are NOT medical practitioners of any kind. With this in mind, I hereby release and grant permission to any Forty106 Dance Project, Limited agent, employee, owner, administrator, or instructor to render temporary first aid to myself or my child/children (if a parent or guardian cannot be reached) in the event of injury or illness, and if deemed necessary by Forty106 Dance Project, Limited staff to call emergency services to seek medical help. Forty106 Dance Project, Limited cannot dispense any form of medication.



I HAVE BEEN FULLY INFORMED AS TO THE CONTENTS OF THIS RELEASE AND HAVE READ THE SAME PRIOR TO SIGNING. I HAVE VOLUNTARILY AND OF MY OWN FREE WILL SIGNED THIS DOCUMENT IN EXCHANGE FOR THE PRIVILEGE OF PARTICIPATION. I WARRANT THE INFORMATION I HAVE PROVIDED IS COMPLETE AND CORRECT AND THAT I DO HAVE AUTHORIZATION TO SPEAK AND ACT ON BEHALF OF ALL PARTICIPANTS I ENROLL IN CLASSES, ACTIVITiES, AND PROGRAMS WITH FORTY106 DANCE PROJECT, LIMITED.
