I, __________________________, the Do It With Class Young Peoples' Theatre Inc. ("DIWC") Company Member Participant (the Participant) and the Participant’s parent or legal guardian, if the Participant is under the age of eighteen (the Participant's Parent), personally and on behalf of the Participant, hereby, in consideration of DIWC allowing the Participant to take part in the activities of DIWC, acknowledge, agree and consent to the terms of this document and acknowledge its effect as a binding legal agreement (the “Agreement”).
1. DIWC and its directors, officers, agents, contractors, employees, volunteers or organizers (the DIWC organization) are not responsible for any injury, personal injury, damage, property damage, expense, loss of income or loss of any kind suffered by a Participant during, or as a result of, the activities of DIWC, caused in any manner whatsoever, including, but not limited to, the negligence of the DIWC organization.
2. The Participant and the Participant's Parent agree:
(a) that the sole responsibility for the Participant's safety remains with the Participant and the Participant's Parent; (b) to assume all risks arising out of or associated with the Participant's participation in the activities of DIWC, including the possibility of the Participant’s personal injury, death, property damage, expense and related loss, including loss of income, resulting from the Participant’s participation in the activities of DIWC; and (c) that they are not relying on any oral or written statement made by the DIWC organization to participate in DIWC.
3. I consent to the Participant acting, dancing, rehearsing, performing, and taking part in the activities of DIWC. Such consent includes traveling by public or private transportation to such locale(s) where DIWC activity takes place. The Participant and the Participant’s Parent hereby waive and forever release DIWC and its directors, officers, agents, contractors, employees, volunteers or organizers (the “DIWC organization”) from any and all claims we may have at any time now or in the future against the DIWC organization for any claim at any time now or in the future, which might arise for damage, injury or loss of any kind suffered or incurred by either the Participant or the Participant’s Parent as a result of our participation or involvement with the DIWC organization, regardless of who caused such claim, or how same arose, even though such claim may have been caused by any manner whatsoever, including but not limited to the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the DIWC organization and including with respect to any action or claim related to the Participant becoming exposed to or infected by COVID-19 as a result of or from any action, omission or negligence of the Participant or the Participant’s Parent or others, including but not limited to the DIWC organization. The Participant and the Participant’s Parent forever indemnify the DIWC organization for any and all liability for any claims that might arise from or relate to the Participant’s participation in the activities of DIWC.
4. The Participant is participating voluntarily and understands and assumes the risks associated with COVID-19, including that COVID-19 is contagious in nature and the Participant may be exposed to or infected by, COVID-19 and such exposure may result in personal injury, illness, permanent disability, or death and could lead to exposure and further spread of COVID-19 to other individuals. The Participant and the Participant’s Parent on behalf of the Participant, agree to assume those risks, including but not limited to exposure and being infected. The Participant and the Participant’s Parent agree to comply with any DIWC organization requirements to provide any consent or declaration for production participation or health screening information.
5. The Participant and the Participant’s Parent agree to the Participant:
(a) singing while not wearing a mask, in the proximity of at least 4 meters to others who are also singing while not wearing a mask, for the purpose of performance or film or audio recording and associated rehearsals; and (b) acting and speaking, but not singing, while not wearing a mask, in the proximity of fewer than 2 meters to others who are also acting and speaking, but not singing, while not wearing a mask, for the purpose of performance or film or audio recording and associated rehearsals.
6. I consent to the use of company member rehearsal, production or other company-related photographs/video for all legal purposes (including, without limitation, digital presentation or production, print, advertising, display, editorial, packaging, promotion, internet, television, social media etc. as well as any future media) Nothing herein shall permit the use of these photographs/videos in a defamatory context.
7. This Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Saskatchewan and if any portion is held invalid, the balance shall, notwithstanding, continue in full legal force and effect. This Agreement will be governed by the laws of Saskatchewan.
8. The signatures below are an acknowledgement that the undersigned have read this Agreement and understand it, that they have executed this Agreement voluntarily, and that this Agreement is to be binding upon themselves, their heirs, their spouses, parents, guardians, next of kin, executors, administrators and legal or personal representatives.
