Waiver and Release
All participants must complete this Agreement, Release and Waiver of Liability in order to participate in any Activities at JJ’s Dance Studio’s facilities..
In consideration of being permitted access to the JJ’s DANCE STUDIO LLC facility located at 13910 S Jog Rd. Suite 101-102, Delray Beach, FL, 33446 (the “Facilityâ€) and viewing, attending, participating in or assisting others in viewing, attending or participating in any activities or events at said Facility (collectively “Activitiesâ€), on behalf of myself, or a minor child or ward, heir, next of kin, personal representative, successor or assign: (the terms “Iâ€, “me†and “my†as used herein shall include myself and my minor child(ren))
(1) I ACKNOWLEDGE, UNDERSTAND, DECLARE AND AGREE THAT:
(a) To the best of my knowledge, I am in good physical health and have no disease or injury that would be aggravated by participating in Activities;
(b) The Activities may involve RISK OF INJURY TO ME, INCLUDING DEATH, LOSS OR DAMAGE TO ME OR MY PROPERTY, or other consequences, which might result not only from my own actions, inaction or negligence but also the actions, inaction or negligence of others, or the conditions of the premises or of any equipment used;
(c) There may be OTHER RISKS not known or not reasonably foreseeable, and understanding ALL of the above,
(2) I ASSUME ALL OF THE ABOVE RISKS AND RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, INDEMNIFY AND COVENANT NOT TO SUE:
(a) JJ’s DANCE STUDIO, LLC, their employees, agents or volunteers, trainers, owners, operators and managers, as well as the respective administrators, officers, directors, agents, representatives, employees, volunteers, coaches, trainers, instructors, officials or any other individuals affiliated with the Activities;
(b) any affiliated subsidiary, successor, organization, or related companies or businesses, other participants, participating or sponsoring municipalities, governmental agencies, international organizations, agencies, sponsors, or advertisers, the respective administrators, officers, directors, agents, representatives, employees or volunteers of such entities or organizations;
(c) owners, lessors and lessees of the Facility used to conduct the Activities FROM ANY AND ALL LIABILITY FOR INJURY, INCLUDING DEATH, LOSS OR DAMAGE TO PERSON OR PROPERTY, OR ANY OTHER CONSEQUENCE related to or arising out of, including travel enroute to and from, the Activities.
(3) Medical Treatment:
(a) In the event of an emergency, I authorize JJ's Dance Studio and its representatives to secure medical treatment for me if deemed necessary. I understand that I am solely responsible for any costs associated with such treatment.
(4) Photo Release:
(a) I hereby grant JJ's Dance Studio the irrevocable and unrestricted right to use and publish photographs or videos of me/my child taken during dance classes for promotional, educational, or other purposes without compensation to me. I understand that these images may be used in print publications, online, or in any other media. I waive any right to inspect or approve the finished product wherein my likeness appears. I understand that once my image is published, it may be distributed with a wide audience.
(5) Payments:
(a) By enrolling in classes at JJ's Dance Studio, parents and students agree to fulfill all financial obligations by making timely payments to JJ's Dance Studio. Payments must be made according to the agreed-upon schedule provided upon enrollment. Additionally, a minimum of 30 days' notice is required for the cancellation of tuition. Failure to provide adequate notice may result in charges for the following month.
(b) In the event of non-payment, JJ's Dance Studio reserves the right to take necessary actions to recover the outstanding balance, including but not limited to, engaging a collections agency. Any fees incurred as a result of collection efforts will be the responsibility of the delinquent account holder.
