NGDC is committed to providing a safe environment for all dancers, instructors, and staff. This concussion policy is designed to promote awareness, outline procedures for managing concussions, and ensure a safe return to dance activities after a suspected concussion.

Policy:

Education and Awareness:
All dancers, instructors, and staff members will receive education on concussions, including common symptoms and how they can occur during dance activities. Informational resources will be provided in areas of the studio to promote concussion awareness.

Recognition and Reporting:
Dancers, instructors, or staff who suspect a concussion in themselves or others must immediately report it to the NGDC Company Director or designated staff member. Symptoms to watch for include but are not limited to headache, dizziness, confusion, sensitivity to light or noise, nausea, and balance problems.

Protocol for Suspected Concussions:
Upon suspicion of a concussion, the dancer will be removed from dance activities immediately and observed in a quiet, supervised area. The studio manager or designated staff member will contact the dancer's emergency contact and advise them to seek medical evaluation by a healthcare provider trained in concussion management.

Medical Evaluation and Clearance:
A dancer suspected of having a concussion must obtain medical evaluation from a qualified healthcare provider. The healthcare provider will determine when the dancer is medically cleared to safely return to dance activities at the studio.

Return-to-Dance Protocol:
Once medically cleared, the dancer will follow a gradual return-to-dance protocol designed in collaboration with their healthcare provider and the studio, including but not limited to, medical clearance documentation provided to the NGDC Company Director. This protocol will include stages of increasing activity levels under the supervision of the instructor or designated staff member.

Documentation and Confidentiality:
The studio will maintain records of reported concussions, actions taken, and clearance status in a confidential manner. Information will be shared only with those directly involved in the dancer's care and safety.

Equipment and Environment:
NGDC will regularly assess and maintain safe dance environments and equipment to minimize concussion risks. Flooring and lighting will be suitable for dance activities to reduce the likelihood of falls and accidents.

Parent/Guardian Communication:
Parents or guardians will be promptly informed if their child is suspected of having a concussion. They will receive clear instructions regarding recommended medical evaluation and clearance before their child can return to dance activities.

Training and Review:
All instructors and staff members will receive initial training on this concussion policy and annual updates as needed. The policy will be reviewed annually to ensure alignment with current best practices and regulations.

Next Gen Dance Company is dedicated to maintaining the health and safety of its dancers, instructors, and staff. By adhering to this concussion policy, we aim to prevent and effectively manage concussions, promoting a safe and supportive dance environment for everyone involved.

By agreeing to this waiver with its terms and conditions, you are hereby agreeing that you have read this General Liability Waiver with Acrobatics Provision and fully understand its terms. You understand that you have given up substantial rights by signing it, and sign it voluntarily without any inducement. Further, you acknowledge and agree to the following terms and conditions as a prerequisite to you or your child’s participation in dance classes, workshops, rehearsals, performances, and any other activities (collectively referred to as "Activities") organized by Next Gen Dance Company (henceforth the "Studio"):

Handbook: I understand and acknowledge that I have read the Next Gen Dance Company Handbook. I agree to follow those terms and conditions as a condition for my or my child's participation in dance activities.

Assumption of Risk: I understand and acknowledge that my or my child’s participation in dance activities, including Acrobatics (also referred to as “Acro”), involves inherent risks, including but not limited to physical exertion, contact with other participants, use of studio facilities and equipment, and the risk of injury. I voluntarily assume all risks associated with my or my child’s participation.

Release and Waiver of Liability: In consideration for being me or my child being allowed to participate in the Activities, I hereby release, waive, discharge, and covenant not to sue Next Gen Dance Company, its owners, directors, instructors, employees, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Activities, whether caused by the negligence of the Released Parties or otherwise.

Indemnification: I agree to indemnify and hold harmless the Released Parties from and against any and all liabilities, claims, actions, damages, costs, or expenses (including reasonable attorney's fees) arising out of or related to my or my child’s participation in the Activities or any breach of this Agreement.

Acrobatics Specific Risks: I understand that my or my child’s participation in acrobatics involves additional risks beyond those typically associated with dance, including but not limited to risks related to flips, lifts, partner work, and aerial movements. I acknowledge that I am or my child is physically and mentally capable of participating in acrobatics and have been given the opportunity to ask questions regarding the risks involved.
Medical Authorization: I authorize the Studio and its representatives to obtain medical care for me or my child in case of injury or illness during my participation in the Activities, if the parent/guardian is unable to communicate consent at the time.

Photography and Publicity: I consent to the use of photographs, videos, or other likenesses of me or my child taken during the Activities for promotional purposes by the Studio without compensation. I understand that in order to withdraw my consent, I must provide the Studio with written notice of withdrawing of my consent.

Miscellaneous: This Agreement constitutes the entire agreement between me and Next Gen Dance Company regarding my or my child’s participation in the Activities, superseding any prior agreements or understandings. This Agreement may only be modified in writing and shall be governed by the laws of the State of Nebraska within the United States of America.

By agreeing to this payment policy with its terms and conditions, you are hereby agreeing that you have read this Payment Policy and fully understand its terms. You understand that you have given up substantial rights by signing it, and sign it voluntarily without any inducement. Further, you acknowledge and agreeing to the following terms and conditions as a prerequisite to you or your child’s participation in dance classes, workshops, rehearsals, performances, and any other activities (collectively referred to as "Activities") organized by Next Gen Dance Company (henceforth the "Studio"):

1. Payment Terms: I understand that Payment to the Studio is due on a monthly basis and may include, but is not limited to, Tuition, Registration Fees, Costume Fees, Recital Fees, any fees incurred through participation with the Next Gen Dance Company Competition Team, and items from the Next Gen Dance Company store. By agreeing to this policy, I understand that I am responsible for any and all payments to be made unless otherwise agreed upon and in writing.

2. Methods of Payment: I understand that the Studio will accept cash, check, Debit/Credit Card, and Automatic Withdrawal. I further understand that the use of a Debit/Credit Card or Automatic Withdrawal comes with a processing fee that I am responsible for. I understand that the use of the payment systems with the Studio incurs a 3.50% processing fee for use of a Credit Card and 1.50% processing fee for use of a bank account. I understand that I will be responsible for payment of processing fees to the Studio.

3. Tuition: I understand that tuition payments are due one month in advance, on the first week of each month. Tuition for September is due at time of registration and October tuition is due the first week of September, and so on. Tuition is the same each month and is not adjusted because of holidays or unattended lessons. All tuition and fees are non-refundable. A $10.00 late fee will be added to the balance due on all accounts paid after the 15th of the month. A $30.00 fee will be added to all returned checks or insufficient funds for auto-payments. Monthly statements are not mailed out. Statement will be emailed to the address provided to the Studio at registration and can be access through the Studio Parent Portal.

4. Fees: I understand that I may be responsible for additional fees including, but not limited to, Recital Fees, Registration Fees, Late Fees, and Costume Fees.

5. Non-Payment: I understand that any student with an outstanding balance may not be admitted to class or allowed to perform in the recital until payment has been received. I understand that the Studio will provide reasonable efforts for accommodations, such as payment plans, in order to assure payment. I understand that further non-payment after these efforts have been taken may result in immediate removal from the Studio. I understand that failure to provide payment may result in additional legal actions being taken by the Studio.
