RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK

The undersigned, being of 18 years of age and/or the parent or legal guardian of child/children listed below (“Student(s)”), represent(s) that I/we understand the nature of dance and its related activities, including, but not limited to tumbling, stretching, and leaps and jumps (“Activities”), and all risks and possible injuries associated with the same. I/We fully accept and assume all such risks associated with Student’s participation in the Activities, and all responsibility for injury, losses, costs and damages, I/we or Student may suffer as a result of/or during Student’s participation in such Activities with Kreative Dance Complex, whether on site at the Kreative Dance Complex studio, at competitions or conventions, at recitals, at other practice or performance venues, or wherever located. I/We further acknowledge and agree my/our decision on whether or not Student may participate in such Activities has been made solely on my/our own and I/we have not been advised or otherwise influenced by Kreative Dance Complex, or any owner, teacher, employee or agent thereof.

I/we further acknowledge and agree as a part of the Activities, Student is likely to be photographed, videotaped, or otherwise digitally recorded while participating in the Activities with Kreative Dance Complex wherever such Activities are located at any given time. I/w authorize Kreative Dance Complex to use photographs, videotapes, film, and/or digital and/or electronic recordings, images or likenesses in which Student appears, including audio recordings of Student’s voice (collectively “Student’s Image”), for any advertising or promotional purposes, including, but not limited to brochures, Facebook, Instagram or similar social media sites, Kreative Dance Complex's website, newspaper and/or television. I give my consent that such Student’s Image(s) , and the plates, tapes, software and/or digital devices or hardware from which they are made shall be the property of Kreative Dance Complex, and Kreative Dance Complex shall have the right to duplicate, reproduce, and make other uses of Student’s Image(s) as it desires free and clear of any claim whatsoever on my/our part. A copy of this Release shall serve the same purpose as an original.

I/we further acknowledge and agree Kreative Dance Complex and its owners, teachers, employees and agents are not responsible for when or whether a Student leaves the studio building (the “Kreative Dance Complex Studio”), convention venues, competition venues, recital venue, and/or any other performance or training venue (collectively “the Venues”) and I/we acknowledge and agree I/we am/are responsible for the above-named Student in the event they choose to leave the Kreative Dance Complex Studio between classes with or without my/our permission or while they are at any other Venue. We recognize and acknowledge Kreative Dance Complex and its owners, teachers, employees and agents are not monitoring or able to monitor the activities of each Student outside of class at the Kreative Dance Complex Studio and/or during conventions, competitions, recitals or other performances at other Venues, and I/we acknowledge and agree I/we am/are solely responsible for the supervision of the above-named Student outside of class at the Kreative Dance Complex Studio.

I/we hereby waive and release Kreative Dance Complex, its respective owners, managers, directors, agents, officers, employees, and Kreative Dance Complex appointed parent volunteers/chaperones (collectively hereinafter “Kreative Dance Complex”), from any and all possible claims for injury to person or property which might arise in connection with Student’s participation in the Activities, wherever located, and/or use of Student’s Image(s), however used, and/or any injury to person or property which might arise in the event Student leaves the Kreative Dance Complex Studio between classes or while at any other Venue, including travel to or from any other Venue or to or from the Kreative Dance Complex Studio . I/we do not hold Kreative Dance Complex responsible for any accident or illness which might occur related to any Activities and/or Student leaving the Kreative Dance Complex Studio with or without my/our permission, or to Student while at any other Venues, and authorize the adult in charge, in my/our absence, should it be necessary, to secure the service of a doctor or other medical personnel at my/our expense.


I/we have read this RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK, and represent that I/we have signed it freely and without any inducement or assurance of any nature and I/we intend it to be a complete and unconditional release of all liability and agree that if any portion is held to be invalid the balance, notwithstanding, shall continue in full force and effect. We further acknowledge this Release shall remain in full force and effect while Student remains a student of Kreative Dance Complex.
