General Release of Liability (Minors)
The Undersigned, for himself or herself and the heirs, next of kin, executors, administrators, assigns or any of them, understands that the terms of this release of liability will be binding upon them. The Undersigned is aware that, by signing this Agreement, the Undersigned is releasing and waiving certain legal rights including the right to sue and to be awarded potentially substantial damages, which the Undersigned or his or her heirs, next of kin, executors, administrators and assigns have or may have against the Releasees.
The Undersigned acknowledges and understands that the COVID-19 pandemic involves unknown risks, hazards, and health effects as it is an unprecedented situation and a novel virus. With this knowledge, the Undersigned agrees to enroll in DFAD classes, camps, sessions or programs despite the unknown health risks and effects related thereto.
The Undersigned warrants the following statements are true and correct and understands that the Releasees have relied on them in entering into this release, waiver and indemnity agreement and in giving the Undersigned permission to enter the premises of Dancefusion Academy of Dance Ltd. (DFAD) and to participate in DFAD classes:
1. The Undersigned hereby agrees to indemnify and save and hold harmless the Releasees and each of them from any illness, loss, liability, damage or cost they may incur due to: (1) the presence of any action of the Undersigned in or about DFAD; (2) the participation in DFAD classes whether caused by the negligence of the Releasees or otherwise; or (3) acquiring or thereby testing positive for the COVID-19 virus or potentially being exposed thereto.
2. The Undersigned agrees to indemnify and hold harmless the Releasees for any and all claims made against any of the Releasees by any person, including any claim or action by or on behalf of my spouse, dependents, or other third parties, for damages suffered or costs incurred arising out of or related to any aspect of the said minor’s participation in any DFAD class, camp, session or program, without limitation.
3. The Undersigned hereby agrees to waive any claim to reimbursement of fees paid for attendance to any DFAD class, camp, session or program in the event of a public health-ordered business closure or any event related thereto, however, DFAD will automatically commence online classes.
4. The Undersigned hereby agrees to perform any required health and/or symptom screenings as a condition of continued enrollment at DFAD. The Undersigned agrees to forego attendance at DFAD in the event of any display or report of COVID-19-related symptoms being experienced by the DFAD attendee including, but not limited to cough, fever, runny nose, sore throat, shortness of breath, or any other cold-like symptoms.
5. The Undersigned acknowledges their positive obligation to disclose to DFAD any COVID-19-related symptoms they may be experiencing including, but not limited to cough, fever, runny nose, sore throat, shortness of breath, or any other cold-like symptoms.
6. The Undersigned hereby allows DFAD to conduct temperature screening and symptom monitoring throughout the duration of the DFAD class, camp, session or program, as required to satisfy public health guidelines.
7. The Undersigned gives consent to whatever medical care might be provided or available on the premises, including the use of any PPE or physical distancing measures required under COIVD- 19 public health guidelines.
8. The Undersigned individually is fully aware of the risks and hazards inherent in entering the premises of DFAD or in participating in any class, camp, session or program held in or upon the DFAD premises. The Undersigned is fully aware that all activities associated with participation in DFAD classes is a calculated risk sport and contains inherent risks and dangers that no amount of care, caution, instruction, or expertise can eliminate. The Undersigned individually herby voluntarily assumes all risks of loss, damage or injury that may be sustained by them, or any of them, any damage to any property of the undersigned, or any of them while in or upon the DFAD premises.
9. No oral representatives, statements, or inducements apart from this written agreement have been made.
10. The Undersigned grants permission for DFAD to use any photographs and/or video for advertising, promotional and publicity purposes.
11. Costume & festival fees will be automatically billed to your online account and must be paid in full by November 15th. Please contact the office prior to November 15th to make payment arrangements. Balance must be paid by Feb 28.
12. Registration and September fees are non-refundable. Fees are based on 35 weeks of instruction. Payment options are available (Fee in full or monthly payments). NSF cheques are subject to a $35 administration fee. Repayment must be made with a certified cheque, debit or credit card.
13. Refunds for class withdrawal will only be given with one month's written notice to the office. If notice is not given, you will be charged the following month’s fees.
The Undersigned expressly agrees that the foregoing release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the province of Alberta and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I have read this Release of Liability and fully understand its content and meaning, and I sign it of my own free will. As a legal guardian of REGISTERED STUDENT, I consent to the above terms and conditions and grant my permission for the above named minor to attend and participate in any Dancefusion Academy of Dance Ltd. class, camp, session or program.
