NOTICE TO PARENT/GUARDIAN
InSync Moves Pty Ltd has taken care to develop and undertake its dance lessons to promote healthy activity in a fun and safe environment. However, like many physical activities, participation in our activities and programmes carries risk of injury and loss.
It is a condition to the Child's participation in our programs and activities that you, the undersigned Parent/Guardian of the Child, sign this document to acknowledge that:
1. you have read and understand its terms;
2. participation in the Activities may expose you and the Child to risk of harm; and
3. you accept FULL responsibility for exposing yourself and the Child to such risks.
PARENTAL RESPONSIBILITY AND CONSENT
I, the undersigned Parent/Guardian of the Child, understand and accept that, in respect of my and my Child's participation in the Activities, it is my responsibility:
1. to ensure that I consider and understand the risks, dangers, hazards and consequences of injury inherent in the Activities;
2. to determine, taking into consideration those risks and the Child's behavioural characteristics, physical health and abilities, whether the Child should be permitted to participate in the Activities;
3. to ensure that InSync Moves is informed as soon as practicable in respect of any condition which may affect my Child's health or performance in any way;
4. to ensure that the Child is picked up from the Activities at the time the Activities are scheduled for completion; and
5. to provide emergency medical information regarding me and the Child.
ASSUMPTION OF RISKS
I am aware of and now freely accept and assume, for me and for the Child, responsibility for all risks to me or the Child in connection with the Activities. I consent to the free use of my and my child's name and pictures of me or my child in any broadcast, telecast, internet and print media by InSync Moves and any of InSync Moves assigns. In entering into this agreement I am not relying on any oral or written representations or statements made by InSync Moves with respect to the safety of the Activities other than what is set forth in this document.
WAIVER, RELEASE AND INDEMNITY
In return for InSync Moves permitting me and the Child to participate in the Activities:
1. I release InSync Moves and its heirs, assigns, agents, contractors and employees (Released Parties) from liability for any claims, demands, damages, expenses, costs, actions or causes of action in respect to death, injury, loss or damage to my person, the Child or my property, however caused and including by negligence of any of the Released Parties, arising out of or directly or indirectly in connection with my participation in the Activities.
2. I agree to compensate the Released Parties for all losses, injuries, deaths, damages, Claims, breaches of contract, failure by me or my Child to perform obligations and expenses of any kind, including those that are not contemplated at the time of signing, that any of the Released Parties may incur and for all complaints, demands, claims, actions, suits, judgments and orders (Claims) for any and all Losses of any kind anyone else may suffer, incur or experience directly or indirectly in connection with my or the Child's participation in the Activities. I hereby agree that this Waiver, Release and Indemnity extends to all acts and omissions of the Released Parties, including negligence, and is intended to be as broad and inclusive as permitted by the laws of New South Wales and that if any portion of this Waiver, Release and Indemnity is held invalid, it is agreed that the balance shall remain in full legal force and effect. This Waiver, Release and Indemnity is binding upon myself, the Child and each our respective heirs, executors, administrators, legal representatives, assigns and anyone else capable of making a claim on my behalf or the Child's behalf now or in the future.
I have read and understand the contents and intent of this acknowledgment of risk, waiver, release and indemnity in its entirety and I agree that is binding on me.
