GULFCOAST DANCE, INC., RELEASE AND WAIVER OF LIABILITY
Please read the agreement completely and carefully before agreeing.
By selecting "I Agree" below, or by signing up for an activity funded or affiliated with GULFCOAST DANCE, INC., or authorizing a person to sign up for a GULFCOAST DANCE, INC., funded or affiliated activity on your behalf, you agree to waive your legal rights. Once you agree to this Release, you will be unable to bring a lawsuit under certain circumstances.
NOTICE TO A MINOR CHILD'S LEGAL GUARDIAN
You are agreeing to let your child engage in a potentially dangerous activity. You are agreeing that, even if GULFCOAST DANCE, INC., uses reasonable care in providing this activity, there is a chance your child may be injured or killed by participating in this activity because there are certain dangers inherent in the activity which cannot be avoided or eliminated. By signing this agreement, you are giving up your child's right and your right to recover from GULFCOAST DANCE, INC., and its directors, officers, employees or agents in a lawsuit for any personal injury, including death, to your child or any property damage that results from the risks that are a natural part of the activity.
1. ACCEPTANCE OF INHERENT POTENTIAL RISK
You understand that the use of any facilities and equipment used during a GULFCOAST DANCE, INC., activity tests a person's physical limits and carries with it a potential for serious injury, such as injuries caused by equipment malfunctioning, defects in or improper maintenance of equipment or premises, inadequate supervision or instruction, intentional or unintentional misuse of the equipment (by you or others), the negligent acts of others with regard to the facilities and equipment (including the actions of any directors, officers, employees or agents of GULFCOAST DANCE, INC.), and other dangers inherent in strenuous physical activity. You are aware of and accept these risks.
2. ACCEPTANCE OF FULL SOLE RESPONSIBILITY
You understand and agree that it is your sole responsibility to determine whether you are sufficiently fit and/or healthy enough to safely participate in dance and to safely use the equipment and/or facilities used during a GULFCOAST DANCE, INC. activity. You also affirm that you will follow the instructions given by any directors, officers, employees or agents of GULFCOAST DANCE, INC.
3. RELEASE OF CLAIM OF INJURIES and ILLNESSES
You, for yourself, and for anyone else who can claim through you, hereby release GULFCOAST DANCE, INC., and its directors, officers, employees or agents from any claim (of any nature whatsoever) that you may have, now or in the future, for any injuries you incur or illnesses you contract while you are participating in a GULFCOAST DANCE, INC., activity (even if caused by the active or passive negligence of GULFCOAST DANCE, INC., and its directors, officers, employees or agents).
4. RELEASE OF CLAIM OF PROPERTY DAMAGE OR LOSS
You, for yourself, and for anyone else who can claim through you, you hereby release GULFCOAST DANCE, INC., and its directors, officers, employees or agents from any claims (of any nature whatsoever) that you may have, now or in the future, for any damage or loss to any of your property incurred while you participating in any GULFCOAST DANCE, INC., activity (even if caused by the active or passive negligence of GULFCOAST DANCE, INC., and its directors, officers, employees or agents).
5. PERMISSION TO RECORD
You understand that during the course of classes, performances and/or other GULFCOAST DANCE, INC., activities, you may be recorded or photographed for use in future Dance Bochette materials and publications.
6. You acknowledge and agree that GULFCOAST DANCE, INC., makes no express or implied warranties of any kind regarding activity participation at a GULFCOAST DANCE, INC., activity.
7. You agree to indemnify and save and hold harmless GULFCOAST DANCE, INC., and its directors, officers, employees or agents from any loss, liability, damage or cost they may incur as a result of your acts or omissions at any GULFCOAST DANCE, INC., activity.
8. You agree that this release shall be interpreted as broad and inclusive as is permitted by the laws of the State of Florida, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
9. You have read this Release and agree that no oral representations, statements, warranties or inducements have been made to you.
10. You have the right to refuse to sign this agreement, and GULFCOAST DANCE, INC., has the right to refuse to allow you to participate in GULFCOAST DANCE, INC., activities if you do not sign this agreement.
11. A person agreeing on behalf of a minor under the age of 18 hereby acknowledges that he or she has the legal capacity and authority to act on behalf of the minor and to legally bind the minor to this Release, and they agree to indemnify and hold harmless GULFCOAST DANCE, INC., and its directors, officers, employees or agents for any expenses incurred, claims made, or liabilities assessed against them, as a result of any insufficiency of legal capacity or authority to act on behalf of the minor in the execution of this Release.
12. I acknowledge that I have carefully read and voluntarily agree to this Release.
13. By clicking on "I agree to the terms and conditions*" on the Dance Bochette Portal, or by creating a Dance Bochette account or authorizing a person to create a Dance Bochette account on your behalf, you acknowledge that you have carefully read, understand and agree to all elements of the GULFCOAST DANCE, INC., Release and Waiver of Liability.
