Terms and Conditions
Those who are enrolled in monthly autopay will automatically be deducted an equal monthly tuition rate along with an administration fee from your credit card on file on the 5th of each month. Monthly autopay must be set up in person.
Dishonored/Returned Items/Late Fees. Buyer agrees to pay a $25 Dishonored Item Fee for any dishonored or returned check or other item along with any costs incurred regarding collection of such dishonored, returned check or other item. Upon receipt of the 2nd dishonored item, payments will only be accepted as cash, money order or valid debit/credit card in-full. A $10 Late Fee will be incurred for every 30 days an account is past due. Applicable Late Fees and Dishonored Item Fees will be automatically charged to the authorized credit/debit card on file at Momentum Performing Arts.
Cancellations/Refunds/Credits:
A) Students enrolled in classes may cancel this Agreement in writing through the MPA Drop Form at the front desk. If a student needs to withdraw from a class for any reason, a notice must be given in writing. Unless a parent or guardian signs and dates the “Class Withdrawal†letter, the parent or guardian will be responsible for tuition payments through the end of the semester. Calling or leaving a message, telling a friend, or notifying a teacher are not accepted as forms of withdrawal. A $25 withdrawal fee will be charged.
The withdrawal notice begins from the date the withdrawal letter is received. If a student who has paid for the full year/semester withdraws before the end of the year/semester, they will forfeit any discounts and their account will be readjusted. Any amount that remains will be left as a credit on your account for up to two years to be used by that student (or, as a courtesy, may be transferred to a sibling for future tuition).
B) Tuition and registration fees are non-refundable. No credits or refunds are given for Costume fees, or Performance Fees.
C) If, by reason of death, disability, or relocation a student is unable to receive all services contracted for under this Agreement, the student will be relieved from the obligation of making payment for services other than those received prior to death, relocation or the onset of disability. If such student has prepaid any sum for services, any amount allocable to services not yet received by the student will be refunded within thirty (30) days of receipt by Momentum Performing Arts of reasonable evidence of such disability or death.
Promotions. Momentum Performing Arts reserves the right to use student photographs or videos for promotional use at any time without notice.
Waiver and Release. A student who engages in any physical activity, does so at his/her own risk. This includes, without limitation, participation in any activity or instruction now or in the future made available. Student is voluntarily participating in these activities and assuming all risk of injury or contraction of any illness or medical condition that might result there from or any damage of any personal property. Buyer agrees to release Momentum Performing Arts, from any and all claims or causes of action arising out of Momentum Performing Arts staff members’ negligence. This Waiver and Release of all liability includes, without limitation, injuries which may occur as a result of use of any facility or its improper maintenance, negligent instruction or supervision, loss of consortium and/or slipping and falling at any time. Student acknowledges that he/she has carefully read this Waiver and fully understands its release of all liability. In addition, Student hereby waives any right by or on behalf of his/her self, spouse or any child (minor or otherwise), to assert legal action for any of the activities described in this paragraph. Buyer fully understands that Momentum Performing Arts staff members are not physicians or medical practitioners of any kind. Student hereby grants Momentum Performing Arts staff members permission to render temporary first aid to Student in the event of any illness and, if deemed necessary, to seek medical help, including the calling of an ambulance for said Student and/or transportation by Momentum Performing Arts staff members and/or its representatives, whether paid or volunteer, to any health care facility or hospital.
This agreement shall commence the date it is signed and expire after all amounts are paid and/or after the last day of enrolled classes or performances. All amounts must be paid up to date for student to receive any goods and/or services. You acknowledge that you have read and agree with all policies stated on this Agreement as well as any separate documents applicable and to all payment methods stated within.
