Waiver: In consideration of permission to use, today and on all future dates the property, facilities, and services of JHK Enterprises, LLC dba Collierville Arts Academy, I, on behalf of myself, my heirs, personal representatives, or assigns, do hereby release, waive, discharge, and covenant not to sue, JHK Enterprises, LLC dba Collierville Arts Academy, its directors, officers, employees, volunteers, independent contractors, and agents from liability from any and all claims arising from the ordinary negligence of any agent of JHK Enterprises, LLC dba Collierville Arts Academy or any of the aforementioned parties. This agreement applies to 1) personal injury (including death) from accidents or illnesses (including but not limited to COVID-19 or other respiratory illnesses) of any kind arising from the participation in Collierville Arts Academy activities including, but not limited to, organized activities, classes, observation, and individual use of facilities, premises, or equipment; and to 2) any and all claims resulting from the damage to, loss of, or theft of property.

Indemnification and Hold Harmless: I agree to HOLD HARMLESS AND INDEMNIFY JHK Enterprises, LLC dba Collierville Arts Academy from all claims resulting from negligence and to reimburse them for any expenses incurred by JHK Enterprises, LLC dba Collierville Arts Academy in investigating and defending a claim or suit if my claim is withdrawn, or to the extent a court or arbitration determines that JHK Enterprises, LLC dba Collierville Arts Academy is not responsible for the injury or loss.

Severability and Venue: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of Tennessee and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Likewise, I agree that if legal action is brought, it must be brought in Memphis, Shelby County, Tennessee.

Acknowledgement of Understanding: I have read this waiver of liability and indemnification agreement and fully understand its terms. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by the State of Tennessee.

The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth in Section 1. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to in Section 1 from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.

PHOTO & IMAGE RELEASE FOR ALL COLLIERVILLE ARTS ACADEMY STUDENTS:
The undersigned consents to be photographed, or for their child to be photographed, interviewed and/or videotaped by representatives of Collierville Arts Academy and/or media outlets without compensation and for the ongoing use in advertising, publicity or educational activities.

By registering and enrolling my child(ren), myself, or other family members, I/We agree to abide by the terms of this Liability Waiver in perpetuity.

General Payment and Tuition Policies for Collierville Arts Academy

Collierville Arts Academy provides a complete online Policy Guidebook available on its website for prospective parents, students, and participants to review prior to registering and participating in any activities at Collierville Arts Academy. This Collierville Arts Academy Policy Guidebook is also available to all online accounts under Documents and Files in your Parent Portal menu. When you register and enroll at Collierville Arts Academy, parents/students are required to agree to abide by and adhere to all Academy policies, rules, regulations, and guidelines.

By registering and enrolling with Collierville Arts Academy, I agree that I have been informed, fully understand, and agree to follow the general policies for Collierville Arts Academy. I understand the regular season of classes runs from August through May (10 Months) and Summer Session runs June through July (2 months).

Payment Methods
Cash, Checks, Credit/Debit Card - Visa/MasterCard, Discover, AmericanExpress, money orders, and cashier’s checks are all acceptable forms of payment. All checks must be made payable to Collierville Arts Academy.

Returned checks are subject to a $30 returned check fee. If a check is returned, the only acceptable form of payment will be cash, Visa/MasterCard, Discover, AmericanExpress, money order or cashier’s check.


Registration Fee
The registration fee is paid annually and is $30 for an individual or $50 for family registration (two or more people from the same household). Registration fees are non-refundable for any reason.

Prorations & Refunds
Tuition payments are non-refundable after the student’s first class for any reason. In cases of severe illness or injury when verified with Doctor’s written note a partial tuition refund may be issued. Refunds are not given for individual classes, class cards, competitions, performances, tickets, costume fees, convention fees, master class fees, etc.

We do not prorate tuition for missed classes. We do allow students to makeup missed classes during the term of their enrollment. Attendance is monitored weekly and updated through our online system. Any makeup lessons must be approved by the Academy Director and scheduled through our office in advance of the makeup lesson.

Tuition Payments Monthly Installments & Term Discounts
Full Season Payment Discount - Tuition may be paid for the entire season (August - May) and a 10% discount off the total of the entire season tuition will be given to those who pay for the season in full.

Partial Season Payment Discount - Tuition may be paid for half the season (August - December) and/or (January - May) and a 5% discount off the total of the season will be given to those who pay for the first half of the season in full.

Monthly Installment Plan - Tuition may be paid in ten (10) equal monthly installments. Monthly payments made after the 7th of the month will be considered late and subject to a late fee of 5%. For example: October tuition will be billed to your account on Sept. 25th and is due October 1st. After the 7th of October the amount will be past due and subject to a late fee.

Tuition Discounts
Family Member Discounts (members of the same family) will be automatically calculated by our online system once you have selected your classes for all family members.
The first child is the full rate.
The 2nd child receives a 25% discount.
The 3rd child receives a 35% discount.
The 4th and subsequent children receive a generous 50% discount.

Multi-Class Discounts
Multi-class discounts are automatically built into our tuition structure and are based on the total amount of enrolled class time per week. The more classes your student is enrolled in, the larger your discount. Our multi-class discounts offer between 25% - 50% off rates depending upon enrollment in our various classes. A member of our staff will be happy to assist you in determining the best tuition package for your situation.

Drop-In Class Rate
Our Drop-In Class Rate is $20 per class.

Dropping a Class If a student is taking multiple classes and needs to drop a single class, simply complete a Drop Form from the Front Desk with 30-days written notice prior to the next tuition installment cycle and the class can be dropped. This will change your next tuition installment amount if you are using our monthly installment paying cycle, so be sure you check with our staff to see you updated amount for the next billing cycle. If you do not give our staff 30-days written notice, your account will be subject to a $20 Administrative Fee for Class Changes.

Withdrawal from the Academy
Complete withdrawals from the Academy prior to the end of a term for instruction or is not advised, but our staff and faculty understand that some times things change for different reasons. If a student is forced to withdraw from the Academy prematurely, the student/parent must complete a Withdrawal Form available at the Front Desk. The Withdrawal Form is to be submitted 30-days prior to the withdrawal and submitted with the final tuition installment payment (cash or credit/debit card) which is equal to one month’s tuition installment if they pay by making monthly tuition installments.

Tuition payments will not cease because a student simply stops attending classes.Students who prematurely stop attending classes during the term without completing the Withdrawal Form and making their final tuition installment payment will be billed for the entire term of the class as agreed to upon their enrollment and their account will be turned over to collections if necessary.

Unpaid Balance
Students who have an unpaid monthly tuition installment balance on their account at the end of the month will not be allowed to participate in their class until their tuition balance is brought current. Students who have unpaid balances for costumes, performance fees, and other similar unpaid fees will not be allowed to take class, participate, compete, or perform until their balance is brought current. Accounts that go unpaid will be turned over to a collections agency.
